Bhagwati Devi And Ors. v. I.S. Goel And Ors.

Supreme Court Of India
Dec 13, 1982
Smart Summary (Beta)

Factual and Procedural Background

This opinion addresses transfer petitions under Section 25 of the Code of Civil Procedure seeking transfer of multiple Motor Accident Compensation Applications from one Motor Accidents Claims Tribunal (MACT) to another. Specifically, Compensation Application Nos. 3 to 15 of 1982, pending before the MACT, Moradabad, were sought to be transferred to the MACT, Delhi. The Court considered its power to order such a transfer in the context of proceedings under the Motor Vehicles Act and disposed of the petitions by ordering the transfer.

Legal Issues Presented

  1. Whether a Motor Accidents Claims Tribunal constituted under the Motor Vehicles Act is a “civil court” for the purposes of Section 25 of the Code of Civil Procedure.
  2. Whether, in the circumstances presented, the pending compensation applications should be transferred from the MACT, Moradabad to the MACT, Delhi.

Arguments of the Parties

The opinion does not contain a detailed account of the parties' legal arguments.

Table of Precedents Cited

Precedent Rule or Principle Cited For Application by the Court
State of Haryana v. Darshana Devi (Smt) & Others, 1979 A.C.J. 205 (S.C.) Observations supporting the characterization of the Motor Accidents Claims Tribunal as a civil court for certain procedural purposes. Relied upon to hold that a MACT is a civil court for the purposes of Section 25 CPC, thereby enabling the Supreme Court to entertain and grant transfer of MACT proceedings.

Court's Reasoning and Analysis

The Court’s analysis is concise and proceeds in two steps:

  • First, invoking the observations in State of Haryana v. Darshana Devi (Smt) & Others, the Court concluded that the Motor Accidents Claims Tribunal constituted under the Motor Vehicles Act qualifies as a civil court for the limited purpose of Section 25 of the Code of Civil Procedure. This threshold determination established the Court’s authority to order a transfer of MACT proceedings under Section 25 CPC.
  • Second, having affirmed its jurisdiction, the Court stated that the cases before it were “fit cases” for transfer from the MACT, Moradabad to the MACT, Delhi. The order does not elaborate on specific factual grounds for this fitness; it records the Court’s satisfaction and accordingly allows the transfer petitions.

Holding and Implications

PETITIONS ALLOWED; TRANSFER ORDERED.

The Supreme Court held that, in view of the cited precedent, a Motor Accidents Claims Tribunal is a civil court for the purposes of Section 25 CPC. Exercising that power, the Court ordered that Compensation Application Nos. 3 to 15 of 1982 pending before the MACT, Moradabad be transferred to the MACT, Delhi.

Implications: The immediate effect is that the specified compensation applications will now be heard by the MACT, Delhi. The order reaffirms the applicability of Section 25 CPC to MACT proceedings for transfer purposes. No broader implications or new precedent beyond this reaffirmation are articulated in the opinion.

ORDER

1. In view of the observations of this Court in State Of Haryana v. Darshana Devi (Smt) & Others 1979 A.C.J. 205 (S.C.), we are of the view that the Motor Accidents Claims Tribunal constituted under the Motor Vehicles Act is a civil Court for the purposes of Section 25 of the Code of Civil Procedure. We are satisfied that the cases before us are fit cases for being transferred from the file of the Motor Accidents Claims Tribunal, Moradabad to the file of the Motor Accidents Claims Tribunal Delhi. The transfer petitions are accordingly allowed and Compensation Application Nos. 3 to 15 of 1982 pending before the Motor Accidents Claims Tribunal, Moradabad are transferred to the file of the Motor Accidents Claims Tribunal, Delhi.
