Tulsi Ram v. State Of Uttar Pradesh .
Factual and Procedural Background
This opinion addresses an appeal limited to the question of sentence. The court noted two mitigating factors: (1) the appellant did not intend to cause injury to the complainant in any vital part of the body, and (2) the appellant’s only son is in a mental hospital. On this basis, the court considered whether the originally imposed sentence should be reduced.
Legal Issues Presented
- Whether the sentence of five years’ rigorous imprisonment should be reduced in light of the finding that the appellant did not intend to cause injury to a vital part of the complainant’s body.
- Whether the appellant’s personal circumstance—having his only son in a mental hospital—warrants a reduction of the sentence.
Arguments of the Parties
The opinion does not contain a detailed account of the parties' legal arguments.

Court's Reasoning and Analysis
The court exercised its sentencing discretion based on two explicit mitigating considerations. First, it accepted that the appellant lacked the intention to cause injury to any vital part of the complainant’s body. Second, it took into account the appellant’s personal hardship arising from the fact that his only son is confined in a mental hospital. Having regard to these factors, the court concluded that the originally imposed sentence was excessive and that a reduction was appropriate. The reasoning is concise and rooted exclusively in these mitigating factors, without additional elaboration.
Holding and Implications
Appeal allowed on the question of sentence; sentence reduced from five years’ rigorous imprisonment to three years’ rigorous imprisonment.
Implications: The immediate effect is a two-year reduction in the appellant’s custodial term. The opinion does not discuss broader legal implications or establish a new legal standard; rather, it reflects case-specific mitigation applied to the sentence.
P.N Bhagwati, J.— We are of the view that having regard to the fact that the appellant did not intend to cause injury to the complainant in any vital part of the body and also having regard to the fact that his only son is in mental hospital, the sentence imposed on the appellant should be reduced. Hence we allow the appeal on the question of sentence and reduce the sentence from five years rigorous imprisonment to three years' rigorous imprisonment.
