(xiv) "compartment" means any room, workshop, godown or other covered, enclosed and protected place in a prison, other than a cell or ward;

(xv) "competent authority" means an officer or authority having jurisdiction and legal authority to deal with a particular matter in question;

(xvi) "confinement" means confinement in a prison and includes detention therein under any law providing for preventive detention;

(xvii) "convict" means any prisoner who has been sentenced for any term by a Court of law or tribunal or under Court-martial;

(xviii) "convicted criminal prisoner" means any criminal prisoner under sentence of a Court or Court-martial, and includes a person detained in prison under the provisions of Chapter VIII of the Code of Criminal Procedure, 1973(Central Act 2 of 1974) or under the Prisoners Act, 1900 (Central Act 3 of 1900);

(xix) "convict officer" means a prisoner appointed to assist the staff members in the administration of the prison under Chapter 35 of these rules;

(xx) "correctional services"means any service that is provided pursuant to the Act, or under a program established pursuant to the Act, and includes services related to the assessment, supervision, treatment, training, control, custody, reformation, and rehabilitation of offenders;

(xxi) "Court" means a Court established by any law for the time being in force and includes any officer or authority vested with the powers or exercising civil, preventive criminal or revenue jurisdiction under any law for the time being in force;

(xxii) "criminal prisoner" means any prisoner duly committed to custody under the writ, warrant or orders of any court exercising criminal jurisdiction or Court-martial;

(xxiii) "Deputy Superintendent Jail (Administration)" means agazetted officer designated as such by the Government;

(xxiv) "Deputy Superintendent Jail (Industries and Welfare)" means a gazetted officer designated as such by the Government;

(xxv) "Deputy Superintendent Jail (Security)" means a gazette officer designated as such by the Government;

(xxvi) "Department "means the Jails Department, Haryana;

(xxvii) "Deputy Inspector General" means Deputy Inspector General of Prisons; (xxviii) "detenue" means any person detained in a prison on the orders of the competent authority under the relevant preventive laws;

(xxix) "Director General" means the Director General of Prisons;

(xxx) "District Prison" means any prison to which prisoners from one or more districts are ordinarily committed and includes every prison other than a Central Prison, maximum security prison, Special Prison, Sub Prison, Open Air Prison or Semi-Open Air Prison;

(xxxi) "District Probation Officer" means the District Probation Officer appointed by the Government under the Probation of Offenders Act, 1958 (Central Act 20 of 1958);

(xxxii) "duty officer" means an officer not below the rank of Head Warder assigned by the Superintendent to be the executive in- charge of the main gate, to supervise the guarding personnel and deal with any emergent situation; (xxxiii) "executive in-charge" means an officer, not below the rank of Head Warder assigned by the Superintendent to be the executive in- charge of any ward, barrack, enclosure, or any other area of the prison;

(xxxiv) "family" means the spouse, children, sibling, parents, grand parents, or grand children of the prisoner;

(xxxv) "foreign prisoner" means a prisoner who is not a citizen of India;

(xxxvi) "furlough" means temporary release from custody of a convicted prisoner on account of good behavior over a period of time as specified by the relevant Act, rules, or instructions.

(xxxvii) "gangster" means an individual, committing an activity prohibited by law, singly or jointly, either as a member of an organized crime syndicate or on behalf of such syndicate, by use of violence or threat of violence or intimidation or other unlawful means, to gain pecuniary benefits, or gaining undue economic or other benefits for himself or any other person; (xxxviii) "geriatric inmate" means a prisoner who is sixty-five years of age or above and medically unable to manage his daily affairs independently without assistance;

(xxxix) "Government" means the Government of the State of Haryana in the administrative department;

(xl) "habitual offender" means a prisoner who has been convicted in two or more cases, or is convicted in one case and facing trial in two or more cases, or is facing trial in three or more cases;

