Cellular Operators Association Of India Petitioner v. Union Of India
The Petitioner, Sanjay Bhalla, claiming to represent the “Telecom Public Policy Forum” seeks to intervene in the Petition filed by the Cellular Operators Association of India against MTNL's entering into the Cellular Mobile Services.
(Petition No. 3/98). To establish his credentials to represent the said Forum, and to intervene in the matter, the Petitioner relies solely upon a Trust Deed, a photo-copy of which has been placed on record. This Trust deed purports to establish a trust to be known as “Telecom Public Policy Forum” but with liberty to the trustees to change the name. To set up this trust, the trust deep purports to dedicate to it a sum of Rs. 10,000/-.
A reading of the trust deed would show that the trustees of the said trust have not been named therein. When asked, the Petitioner was constrained to say that there were only two trustees, they being he himself and his wife.
Besides this trust deed, the Petitioner has singularly failed to show any interest or connection with Telecom Sector.
Such being the situation, there is clearly no occasion provided here to permit the petitioner to come in as an intervener.
Dismissed.
