Relevant facts emerging during hearing: Both the parties present. Appellant sought copies of the complete file diary No.1839/SIO(P)/ Vig/2005 in RC No.3(A)/2005 pertaining to Retro-reflective Sign Boards. The appellant further stated that he is an accused in this case filed by the CBI relating to the placing of Retro-reflective Sign Boards in 2003 by the MCD. The case is filed in the CBI Special Court in 2005 and court proceedings are on. The appellant says that he wants these papers for his defence. The respondent PIO (Legal) stated that copies of pages 1 to 192 have been supplied to the appellant which were actually required. The respondent further submitted that rest of the papers in the file have not been supplied invoking 8(i)(j) which are relating to the prosecution. The appellant stated that he wants copies of the entire correspondence file running into 362 pages.

Interim Decision: The Commission directs the respondent to put up the file before the Commission and show the pages which have been denied to the appellant invoking the section 8(i)(j) of the RTI Act within one week of receipt of this order for final decision.