(xli) "hardcore prisoner" shall have the same meaning as defined in the Haryana Good Conduct Prisoners (Temporary Release) Act, 2022 (15 of 2022); (xlii) "Head of the Department" means the Director General of Prisons; (xliii) "high-risk prisoner" means a prisoner with a high propensity towards violence, escape, self-harm, or disorderly behavior, or who is likely to create unrest in the prison and pose threat to public order, or who suffers from suicidal tendencies or any substance-related and addictive disorder with intermittent violent behavior, or who has a threat to limb or life from other prisoners or who are facing specific identifiable threat; (xliv) "history ticket" means the ticket exhibiting such information as required in respect of each prisoner, by the Act, rules or instructions issued thereunder from time to time and includes a record of all important occurrences, sanctions accorded, and punishments awarded to the prisoner; (xlv) "inmate" means a prisoner lawfully confined in a prison; (xlvi) "Inspector General" means Inspector General of Prisons ; (xlvii) "institution" means a place where prisoners are lawfully confined; (xlviii) "juvenile" means any person who has been so defined under the provisions of the Juvenile Justice (Care and Protection of Children) Act, 2015 (Central Act 2 of 2016);

(xlix) "kotmauka" means the area between the outer and inner peripheral walls of the prison;

(l) "legal counsel" means a practitioner within the meaning of the Legal Practitioners Act, 1879 (Central Act 18 of 1879) or the Advocates Act, 1961 (Central Act 25 of 1961);

(li) "life sentenced prisoner" means a prisoner sentenced to imprisonment for life;

(lii) "Magistrate" means any person exercising all or any of the power of a judicial magistrate under the Code of Criminal Procedure, 1973 (Central Act 2 of 1974);

(liii) "maingate" means the area between the inner and outer gate of the only entrance of prison also known as deodi;

(liv) "maximum security prison" means a prison meant for the confinement of high-risk prisoners including (but not limited to) Fundamentalists, communally indoctrinated persons, naxalites, terrorists, extremists, gang leaders, prominent gang members, prisoners organizing or suspected of organizing crime from inside the prison, or those exhibiting persistent violent behavior inside the prison, previous escapees, and those having a history of attack on police or prison personnel;

(lv) "Medical Officer" means a medical officer appointed as such by the Government;

(lvi) "medical subordinate" includes pharmacy officer, male nurse, female nurse, lab technician, etc.;

(lvii) "military prisoner" means a prisoner convicted by Court-martial or Armed Forces Tribunal;

(lviii) "Narcotic Drug or Psychotropic Substance" shall have the same meaning as assigned to it in the Narcotic Drugs and Psychotropic Substances Act, 1985 (Central Act 61 of 1985);

(lix) "notification" means any authenticated information published in the Official Gazette or any other authorized publication issued by a competent authority; (lx) "offence" means any act of commission or omission made punishable by any law for the time being in force;

(lxi) "open prison, semi-open prison" means any place or part or barrack inside any prison complex or any prison which is declared by the Government as such for the confinement of eligible convicted prisoners on such conditions, as may be prescribed for giving them more liberty and more opportunity of association with the social life and facilitating their rehabilitation after release;

(lxii) "organized crime" means any continuing unlawful activity by an individual, singly or jointly, either as a member of an organized crime syndicate or on behalf of such syndicate, by use of violence or threat of violence or intimidation or coercion, or other unlawful means, to gain pecuniary benefits, or gaining undue economic or another advantage for himself or any person or promoting insurgency;

(lxiii) "parole" means the temporary release of a convicted prisoner from custody on account of good behavior over a period of time as specified by the relevant Act and rules framed thereunder. The period spent on parole shall not be counted towards the actual sentence;

(lxiv) "prison" means any place used permanently or temporarily under the general or special orders of the Government for the detention of persons including under trial prisoners, convicts, civil prisoners, preventive detenues or any other person as ordered by a court or a competent authority, and for the aftercare and rehabilitation of convicts, and includes all lands and buildings appurtenant thereto, but does not include,-

(a) any place for the confinement of persons who are exclusively in the custody of the police; or

(b) any place specially appointed by the Government under section 417 of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974);

(c) any observation home, special home, children home, shelter home, place of safety under the Juvenile Justice (Care and Protection of Children) Act, 2015 (Central Act 2 of 2015) and protective home for women set up by the Government;

(lxv) "prisoner" means any person confined in prison under the order/warrant of a Court of law or any competent authority;

