Samer Singh Yadav (Dr.) v. Cpio
Satyananda Mishra, CIC
2. The Appellant did not turn up for the hearing in spite of notice. The Respondents were present and made their submissions.
3. In the RTI application preferred on 13 October 2011, the Appellant had sought three items of information concerning the Bharat Sevak Samaj, an organisation supposed to be established by Pt. Jawahar Lal Nehru, the first Prime Minister of India. He had not enclosed the application fee in the valid manner. In spite of that, the CPIO had responded in time and informed him that the desired information was not held by them and they could not transfer the application to other public authorities either since the Appellant had not deposited the application fee in the valid manner. The Appellate Authority had endorsed the stand taken by the CPIO.
4. The information sought by the Appellant is not very clear. The Bharat Sevak Samaj is a non-governmental organisation. It is unlikely that either the Lok Sabha or any other public authority in the Central Government would have any of the information sought by the Appellant. As far as the copy of the Indian Constitution as approved by the Constituent Assembly (item 2 of the RTI application) is concerned, it is a published document and can be easily procured from both government and private booksellers. Thus, there is no information which can be disclosed in this case. We cannot direct the CPIO to provide any such information either.
5. The appeal is disposed off accordingly.
6. Copies of this order be given free of cost to the parties.
