Power Grid Corporation Of India Ltd. v. Madhya Pradesh State Electricity Board

Through this petition, the petitioner seeks approval of the Commission to the incentive based on availability of transmission system for Western Region for the year 2002–2003. We direct that the petition be admitted. The petitioner is directed to serve copy of the petition on respondents within two weeks from the date of this order. The respondents may file their replies within four weeks thereafter with an advance copy to the petitioner who may file its rejoinder within two weeks. The present petition be listed for hearing along with petition No. 88/2002.

IA No. 43/2003

This application has been filed for ad interim exparte order permitting the petitioner to realise incentive based on availability as claimed in the main petition. We direct that the petitioner, as an interim measure shall be paid 80% of the incentive claimed in the main petition. It bears notice that in similar petitions for the previous years, the Commission had allowed 80% of the incentive claimed by the petition as an interim measure and the present order is in line with the orders passed by the Commission earlier.