(lxvi) "prisoner with mental illness" means a prisoner with mental illness as defined in the Mental Health Care Act, 2017 (Central Act 10 of 2017);

(lxvii) "Probation Officer" means Probation officer appointed by the Government under the Probation of Offenders Act, 1958 (Central Act 20 of 1958); (lxviii) "prohibited article" means an article which is prohibited and declared as such under the Act and under these rules or by an order of the Director General, Prisons;

(lxix) "recidivist" means a convict or under trial prisoner who re-offends; (lxx) "remission" means the act of reducing the period of sentence of a prisoner without changing its character as per relevant provisions of law, rules and policy;

(lxxi) "sentence" means sentence as finally decided on appeal, revision or otherwise, and includes an aggregate of more sentences than one and an order of committal to prison in default of furnishing security for keeping the peace or good behavior;

(lxxii) "separate confinement" means such confinement with or without labour, as secludes a prisoner from communication with, but not from sight of other prisoners, and allows him not less than one hour's exercise per day, and to have his meals in association with one or more prisoners; (lxxiii) "solitary confinement" means such confinement with or without labour as entirely secludes the prisoner both from the sight of, and communication with other prisoners;

(lxxiv) "special prison" means any prison established for the confinement of a particular class or classes of prisoners and notified as such under the Act by the Government;

(lxxv) "staff member" means an employee of the Department who exercises the powers or performs duties or functions related to the administration of the Act and rules made thereunder;

(lxxvi) "State" means State of Haryana;

(lxxvii) "sub-prison" means any prison other than central prisons, district prison, maximum security prison, special prisons, open air prison or semi-open Air Prison;

(lxxviii) "Subordinate Officer" means a non gazetted officer serving in the Department;

(lxxix) "Superintendent Jail" means Superintendent Jail of the prison; (lxxx) "undertrial prisoner" means a person who has been remanded by the court to judicial custody during the pendency of investigation or trial by a court of law or any competent authority;

(lxxxi) "visitor" means any person other than a staff member or prisoner, who is permitted by the competent authority to visit a prison;

(lxxxii) "wireless communications device" means a device used for connecting and communicating through any wireless communication technology; (lxxxiii) "young offender" means any prisoner who is above the age of eighteen years and has not attained the age of twenty-one years.

(2) Words and expressions used and not defined in these rules but defined in the Act or Indian Penal Code, 1860 (Central Act 45 of 1860) or in the Code of Criminal Procedure, 1973(Central Act 2 of 1974), shall have the same meaning as respectively assigned to them in those enactments; NOTE 1.- Except where otherwise provided, the words having the import of masculine gender shall be taken to include the feminine gender, and words in the singular shall include the plural and vice versa;

NOTE 2.- Any reference to open air prison or semi-open air prison shall include open air camp or semi-open air camp respectively.

(3) In a prison where prisoners under the age of twenty-one years are confined, adequate means shall be provided for separating them altogether from other prisoners.

(4) Undertrial prisoners shall, as far as practicable, be kept apart from convicts. For administrative purposes, convict officers may be deputed in barracks wherein under trials are confined.

(5) Civil prisoners shall, as far as practicable, be kept apart from criminal prisoners.

(6) Prisoners classified under different security categories shall be kept separate from each other.

(7) Lesbian, Gay, Bisexual, Transgender, Queer prisoners shall be kept separately in male and female enclosures respectively based on their medical examination on recommendation of the medical officer of the prison. Separate accommodation including toilet/bathroom facilities shall be provided for them.

NOTE:- Instructions or orders issued by the Government or the Director General in accordance with the Transgender Persons (Protection of Rights) Act, 2019 (Central Act 40 of 2019) shall be read as part and parcel of these rules and applicable as such.

(8) When in any prison, only one prisoner is lodged under any category, such prisoner may, if he so desires, be permitted to associate with prisoners of another class:

Provided that the category, with which such prisoner is permitted to associate, shall be determined by the Superintendent who shall ensure that the provisions of the Act are not in any case infringed by the permission so accorded.

