It is brought to our notice that the parties did not have an agreement for the year 2006. Now the year 2007 has started and if at all a fresh agreement has to be executed between the parties for which it is for the parties to negotiate the terms and arrive at a settlement which ultimately has to be reduced to an agreement. Accordingly, we direct the parties to negotiate and reach a settlement about the terms on which an agreement may be executed for the year 2007.

The learned counsel for respondent submits that there are dues for the past period. This aspect be also negotiated by the parties. While considering the payment of past dues, the respondent may consider the plea of the petitioner that its subscriber base had fallen at the relevant time.

This petition is disposed of with these observations.
