1. This shall dispose of Criminal Miscellaneous No. M-9890 of 2011 titled ‘Harbhajan Singh v. State of Punjab’ and Criminal Miscellaneous No. M-8460 of 2011 titled ‘Piara Singh v. State of Punjab’. In regard to an incident, one FIR and a cross case came to be lodged.
2. Parties have entered into compromise and have settled their disputes, and therefore, seek quashing of the FIR and cross case by virtue of the two petitions detailed above.
3. Vide order dated 4.4.2011 passed in Criminal Miscellaneous No. M-9890 of 2011, the parties were directed to approach the Trial Court and give their statements so that the factum of compromise could be verified. Likewise, in Criminal Miscellaneous No. M-8460 of 2011, vide order dated 18.3.2011, parties were directed to approach the Trial Court for confirmation of factum of compromise.
4. Report dated 5.5.2011 has been received from the Additional Chief Judicial Magistrate, Hoshiarpur, to the effect that on account of property dispute, the incident took place. Both the parties received injuries. With the intervention of respectables, compromise has been effected and they have no objection if the FIR is quashed.
5. Learned counsel for the complainant-respondent (s) in two cases contend that Piara Singh and Harbhajan Singh are real brothers. Families want to live in peace and harmony. Continuance of proceedings shall not allow the parties to live in peace, and therefore, let the petition be allowed and FIR & cross case be quashed.
6. Since factum of compromise has been verified; all the disputes have been settled between the parties, who are close relatives; and in the interest of peace and harmony, the petitions are allowed.
7. FIR No. 286 dated 6.9.2006 under Sections 323, 324, 34 IPC, Police Station, Sadar Hoshiarpur and cross version therein, under Sections 323, 324 326, 148, 149 IPC are hereby quashed.