(9) In a prison where number of toilets and feeding and bathing platforms is not sufficient to keep the classes completely apart at parades, appropriate arrangements for separation shall be made after giving pragmatic consideration to circumstances.

CHAPTER 6

HISTORY TICKETS

Preparations 47. (1) A history-ticket for each prisoner shall be prepared immediately on his admission into and

maintenance of prison and it shall be maintained in the manner hereinafter provided, throughout the period during history tickets. which such prisoner remains in confinement.

(2) The history-ticket may also be maintained digitally.

(3) Every history-ticket shall contain the following details amongst others, -

(a) the unique prisoner number, name, residence address, and other particulars necessary for the identification of the prisoner along with his photograph;

(b) security category of the prisoner;

(c) In case of a convict, -

(i) the nature of the offence for which he has been convicted and the provisions of the law applicable thereto;

(ii) FIR Number, date, police station, and brief facts of the case;

(iii) the date, sections, nature and extent of the sentence passed;

(iv) period undergone under section 428 of the Code of Criminal Procedure, 1973(Central Act 2 of 1974);

(v) detailed previous history of convicted including decided and pending cases along with the gist of each case;

(vi) name and details of the prisoner's nominee who is to be handed such prisoner's property, wherever applicable;

(vii) prisoner's accommodation details in the prison;

(viii) details and status of appeal or revisions filed by the prisoner, if any;

(ix) particulars of his lawyer in each case, appeal or revision;

(x) educational qualifications and skills (at the time of admission to prison and acquired while in prison);

(xi) details of duty as convict officer.

(d) The history-ticket of every under-trial prisoner shall contain the following particulars, namely: -

(i) FIR number alongwith date and section(s);

(ii) name of the police station where the FIR is registered;

(iii) brief facts of the case;

(iv) name of the trial court;

(v) date of hearing;

(vi) details of all criminal cases decided and pending, including appeals and revisions, name and particulars of the legal counsel etc.

(4) Every entry made on the history-ticket shall be so made at the time of, or as soon as possible after, the occurrence of the event to which it relates, and shall be signed with name and date by the officer who maintains it.

(5) A duplicate history-ticket shall be issued in case the original history-ticket is lost. The new history-ticket shall be marked duplicate and duly signed/certified by the competent authority. The ticket shall be reconstructed from available records maintained under these rules or otherwise.

Those who are on specific tasks of work or vocational training shall continue to work or undergo training during afternoon lockup and shall be counted at their place of work/training. Literacy classes as far as possible shall be held block-wise.

NOTE. - Schedule of lock-up and lock-out time shall ordinarily be notified by the Director General, provided that the Superintendent may cause minor changes in such schedule in view of the local requirements. The schedule may be reviewed by the Director General and necessary instructions/guidelines in this regard may be issued from time to time. Procedure after 70. On the completion of the morning routine as mentioned in rule 68 above, tea with minor morning latrine snacks shall be served to prisoners as provided for in rule 69. parade.

(ii) doing or omitting to do any act with intent to cause to oneself any illness, injury or disability including an attempt to suicide;

(iii) violating public order or prison discipline;

(iv) planning, making preparation for, instigating or abetting, directly or indirectly, the commission of any prison offence;

(v) refusing, omitting to abide by standards of behaviour, rules and regulations and lawful instructions and orders;

(vi) failing to assist a prison officer when called to do so or answering untruthfully any question put up by a prison officer or a visitor;

(vii) making false, malicious and groundless, written or verbal, complaints against prison officials;

(viii) quarrelling with other prisoners, creating an environment of fear amongst the inmates;

(ix) attacking, assaulting and causing injuries to others, or use of criminal force against prison officers or others;

(x) participating in a riot or mutiny or abetting another prisoner to do so;

(xi) escaping, preparing to escape or attempting to escape from prison or legal custody or failing to report to prison officials about the same by any other prisoner;

(xii) possessing any object or material removed from any larger object or from a building, which has been altered in such a manner that it can be used for damaging prison property or as a weapon of offence or as an implement to assist in escape from prison;

(xiii) possessing, hiding, transferring, smuggling, attempting to smuggle, obtaining, giving, receiving or bartering any prohibited article;

