Central Information Commission
Sep 5, 2012

Sushma Singh, IC

Smt. Eshwar Devi, the appellant, widow of deceased Janki Prasad Barma who was an employee of Shreeniwas Cotton Mills Ltd., Lower Parel, Mumbai, has through her RTI application dated 18.10.2011 sought information regarding payment of terminal dues of her late husband and has requested for early clearance of these dues.

During the hearing the respondent CPIO states that the respondents have issued release of payment of Dividend Warrant Claim twice to the appellant on 23.2.2010 and 14.6.2010 regarding the terminal dues of her husband who was an employee of Shreeniwas Cotton Mills Ltd. They have subsequently issued a cheque for the said amount on 16.9.2011 which also the appellant claims has not been received by her. The Official Liquidator made ‘stop payment’ of cheque issued and thereafter issued a fresh cheque dated 6.2.2012, which the appellant has received and encashed on 16.2.2012, as per information received from the Union Bank of India.

The CPIO submits that the office of the Official Liquidator has provided all information to the appellant as and when sought by her and have never denied any information to her.

Having considered the submissions of the parties and perused the relevant documents on record, the Commission is of the view that requisite information regarding terminal dues has been provided to the appellant.

The matter is disposed of on the part of the Commission.
