Sukhwinder Singh And Others Petitioner(S) v. State Of Punjab And Others (S)

Punjab & Haryana High Court
Jan 29, 2014

RAM CHAND GUPTA, J. (Oral)

This order will dispose of both the afore-mentioned petitions filed under Section 482 of the Code of Criminal Procedure for quashing of FIR No. 26 dated 14.04.2007 under Sections 323, 324, 325, 148 read with Section 149 of Indian Penal Code, registered at Police Station Sohana, District S.A.S Nagar (Mohali) alongwith all other consequential proceedings arising therefrom as well as cross-version recorded on the statement of Sukhwinder Singh in the said FIR alongwith all other consequential proceedings arising therefrom on the basis of compromise, having been entered between the parties.

I have heard learned counsel for the parties and have gone through the record.

It has been stated by learned counsel for the parties that it is a case of version and cross-version and the same has since been settled due to intervention of respectable persons and relatives from both the sides as both the parties belong to same village.

Both the parties appeared in person and filed their respective affidavits, admitting the factum of compromise and stating that they are having no objection if the FIR and cross-version alongwith consequential proceedings are quashed.

In appropriate cases FIR/cross-version can be quashed on the basis of compromise by exercising power under Section 482 Cr.P.C, even if the offences are not compoundable. It was so held by Full Bench of this Court in the case of Kulwinder Singh v. State of Punjab, 2007 (3) RCR (Crl.) 1052.

Since the dispute has been settled between the parties, in the interest of harmonious relations between the parties, who are residents of same village, both the aforementioned petitions are allowed and the impugned FIR No. 26 dated 14.04.2007 under Sections 323, 324, 325, 148 read with Section 149 of Indian Penal Code, registered at Police Station Sohana, District S.A.S Nagar (Mohali) alongwith all consequential proceedings qua petitioners Sukhwinder Singh, Gurmeet Kaur, Kashmir Kaur, Dilbag Singh Gora, Sucha Singh and Baljinder Singh and cross-version recorded on the statement of Sukhwinder Singh in the said FIR alongwith all consequential proceedings qua petitioners Pal Singh, Charan Kaur, Bhupinder Singh, Hardeep Singh, Ram Asra, Gurpreet Singh, Sikandar Singh, Satwinder Kaur and Jagir Kaur are, hereby, quashed.
