BE it enacted by Parliament in the Twenty-second Year of the Republic of India as follows: —

(2) Subject to the provisions of sub-section (4), a pregnancy may be practi-

(a) where the length of the pregnancy does not exceed twelve

weeks, if such medical practitioner is, or

(b) where the length of the pregnancy exceeds twelve weeks

but does not exceed twenty weeks, if not less than two registered medical practitioners are,

of opinion, formed in good faith, that—

(i) the continuance of the pregnancy would involve a risk to the life of the pregnant woman or of grave injury to her physical or mental health; or

(«) there is a substantial risk that if the child were born, it would suffer from such physical or mental abnormalities as to be seriously handicapped.

Explanation I.—Where any pregnancy is alleged by the pregnant woman to have been caused by rape, the anguish caused by such preg- nancy shall be presumed to constitute a grave Injury to the mental health

of the pregnant woman. Explanation II.—Where any pregnancy occurs as a result of failure of

any device or method used by any married woman or her husband for the purpose of limiting the number of children, the anguish caused by such unwanted pregnancy may be presumed to constitute a grave injury to the mental health of the pregnant woman.

(3) In determining whether the continuance of a pregnancy would involve such risk of injury to the health as is mentioned in sub-section (2), account may be taken of the pregnant woman's actual or reasonably foreseeable environment.

(4) (a) No pregnancy of a woman, who has not attained the age of eighteen years, or, who, having attained the age of eighteen years, Is a

lunatic, shall be terminated except with the consent in writing of her guardian.

(b) Save as otherwise provided in clause (a), no pregnancy shall be terminated except with the consent of the pregnant woman.

4. No termination of pregnancy shall be made in accordance with this Place Act at any place other than—

5. (1) The provisions of section 4, and so much of the provisions of

Sections sub-section (2) of section 3 as relate to the length of the pregnancy and the

(2) Notwithstanding anything contained in the Indian Penal Code, the

termination of a pregnancy by a person who is not a registered medical practitioner shall be an offence punishable under that Code, and that Code shall, to this extent, stand modified. \

Explanation.—For the purposes of this section, so much of the provi- sions of clause (d) of section 2 as relate to the possession, by a registered medical practitioner, of experience or training in gynaecology and obste- trics shall not apply.

6. (1) The Central Government may, by notification In the Official

(2) In particular, and without prejudice to the generality of the fore- going power, such rules may provide for all or any of the following

matters, namely :•—

(a) the experience or training, or both, which a registered medical practitioner shall have if he intends to terminate any preg- nancy under this Act; and

(b) such other matters as are required to be or may be, provided by rules made under this Act.

(3) Every rule made by the Central Government under this Act shall be laid, as soon as may be after it Is made, before each House of Parlia- ment while it is in session for a total period of thirty days which may be comprised in one session or in two successive sessions, and if, before the expiry of the session in which it is so laid or the session immediately following, both Houses agree In making any modification in the rule or

both Houses agree that the rule should not be made, the rule shall there- after have effect only in such modified form or be of no effect, aa the

case may be; so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done under that rule.

7. (I) The State Government may, by regulations,— make

tions. (a) require any such opinion as is referred to in sub-section (2) of section 3 to be certified, by a registered medical practitioner or practitioners concerned, in such form and at such time as may be

specified in such regulations, and the preservation or disposal of such certificates;

(fa) require any registered medical practitioner, who terminates a pregnancy, to give intimation of such termination ,and such other information relating to the termination as may be specified in such

regulations;

(c) prohibit the disclosure, except to such persons and for such

purposes as may be specified in such regulations, of intimations given

or information furnished in pursuance of such regulations.

(2) The intimation given and the information furnished in pursuance

of regulations made by virtue of clause (fa) of sub-section (1) shall be

given or furnished, as the case may be, to the Chief Medical Officer of the State.

(3) Any person who wilfully contravenes or wilfully fails to comply

with the requirements of any regulation made under sub-section (1)

shall be liable to be punished with fine which may extend to one thousand

(4) Either House of Parliament may, by resolution passed within thirty days from the date on which the Act has been laid before it under sub-section (3), which period may be comprised in one session or in two successive sessions, direct any modifications to be made in the Act and if the modifications are agreed to by the other House of Parliament dur- ing the session in which the Act has been so laid before it or the session succeeding, such modifications shall be given effect to by the President by enacting an amending Act under sub-section (2):

Provided that nothing in this sub-section shall affect the validity of the Act or of any action taken thereunder before it is so amended.

