Ummed Kushwaha v. The State Of Madhya Pradesh

Madhya Pradesh High Court
Aug 25, 2015

MCRC-13788-2015 (UMMED KUSHWAHA Vs THE STATE OF MADHYA PRADESH) 25-08-2015 Shri Ramesh Tamrakar, counsel for the applicant.

Shri G.S. Thakur, Panel Lawyer for the respondent/State.

Heard the learned counsel for the parties.

This is a repeat bail application filed on behalf of the present applicant, whereas his previous application was dismissed on 20.7.2015 being withdrawn.

The applicant is in custody since 9.6.2015 relating to Crime No.19/15 registered at Police Station Bina, District Sagar for the offences punishable under Sections 419, 420, 465, 467, 468, 471 and 120-B of the IPC.

After considering the submissions made by the learned counsel for the parties, looking to the facts and circumstances of the case and gravity of the offence, without expressing any view on the merits of the case, a grave case of forgery has been alleged against the applicant that he had radically participated in creation of forged power of attorney and consequential sale deed by impersonating one Laxmi Bai. Looking to the gravity of offence, I am of the view that it is not a fit case in which bail may be granted to the applicant.

Consequently, the application under Section 439 of Cr.P.C. filed by the applicant namely Ummed Kushwaha relating to aforesaid crime is hereby dismissed.