(xiv) failing to report to prison officials about any prohibited articles;

(xv) stealing, damaging, destroying, disfiguring or misappropriating any government property or another prisoner's property;

(xvi) failing to report at once any loss, breakage or injury, which the prisoner may accidentally have caused, to prison property or implements;

(xvii) tampering with or defacing identity cards, records or documents of the prison;

(xviii) breach of the conditions of parole/furlough or emergency release;

(xix) refusing to eat or threatening to go or going on a hunger strike or abetting others to do so;

(xx) wilfully or negligently destroying or spoiling food or throwing it away without authorization;

(xxii) tampering with the scale of food;

(xxiv) violating rules and regulations framed for the systematic running of the canteen or bartering canteen articles;

(xxv) manufacturing any article without the knowledge or permission of a prison officer or causing adulteration during manufacturing;

(xxvi) mixing or adding a foreign substance to the materials issued for work;

Calculation of 152. Sentences awarded in default of payment of fine shall be calculated as follows, - sentence of (a) Sentences imposed in default of payment of fines shall not run concurrently; imprisonment in

Illustration.- A prisoner is sentenced on the 9^thJune, 2017 to two years rigorous imprisonment and a fine of Rs. 50 or in default, six months further rigorous imprisonment, on the 17^thJuly of the same year he is sentenced on another charge to imprisonment for 18 months, and on the 6^thOctober, 2018, he is again sentenced on a third charge to imprisonment for two years, the sentence of six months imprisonment in default of payment of fine should begin from the 9^thDecember, 2022 (the date immediately after that on which all the substantive sentences expire, i.e. the 8^thDecember).

(c) If a prisoner sentenced to imprisonment in default of payment of fine receives another substantive sentence while undergoing such imprisonment, the second substantive sentence shall begin from the date it was imposed and sentence in default of fine shall be kept in abeyance.

A prisoner is sentenced on the 31^stJanuary to pay a fine of Rs. 300/- or in default to two months' rigorous imprisonment and on 12^thFebruary of the same year he is sentenced on another account to additional imprisonment for four months. The sentence of four months of imprisonment shall begin from 12^thFebruary.

(d) The imprisonment which is imposed in default of payment of a fine, shall terminate whenever that fine is either paid or recovered as per law.

(e) If a prisoner is sentenced to imprisonment of which the whole or any portion thereof is in default of the payment of any fine, and if the fine or a portion of it is not immediately paid, the dates of release shall be calculated and entered on the prisoner's warrant and history ticket and in the registers so as to correspond both with payment and with non- payment of fine.

(f) If a prisoner who is sentenced to a fine and in default to imprisonment, pays a portion of the fine, the date of release shall be proportionally altered. If the imprisonment in default of payment of fine is expressed in calendar months, then the reduction of imprisonment to be made in consequence of such payment, shall be calculated in calendar months and not in days. Any fraction of a month obtained by such calculation shall be reduced to days. When the fraction thus obtained is not exactly equal to any number of days or is less than a single day, the portion of a day which results shall be considered and treated as being equal to a full day.

Illustration:- A prisoner is sentenced on 1^stJanuary to a fine of Rs. 300 or in default to six months' imprisonment. No part of the fine is realized except a sum of 75 paise. He shall be released on the 29^thJune, even though the amount realized is less than the full amount due for a single day.

(g) When a prisoner is sentenced to fine and the fine is paid in installments, the period of sentence to be remitted shall not be calculated on the individual payments but the aggregate of the several previous payments.

If a prisoner is sentenced on 1^stJanuary to six months imprisonment and a fine of Rs. 300 and it is ordered that if the fine is not paid, he shall be imprisoned for a further period of six months, then if the prisoner immediately on conviction pays Rs.100 the date of release shall be first fixed at 31^stOctober (six months plus four months as equivalent of the fine unpaid), or if he afterwards pays another Rs.100, then the date will be changed to 31^stAugust and on his paying the entire amount of the fine, to 30^th June.

