Smart Summary (Beta)

Factual and Procedural Background

The matter arises from a petition challenging an order of the Motor Accidents Claims Tribunal (MACT). In addition to the award passed by the Tribunal, the High Court granted the petitioner an additional sum of Rs 50,000 for loss of consortium, with interest at 9% per annum computed from the date of the High Court’s order (18-8-2004) until realization, instead of from the date of filing of the claim petition before the Tribunal (20-5-1982). The petitioner sought modification so that interest on the Rs 50,000 would run from 20-5-1982.

The court heard the petitioner’s counsel; the respondent’s counsel, though served, did not appear. The order concludes by disposing of the special leave petitions.

Legal Issues Presented

  1. Whether interest at 9% per annum on the additional amount of Rs 50,000 awarded for loss of consortium should be calculated from the date of filing of the claim petition (20-5-1982) rather than from the date of the High Court’s order (18-8-2004).

Arguments of the Parties

The opinion does not contain a detailed account of the parties' legal arguments.

Table of Precedents Cited

Court's Reasoning and Analysis

The court noted that the petitioner’s grievance was limited to the commencement date for interest on the additional Rs 50,000 granted towards loss of consortium. Accepting this request, the court directed that interest at 9% per annum on the said amount be allowed from the date of filing of the petition before the Tribunal (20-5-1982). The order does not set out further reasoning or any discussion of legal principles beyond this correction.

Holding and Implications

ALLOWED IN PART / MODIFIED: The court granted interest at 9% per annum on the amount of Rs 50,000 from the date of filing of the claim petition (20-5-1982).

The direct effect is that the petitioner becomes entitled to interest on the Rs 50,000 for loss of consortium from 20-5-1982 (instead of from 18-8-2004). The special leave petitions were disposed of accordingly. The order does not indicate any broader implications or creation of new precedent.

Order

1. Heard the learned counsel for the petitioner. The counsel for the respondent though served but not appeared.

2. This petition is filed against the order of the Motor Accidents Claims Tribunal. In addition to the award passed by the Tribunal the High Court was pleased to grant Rs 50,000 for loss of consortium with interest @ 9% p.a from the date of the passing of the order i.e 18-8-2004 till the date of realisation instead from the date of filing of the petition i.e 20-5-1982. The petitioner claims that she should have been allowed to have interest from 20-5-1982 i.e from the date of filing of the petition before the Tribunal.

3. We, therefore, allow interest @ 9 per cent per annum on the amount of Rs 50,000 from the date of filing of the petition i.e from 20-5-1982.

4. The special leave petitions are disposed of accordingly.
