SMC PNEUMATICS (INDIA) PVT. LTD. & ANR v. JOGESH KWATRA
Factual and Procedural Background
The appellant company filed an appeal which was scheduled for hearing. On the first call, no one appeared on behalf of the appellant. The respondent's counsel informed the Court about a statement made by Mr. Rajesh Chanana, the appellant's Authorized Representative, before the Joint Registrar on 14.9.2016, indicating that since the respondent had expired, the appellant intended to withdraw the appeal. The Joint Registrar referred the matter to the Court. On the second call, again no one appeared for the appellant. The court concluded that the appellant was not interested in prosecuting the appeal.
Legal Issues Presented
The opinion addresses a procedural matter and does not frame distinct legal issues.
Arguments of the Parties
The opinion does not contain a detailed account of the parties' legal arguments.
Table of Precedents Cited
No precedents were cited in the provided opinion.
Court's Reasoning and Analysis
The Court relied on the absence of the appellant’s presence on two successive calls and the statement made by the appellant's Authorized Representative before the Joint Registrar indicating an intention to withdraw the appeal due to the respondent’s death. Based on these facts, the Court inferred that the appellant was not interested in prosecuting the appeal and proceeded to dismiss it for default and non-prosecution.
Holding and Implications
The appeal is dismissed in default and for non-prosecution.
The direct consequence of this decision is the termination of the appeal due to the appellant’s failure to appear and prosecute the case. The opinion does not establish any new legal precedent or broader implications beyond the immediate effect on the parties.
% 23.09.2016
1. The case was passed over on the first call as none was present for the appellant. At that stage, counsel for the respondent had drawn the attention of the Court to the statement made by Mr. Rajesh Chanana, Authorized Representative of the appellant company before the Joint Registrar on 14.9.2016 to the effect that since the respondent has expired, the appellant intends to withdraw the present appeal. In view of the submission made by the counsels for the parties, the Joint Registrar has placed the matter before this Court.
2. On the second call, the position remains the same. It is 3.15 PM, but none is present for the appellant.
3. It appears that the appellant is not interested in prosecuting the present appeal, which is accordingly dismissed in default and for non- prosecution. HIMA KOHLI, J SEPTEMBER 23, 2016/sk/rkb
