Court's Reasoning and Analysis

The Court noted that the Additional Solicitor General handed over a copy of communication No. MCI-37(1)(RI-89)(UG)/2014-Med./127/90 dated 17-8-2015, which recorded that the MCI Executive Committee had decided to renew permission for admission of the second batch of MBBS students against the increased intake from 100 to 150 under Section 10-A of the IMC Act, 1956 for the academic year 2015–2016. A copy of the same communication was also provided to counsel for the Union of India.

On the basis that a resolution had been passed by MCI, the Court expressed an expectation that the Central Government would take an immediate decision on it, preferably within one week. The Court further recorded that MCI had taken its decision in the peculiar facts of the case, and concluded that the petitioner's grievance had been redressed.

Holding and Implications

DISPOSED OF: The writ petition was disposed of on the ground that, in light of MCI's decision to renew permission for the increased intake for 2015–2016, the petitioner's grievance stood redressed.

The direct effect of the order is that the proceedings ended without further adjudication on merits, while the Court recorded its expectation that the Central Government would decide on the MCI resolution preferably within one week. The order states that MCI acted in the peculiar facts of the case and does not indicate that any new precedent or broader legal principle was laid down.
