Harichand v. Fakir Sadrudin
Bombay High Court
Nov 14, 1901
Per Curiam:-
We set aside the order of the District Magistrate awarding on appeal, compensation under section 250, as in our opinion, such procedure is not justified by the Code. The expression in section 250 "the Magistrate by whom the case is heard" does not, we think, include the Court of appeal, which must often be the Court of Session.
