This writ petition has been filed to quash qualification prescribed for the post of Multipurpose Health Worker (Male). Challenge has also been laid to the Haryana Health Department Multipurpose Health Supervisors & Multipurpose Health Workers Group ‘C’ Service Rules, 1984.

It is on record that the petitioners had earlier filed CWP Nos. 25772 of 2013 and 26061 of 2013 in this Court which were dismissed as withdrawn on 4.2.2014 Order passed reads thus:-

“The writ petition is permitted to be withdrawn with liberty to file a fresh petition on the same cause of action, on same/similar and other grounds besides challenging the vires of the statutory rules governing the appointment to the posts of Multipurpose Health Worker (Male). The interim order shall continue to enure in favour of the petitioner as passed in this writ petition for a period of three weeks from today, whereafter it shall cease to operate.”

It appears that when the Court was not agreeing with the petitioners, they have opted to withdraw the writ petitions. Now separate writ petition has been filed. Except mentioning those Rules and baldly stating that those Rules are arbitrary and unreasonable, not a single word has been said over and above the grounds taken in earlier writ petitions which were dismissed as withdrawn.

A similar matter came to this Court in CWP No. 2629 of 2014 titled as Dharmander v. State of Haryana which was dismissed on 12.2.2014

In view of order passed in that writ petition, this petition is also dismissed.
