Order

1. Taken on board. While issuing notice on the special leave petition on 11-8-2011 and on Interlocutory Application No. 2 on 7-9-2010 (2012) 8 SCC 324, this Court had directed the parties to maintain status quo with regard to the property in question, for a period of six weeks or until further orders, whichever was earlier. It appears that, thereafter, the said order was not extended, and in the meantime, the Debts Recovery Tribunal proceeded with the matter and passed certain orders, including an order to hand over the physical possession of the flat in question to the Court Receiver on 11-1-2011. The upshot of the matter is that till today, the petitioner remains in possession of the flat in question.

2. From the report of the Deputy Registrar (Mentioning), the special leave petition is fixed for consideration on 30-1-2012. Let the matter appear on that date and let it not be deleted from the list. Till 6-2-2012, the parties are once again directed to maintain status quo with regard to the flat in question.

3. The IA is disposed of in the above terms.