(h) If a prisoner, who is sentenced to a fine and in default imprisonment for a certain number of years, months and days, pays a part of the fine, the remission for the payment shall be calculated in year and months and not in days, and any fraction of a month, obtained by such calculation shall be reduced to days. When the fraction thus obtained is not exactly equal to any number of days, or is less than a single day, the portion of a day which results shall be considered and treated as being equal to a full day, in favour of the prisoner.

(2) When the rejection by the High Court, of an appeal or revision application of a prisoner is communicated to the court by which such prisoner was convicted, such court shall at once cause the intimation of such decision to be given to the Superintendent as well the prisoner concerned.

(3) In the cases referred by the Court of Sessions for the confirmation of a sentence of death by the High Court, the High Court will send a copy of its order to the court of Sessions which will then issue a warrant to the Superintendent.

(3) In all cases in which a sentence or order is modified or reversed, whether, in appeal or revision, a separate warrant shall be issued as regards each prisoner whose sentence has been so modified or reversed.

Calculations of 164. The following method shall be adopted in calculating the date of release of a prisoner who, date of release after conviction, is released on bail but is afterwards re-committed to prison to serve his sentence, or on re-arrest and

re-capture of a who escapes and is subsequently recaptured, namely: -

Provided further that the case of premature release of a convict whose conduct during the confinement in prison or temporary release in the last five years prior to the date of consideration for premature release has been categorized as 'persistently bad', shall be considered under clause (xxi) of the category (a) in case the life convict is not already covered under the same. However, if he is already covered under clause (xxi) of the category (a), his case for premature release shall not be considered before a further period upto five years beyond the completion of the required minimum sentence:

Provided further that no benefit of remission shall be granted during such period of deferment. EXPLANATION- The period mentioned hereinabove is the minimum length of sentence a convicted prisoner is required to undergo before his case for premature release can be considered. The competent authority may approve, reject or defer the case for any length of time for reasons to be recorded in writing. A case once deferred shall be considered only after the expiry of the period of such deferment. The order of deferment shall make a reference to the period for which it has been deferred. The case for premature release of a convict can be deferred for a maximum of two times, provided that any deferment on the ground of non-completion of the minimum sentence, actual or total, as provided hereinabove shall not be counted. Premature release shall neither be claimed nor allowed solely on the ground that the case has been deferred in the past.

(3) In addition to the nature of the crime, the age and gender of the convicted prisoner, his conduct during the last five years prior to the date of consideration for premature release, capacity to commit the crime again, social impact of his release, safety of the victim and the witnesses shall be relevant factors amongst others in deciding the case for premature release:

Provided that if any discrepancy is found in the age of a convict in the warrant or the copy of the judgment, proof of age like matriculation certificate, birth certificate, or school leaving certificate shall be obtained and got verified from the authority concerned. If any convict is unable to produce the proof of age, he may be examined by a Board of Doctors of an authorized medical institution. It shall be the responsibility of the Superintendent concerned to arrange for the medical examination:

Provided further that all cases of pre-mature release under these rules shall be considered subject to the provisions of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974) and any convict so released shall be liable to be re-called by the competent authority in case any irregularity, mistake or deficiency is found in any respect at a later stage.

(4) The conduct of a convict shall be categorized as under, -

(a) 'good' if he has not been punished for any prison offence or for violating any conditions of temporary release;

(b) 'satisfactory' if he has been punished with only one minor punishment for any prison offence or for violating conditions of temporary release during the last five years prior to the date of consideration for premature release;

(c) 'not Satisfactory' if he has been punished with one major punishment or more than one minor punishment for any prison offence or for violating conditions of temporary release during the last five years prior to the date of consideration for premature release;

(d) 'bad' if he has been punished with two major punishments or more than two minor punishments for any prison offence or for violating conditions of temporary release during the last five years prior to the date of consideration for premature release; or

(e) 'persistently Bad' if he has been punished with more than two major punishments or more than three minor punishments for any prison offence or for violating conditions of temporary release during the last five years prior to the date of consideration for premature release, or who has been convicted for any criminal offence committed during the period of confinement in prison or temporary release.

(5) Medical re-examination of a convict released on the ground of terminal disease shall be conducted every six months and if the convict is not found to be suffering from such disease any longer and is medically fit, he shall be re-admitted in the prison to undergo the unexpired portion of his sentence.

