People'S Rights And Social Responsibility Centre And Others v. Union Of India And Others
Factual and Procedural Background
This order arises in ongoing proceedings before the court concerning the problem of silicosis affecting a large number of persons working in stone crushers, stone quarries, construction work, glass factories, quartz crushing factories, stone mines, and other silicon dust producing plants.
Pursuant to earlier directions of the court, the National Human Rights Commission (NHRC) conducted a survey regarding the prevalence of silicosis. A preliminary report was prepared, indicating that the problem is prevalent in many States and that further survey work remains to be done.
In this procedural context, the court passed directions regarding: impleadment of additional necessary parties, assistance to be provided by Union Ministries to NHRC, steps for relief and compensation to affected persons, and the future listing of the matter.

Table of Precedents Cited
No precedents were cited in the provided opinion.
Court's Reasoning and Analysis
The court first determined that the Central Pollution Control Board (CPCB) is a necessary party for effective adjudication in this matter. On that basis, it directed that CPCB be impleaded as an additional respondent and ordered that notice be issued to CPCB, returnable after six weeks.
The court then recorded the statement of learned counsel for NHRC that, pursuant to earlier directions, NHRC had conducted a survey on the problem of silicosis affecting workers in various industries and locations associated with silicon dust exposure. The court noted that the preliminary report of NHRC showed that silicosis is prevalent in many States and that a further survey is required.
Recognizing that the Ministry of Health and the Ministry of Labour, Union of India, are responsible for providing necessary assistance in such matters, the court directed these Ministries to extend all further assistance to NHRC to enable it to carry out further action and surveys regarding silicosis.
The court further directed that NHRC may:
- Take up specific and confirmed cases of persons suffering from silicosis and recommend that immediate medical relief be provided to them through the authorities concerned; and
- In cases where individuals have died due to silicosis, recommend that compensation be provided through the authorities concerned.
Additionally, the court directed learned Senior Counsel for the petitioner to inform the court, on the next date of hearing, which States should be impleaded as necessary party-respondents in the matter. The case was then ordered to be listed after six weeks, consistent with the returnable date for the notice to CPCB.
Holding and Implications
The court’s operative directions can be summarized as follows: (1) CPCB is to be impleaded as an additional respondent and notice is issued to it, returnable after six weeks; (2) The Ministry of Health and the Ministry of Labour, Union of India, are directed to extend all further assistance to NHRC in relation to silicosis surveys and actions; (3) NHRC is authorized and directed to take up specific confirmed cases of silicosis, recommending immediate medical relief for sufferers and compensation for the families of those who have died due to silicosis; (4) Petitioner’s Senior Counsel must indicate which States are to be impleaded as necessary party-respondents; (5) The matter is to be listed after six weeks.
The immediate implications are procedural and remedial: additional respondents are to be joined, Union Ministries must support NHRC’s work, and NHRC is to initiate concrete steps for medical relief and compensation in confirmed silicosis cases. The opinion does not articulate any broader legal precedent beyond these directions in the specific matter.
Order
1. In our view, the Central Pollution Control Board is a necessary party to be impleaded as an additional respondent in this matter. Let notice be issued to the Central Pollution Control Board returnable after six weeks.
2. Learned counsel appearing for the National Human Rights Commission (for short “NHRC”) states that pursuant to the directions, NHRC has conducted a survey regarding the problem of silicosis which is affecting a large number of people working at the premises of stone crushers, stone quarries, construction work, glass factories, quartz crushing factories, stone mines and other silicon dust producing plants, etc.
3. The preliminary report of NHRC shows that the problem of silicosis is prevalent in many States and further survey is to be conducted in this regard and since the Ministry of Health and Ministry of Labour, Union of India have to provide all necessary assistance, we direct the Ministry of Health and Ministry of Labour, Union of India to extend all further assistance to NHRC for further action in this regard. NHRC may take up the specific and confirmed cases of persons who are suffering from silicosis and shall recommend to provide immediate medical relief to them through the authorities concerned and in case of those persons who died because of silicosis, may provide for compensation through the authorities concerned.
