Rockwool (India) Private Limited v. Commissioner Of Customs And Central Excise, Hyderabad .
Factual and Procedural Background
Civil Appeals (CAs) Nos. 60-61 and 543 of 2003 were withdrawn on applications filed by the appellant’s counsel; those appeals were therefore dismissed as withdrawn. In CA No. 223 of 2003, the dispute concerned the correct Central Excise classification of slagwool and rockwool manufactured by the appellant. The Revenue classified the goods under Sub-Heading 6803.00 (“Slagwool, rockwool and similar mineral wools”) of the Central Excise Tariff Act, 1985, while the appellant claimed classification under Sub-Heading 6807.10. The Customs, Excise and Service Tax Appellate Tribunal (the “Tribunal”) had ruled for the Revenue on both merits and limitation. The present opinion addresses the appellant’s challenge to that Tribunal decision.
Legal Issues Presented
- Whether slagwool and rockwool manufactured by the appellant are correctly classifiable under Sub-Heading 6803.00 or under Sub-Heading 6807.10 of the Central Excise Tariff Act, 1985.
- Whether, in light of the Tribunal’s larger Bench decision in CCE v. Punj Star Insulation Fibre Co., the earlier contrary Tribunal order could stand.
Arguments of the Parties
Appellant's Arguments
- Drew attention to conflicting Tribunal decisions on the proper classification of slagwool and rockwool.
- Relied on the larger Bench ruling in CCE v. Punj Star Insulation Fibre Co., which held that such goods fall under Sub-Heading 6807.10.
- Noted that the Revenue had not appealed the larger Bench ruling, allowing it to attain finality.
Table of Precedents Cited
| Precedent | Rule or Principle Cited For | Application by the Court |
|---|---|---|
| CCE v. Punjstar Insulation Fibre Co., 2004 165 ELT 543 (Tri.) | Held that slagwool and rockwool are classifiable under Sub-Heading 6807.10. | Used as authoritative guidance demonstrating the correct classification and the absence of any pending challenge by the Revenue. |
| CCE v. Punj Star Insulation Fibre Co., 2004 170 ELT 43 (Tri.) | Confirmed the same classification conclusion in favour of the assessee. | Reinforced the binding nature of the larger Bench view relied on by the appellant. |
Court's Reasoning and Analysis
The Court observed that a larger Bench of the Tribunal had already settled the classification issue in favour of assessee-manufactured slagwool and rockwool falling under Sub-Heading 6807.10. Because the Revenue had chosen not to appeal that larger Bench decision, it had attained finality. Accordingly, the impugned Tribunal order—decided contrary to the larger Bench ruling—could not be sustained. Having resolved the matter on merits, the Court found it unnecessary to examine the limitation question.
Holding and Implications
The appeal in CA No. 223 of 2003 is allowed; the impugned Tribunal order is set aside, and slagwool and rockwool manufactured by the appellant are classified under Sub-Heading 6807.10 of the Central Excise Tariff Act, 1985. The Court awarded no costs. The decision directly benefits the appellant by applying the lower duty classification; it does not establish a new legal principle but affirms the finality of the Tribunal’s larger Bench ruling. The other civil appeals (CAs 60-61 and 543 of 2003) were dismissed as withdrawn.
Order
CAs Nos. 60-61 and 543 of 2003
1. The counsel for the appellant has filed applications viz. IAs Nos. 5-6 in CAs Nos. 60-61 of 2003 and IA No. 3 in CA No. 543 of 2003 seeking withdrawal of the civil appeals. These applications are allowed. Consequently, the civil appeals stand dismissed as withdrawn.
CA No. 223 of 2003
2. The point in dispute is regarding the correct classification of slagwool and rockwool manufactured by the appellant. According to the Revenue, the goods manufactured by the appellant are classifiable under Sub-Heading 6803.00 of the Central Excise Tariff Act, 1985 (for short “the Tariff Act”) whereas claim of the assessee is that the goods manufactured by it are classifiable under Sub-Heading 6807.10 of the Tariff Act.
3. The contending entries as were in existence at the relevant time read:
“Heading No. Sub-Heading No. Description of goods Rate of duty (1) (2) (3) (4) * * * 68.03 6803.00 Slagwool, rockwool and similar mineral wools 16% * * * 68.07 Goods, in which more than 25% by weight of red mud, press mud or blast furnace slag or one or more of these materials, have been used; all other articles of stone, plaster, cement, asbestos, mica or of similar materials, not elsewhere specified or included”
4. The Tribunal by its impugned order 2003 152 ELT 414 (Tri) has decided the appeal in favour of the Revenue on merits as well as on the question of limitation and held that the goods manufactured by the appellant will fall under Sub-Heading 6803.00 Hence, the assessee is in appeal before us.
5. The counsel appearing for the appellant has brought to our notice that there was a conflict of opinion between different Benches of the Tribunal regarding correct classification of the slagwool and rockwool and noticing the conflict between the different Benches, the matter was referred to a larger Bench of the Tribunal, in CCE v. Punjstar Insulation Fibre Co. 2004 165 ELT 543 (Tri) which gave its decision in favour of the assessee holding that the goods manufactured by the appellant are classifiable under Sub-Heading 6807.10 The decision of the larger Bench is reported in CCE v. Punj Star Insulation Fibre Co. 2004 170 ELT 43 (Tri) Admittedly, the Revenue did not file any appeal against the decision of the larger Bench and the same has attained finality.
6. In view of this, we accept this appeal; set aside the impugned order of the Tribunal and it is held that the slagwool and rockwool manufactured by the appellant would be classifiable under Sub-Heading 6807.10 Since we have decided the appeal on merits, we need not go into the question of limitation. No costs.