(6) The formula for calculating the period of sentence undergone shall be as follows: A person convicted and sentenced for life imprisonment on the 21^stJanuary, 2006 who has been in custody since the 1^stJanuary, 2004. During the above-said sentence period, he had availed parole for fourteen months and overstayed parole for ten days. Then on the 31^stDecember, 2017, his actual sentence undergone will be twelve years nine months, and twenty days. If during this period he has earned six years ten months twenty days total remission, his total sentence period will be calculated for example i.e. as under:

(7) Remissions granted under these rules, excluding those granted by the Government under statutory provisions, shall not exceed one-fourth of the total sentence:

Provided that the total remission granted by all authorities shall not exceed one-third of the total sentence.

(8) The cases for premature release shall be decided as per the recommendation of a State level committee constituted by the Government from time to time.

(9) The premature release case of a convict who has been sentenced to undergo life imprisonment in more than one case shall be considered after completion of the requisite sentences in all the cases.

Example.- A convict has been sentenced to undergo life imprisonment in case "A" on the 1^stJanuary, 2019 and case "B" on the 1^stJanuary, 2022, his case for premature release shall be considered only when he completes the requisite minimum sentence in both cases, i.e. case

"A" and case "B" as per sub-rule (2) above. NOTE.- Upon conviction, every convict sentenced to life imprisonment shall be informed regarding the relevant policy of premature release or as the case may be the relevant rule applicable to him alongwith minimum period of actual and total imprisonment that he has to undergo before his case for premature release may be considered. The Superintendent shall personally ensure that cases for premature release shall be sent after completion of the minimum prescribed period. Any case put up before completion of the requisite sentence shall be viewed seriously.

(10) Steps for processing the application for premature release shall be as under, namely: -

(a) The Superintendent shall, at an interval of every four months i.e. in January, May and September, make list of all convicts who are eligible for consideration for premature release in the next four months. The list will be made as per the eligibility criteria laid down in these rules. The Superintendent shall send a copy of the list so prepared to the District Legal Services Authority concerned. The District Legal Services Authority shall assist in preparing applications to be made by such eligible convicts. The District Legal Services Authority shall also organize legal awareness programmes in prisons through its Prison Legal Services clinics, with the aim to make the prisoners aware about the premature release policy and procedures.

(b) The Superintendent shall collect all requisite documents or reports within a maximum period of three months so that the file is complete for forwarding the same to the State Level Committee. The premature release case shall be considered within a fixed time, irrespective of whether appeal by such convicted prisoner is pending or not, if otherwise he is eligible. The Superintendent shall forward the case to the Director General within the stipulated time, even in cases where in the collection of documents is incomplete. In such cases, the Director General shall collect the remaining documents. In no case, the file shall be returned to the Superintendent citing incomplete documentation as a reason.

The Director General shall forward the proposal to the State Level Committee within a period of one month from the date of receipt of the proposal. Assistance of the District Legal Services Authority concerned may be sought for the collection of any remaining documents.

(c) The State Level Committee shall make its recommendation to the Government within three months of the receipt of the documents. The State Level Committee may meet once in every quarter to ensure timely decision on premature release applications.

(d) The order passed by the Government should be uploaded on the website. A copy may also be given to the convict through the Superintendent. The District Legal Services Authority shall advise and provide legal assistance, if required and admissible, to the convict, if there is a possibility of legal challenge to the rejection of the premature release application.

NOTE.- Cases for premature release which are otherwise barred by section 433A of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974) shall be processed by the Government under article 161 of the Constitution of India on the recommendation of the State Level Committee.

(11) The powers of premature release of convicts whose cases are covered under section 435 of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974) shall be exercised by the Government in consultation with the Central Government.

(12) Authorized Medical Institution for the purpose of this rule shall include AIIMS New Delhi, PGIMS Rohtak, PGIMER Chandigarh, BPS Medical College, KhanpurKalan (Sonipat), Government Medical College, Nalhar (Nuh), Maharaja Aggrasen Medical College, Agroha (Hisar), or any other Medical Institution designated by the Government for the purpose.

