Kuppan And Others v. State Of T.N .
Factual and Procedural Background
Three appellants were prosecuted and convicted for offences under Sections 326, 324 and 452 of the Indian Penal Code (IPC). They were awarded different terms of imprisonment. On appeal, both the conviction and the sentences were confirmed. In revision, the sentences were modified: the first accused (A-1) was sentenced mainly under Section 326 IPC to imprisonment for a period of one-and-a-half years; the third accused (A-3) was sentenced to the same period of imprisonment for the offence under Section 324 IPC; and the second accused (A-2) was sentenced only to pay a fine of Rs 1500.
The present order is passed after leave was granted. The court reviews the sentences imposed by the High Court, particularly in relation to the three accused, and considers whether any interference with the sentences is warranted.
Legal Issues Presented
- Whether the sentence imposed on the first accused under Section 326 IPC, as modified by the High Court, required further interference.
- Whether the sentence of fine imposed on the second accused required interference.
- Whether the sentence of one-and-a-half years' imprisonment and fine imposed on the third accused under Section 324 IPC (and also convicted under Section 341 IPC) was excessive and required reduction.
Arguments of the Parties
The opinion does not contain a detailed account of the parties' legal arguments.

Court's Reasoning and Analysis
The court first considers the nature of the injuries and the role of each accused. It notes that a grievous hurt was inflicted on the head of the injured person and that this act is attributed to the first accused. In light of the seriousness of the injury and the responsibility ascribed to A-1, the court finds no reason to disturb the sentence of one-and-a-half years' imprisonment imposed by the High Court on the first accused under Section 326 IPC.
As regards the second accused, the court records that she has only been sentenced to pay a fine of Rs 1500. The court finds no reason to interfere with this sentence either.
The court then turns to the position of the third accused, who is the son of A-1 and A-2. He is convicted under Section 324 IPC and also under Section 341 IPC. The court observes that the sentence of one-and-a-half years' imprisonment awarded to him for the offence under Section 324 IPC "appears to be excessive," given that his conviction is under Section 324 IPC (voluntarily causing hurt by dangerous weapons or means) and Section 341 IPC (wrongful restraint), rather than for causing grievous hurt under Section 326 IPC.
On this basis, the court decides to reduce the sentence imposed on the third accused for the offence under Section 324 IPC to the period of imprisonment already undergone. The court further holds that the fine portion of the sentence in respect of A-3 should also be deleted. The reasoning is thus grounded in proportionality of punishment to the specific offences of conviction and the relative gravity of the acts attributed to each accused.
Holding and Implications
HOLDING: The appeal is DISPOSED OF with a partial modification of sentences:
- The sentence of one-and-a-half years' imprisonment imposed by the High Court on the first accused under Section 326 IPC is left undisturbed.
- The sentence imposed on the second accused, namely a fine of Rs 1500, is also left undisturbed.
- The sentence imposed on the third accused for the offence under Section 324 IPC is reduced to the period already undergone, and he is directed to be set at liberty. The fine portion of the sentence as regards the third accused is deleted.
IMPLICATIONS: The decision results in immediate release of the third accused from custody (to the extent he has already undergone imprisonment) and removes the financial penalty against him. For the first and second accused, the High Court's sentencing remains intact. The order operates only on the facts and sentences in this case and does not articulate any broader legal principle or new precedent beyond the proportional adjustment of the sentence for the third accused.
Order
1. Leave granted.
2. In this case three appellants have been convicted and sentenced to different terms of imprisonment for offences under Sections 326, 324 and 452 of the Indian Penal Code. In appeal the conviction and sentences were confirmed but in revision the sentence was reduced to imprisonment for a period of one-and-a-half years for the first accused under Section 326 mainly. For the third accused the same period of imprisonment was awarded for the offence under Section 324 IPC. The second accused was sentenced only to pay a fine of Rs 1500.
3. A grievous hurt was inflicted on the head of the injured and that is attributed to the first accused. We are not inclined to disturb the sentence imposed by the High Court on the first accused. Even regarding the second accused (she is sentenced to fine alone) there is no reason to interfere with the sentence. But the sentence as for the third accused who is the son of A-1 and A-2 appears to be excessive as he is convicted only under Section 324 IPC besides Section 341. We, therefore, reduce the sentence imposed on the third accused for the offence under Section 324 IPC to the period already undergone. In other words he shall be set at liberty. The fine portion of the sentence is also deleted as for A-3.
4. The appeal is disposed of.
