Om Parkash Sharma And Others Petitioners v. Punjab School Education Board And Another S
HARINDER SINGH SIDHU, J.
The present writ petition has been filed for seeking directions to the respondents to step up the pay of the petitioners (Senior General Category Employee) at par with their junior Scheduled Caste category employee, namely Sh. Khushbir Singh son of Sh. Labh Singh (Junior Schedule Caste Category Employee, Seniority No. 136) in accordance with the law as laid down by this Court in Civil Writ Petition No. 18307 of 2011 titled as “Gurmeet Singh v. Punjab School Education Board”
Counsel submits that legal notice dated 04.07.2014 (Annexure P-5) has been served upon the respondents for redressal of grievance, but to no avail.
Counsel submits that he would be satisfied if a time bound direction is given to respondent No. 1 to take action on the above said legal notice.
After hearing counsel for the petitioners and in view of the facts summarized above, this Court is of the opinion that no useful purpose would be served if notice of motion is issued upon the respondents to call upon them to file reply in view of the limited relief which the petitioners are seeking.
Accordingly, the present writ petition is disposed of with a direction to respondent No. 1 to take into consideration legal notice dated 04.07.2014 (Annexure P-5) and pass necessary orders thereon within a period of three months from the date of receipt of a certified copy of this order. In case the petitioners are found entitled for their claim, the amount be disbursed to them within a period of one month thereafter. In case relief is to be denied to the petitioners, a speaking order be passed which shall be communicated to the petitioners within the aforesaid period.