(13) From the date of notification of these rules, all premature release cases of prisoners who are convicted by the courts having jurisdiction within the State of Haryana before or on or after the date of notification of these rules.

CHAPTER 13

APPEALS, REVISIONS, PETITIONS, INTERVIEWS, AND COMMUNICATIONS

Appeal, revision 192. As per section 12 of the Legal Services Authorities Act, 1987 (Central Act 39 of 1987) a for a prisoner person in custody shall be entitled to legal services of the District, State, or National Legal Services who has no

friend or agent. Authority. If a prisoner desires to file an appeal or revision and declares that he has no relative, friend, or agent who is willing to prepare the appeal or revision for him, he shall be referred to the appropriate legal services authority as per rules or instructions of such legal services authority. The legal services authority concerned shall provide all required documents for filing an appeal or revision free of cost.

Procedure for 193. (1) If a prisoner, who desires to appeal or to file revision, declares that he has no relative or preparation and agent who is willing to make an appeal or file revision for him, the Superintendent shall apply, in the presentation of

appeal, revision. form as prescribed from time to time by the Director General, for a copy of the judgment or order relating to such prisoner against which he desires to appeal or file revision. If the copy of the judgment is not received within seven days, the Superintendent shall send a reminder for it and if there is any excessive delay, shall report the matter to the District & Sessions Judge.

(2) On receipt of the copy of judgment or order, a written acknowledgment shall be obtained from the prisoner. The prisoner shall if he knows to write, be allowed to write his appeal or revision. If the prisoner does not know to write, the Superintendent shall cause his appeal to be written for him by another prisoner or by a prison officer or by his counsel or the counsel provided by the legal services authority concerned.

(3) When a legal aid counsel is provided to the petitioner through legal services authority, the prisoner shall be informed about the particulars of such legal aid counsel provided to him. If such legal aid counsel fails to represent the prisoner in court, the prisoner will intimate the Superintendent and the Superintendent shall report the matter to the legal services authority concerned.

(4) A prisoner or officer deputed to write an appeal or revision shall do so at the appellant's dictation and shall neither make any suggestion to the prisoner as to what shall be stated nor add anything to what the prisoner himself desires to have stated in the appeal or revision. The prisoner or officer deputed to write an appeal or revision shall read out the appeal to the convict. NOTE.-1 The Superintendent is not justified in refusing to forward the appeal or revision of any prisoner on the ground of limitation.

NOTE.-2 An appeal or revision made by the Superintendent on behalf of a prisoner should, before dispatch, be read over to the appellant, in the presence of the Superintendent, who shall if the prisoner approves of the appeal or revision, countersign the document and the official seal of the prison be stamped thereon.

NOTE.- 3 If, after the receipt of the copy of the judgment or order, a relative, family member, or agent of the prisoner undertakes to make the appeal or revision on his behalf and the prisoner consents to that course, the copy of the judgment shall be delivered to such relative, family member or agent as the case may be, under proper receipt. NOTE.- 4 Convicts are entitled under section 363 (1) and (2) of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974) to a copy of the judgment free of all cost. A copy of every judgment shall also be sent to the Superintendent.

For this rule, the word prisoner shall include his legal counsel

(5) If a prisoner's appeal fails and he desires to prefer an application for revision, he is entitled to get, for filing revision application, a free copy of the impugned order.

(6) The signature of the appellant on the appeal or revision petition shall be witnessed and attested by an officer not below the rank of Assistant Superintendent before forwarding the same to the Superintendent.

(7) The Superintendent shall forward the appeal or revision without delay to the appellate or the revisional court. If any delay has occurred in preparing the appeal or revision petition after the receipt of the copy of the judgment, a note of such delay shall also be made on the petition. Prisoners convicted in the same case may appeal or apply for revision either jointly in one petition or separately. In case of joint petition, one copy of judgment shall suffice for all. NOTE.- Appeal or revision by military prisoners against sentences passed by the Court Martial shall be forwarded to the Military Command headquarters.

When the fresh warrant is returned with an endorsement of execution, the appellate court shall forward it to the court from the decision of which the appeal was preferred, to be attached to the original record.