THE MEDICAL TERMINATION OF PREGNANCY (AMENDMENT)

ACT, 2021

NO. 8 OF 2021

[25th March, 2021.] An Act further to amend the Medical Termination of Pregnancy Act, 1971. BE it enacted by Parliament in the Seventy-second Year of the Republic of India as follows:—

1. (1) This Act may be called the Medical Termination of Pregnancy (Amendment)

2. In the Medical Termination of Pregnancy Act, 1971 (hereinafter referred to as the

(i) after clause (a), the following clause shall be inserted, namely:— '(aa) "Medical Board" means the Medical Board constituted under sub-section (2C) of section 3 of the Act;';

(ii) after clause (d), the following clause shall be inserted, namely:— '(e) "termination of pregnancy" means a procedure to terminate a pregnancy by using medical or surgical methods.'. Amendment

3. In section 3 of the principal Act, for sub-section (2), the following sub-sections of section 3.

shall be substituted, namely:—

"(2) Subject to the provisions of sub-section (4), a pregnancy may be terminated by a registered medical practitioner,—

(a) where the length of the pregnancy does not exceed twenty weeks, if such medical practitioner is, or

(b) where the length of the pregnancy exceeds twenty weeks but does not exceed twenty-four weeks in case of such category of woman as may be prescribed by rules made under this Act, if not less than two registered medical practitioners are,

of the opinion, formed in good faith, that—

(i) the continuance of the pregnancy would involve a risk to the life of the pregnant woman or of grave injury to her physical or mental health; or

(ii) there is a substantial risk that if the child were born, it would suffer from any serious physical or mental abnormality.

Explanation 1.—For the purposes of clause (a), where any pregnancy occurs as a result of failure of any device or method used by any woman or her partner for the purpose of limiting the number of children or preventing pregnancy, the anguish caused by such pregnancy may be presumed to constitute a grave injury to the mental health of the pregnant woman. Explanation 2.—For the purposes of clauses (a) and (b), where any pregnancy is alleged by the pregnant woman to have been caused by rape, the anguish caused by the pregnancy shall be presumed to constitute a grave injury to the mental health of the pregnant woman.

(2A) The norms for the registered medical practitioner whose opinion is required for termination of pregnancy at different gestational age shall be such as may be prescribed by rules made under this Act.

(2B) The provisions of sub-section (2) relating to the length of the pregnancy shall not apply to the termination of pregnancy by the medical practitioner where such termination is necessitated by the diagnosis of any of the substantial foetal abnormalities diagnosed by a Medical Board. (2C) Every State Government or Union territory, as the case may be, shall, by notification in the Official Gazette, constitute a Board to be called a Medical Board for the purposes of this Act to exercise such powers and functions as may be prescribed by rules made under this Act. (2D) The Medical Board shall consist of the following, namely:—

(a) a Gynaecologist;

(b) a Paediatrician;

(c) a Radiologist or Sonologist; and

(d) such other number of members as may be notified in the Official Gazette by the State Government or Union territory, as the case may be.".

4. After section 5 of the principal Act, the following section shall be inserted, Insertion of namely:— new

5. In section 6 of the principal Act, in sub-section (2), after clause (a), the following Amendment clauses shall be inserted, namely:—

1. (1) इन जनयमों का संजिप्त नाम गभ भ का जचदकत्सीय समापन (संिोधन) जनयम, 2021 ह ै।

(2) य ेरािपत्र म ें उनके प्रकािन की तारीख से प्रवृत्त होंग े।

2. गभभ का जचदकत्सीय समापन जनयम, 2003 (जिन्द्ह ें इसमें इसके पश्चात् उि जनयम कहा गया ह)ै, के जनयम 2 के उपजनयम (ङ) के पश्चात,् जनम्नजलजखत उपजनयम अंतःस्ट्र्ाजपत दकया िाएगा, अर्ातभ ् :-

'(च) "जचदकत्सा बोडभ" से अजधजनयम की धारा 3 की उपधारा (2ग) के अधीन गरित जचदकत्सा बोडभ अजभप्रेत ह ै।'।

3. उि जनयमों के जनयम 3 के पश्चात्, जनम्नजलजखत जनयम अतंःस्ट्र्ाजपत दकए िाएंगे, अर्ाभत ्:-

"3क. जचदकत्सा बोडभ की िजियां और कृत्य - धारा 3 के प्रयोिनों के जलए, - (क) जचदकत्सा बोडभ की िजियां जनम्नजलजखत होंगी, अर्ाभत् :-

(i) उि धारा की उपधारा (2ख) के अधीन, केवल सम्यक् जवचार करन े के पश्चात ्और यह सुजनजश्चत करन े के पश्चात् दक गभ भ की उस अवस्ट्र्ा में स्त्री के जलए प्रदिया सुरजित होगी तर्ा क्या भू्रणीय जवकृजत का इसके िीवन के सार् असंगत होने का सारवान् िोजखम ह ैया यदि जििु उत्पन्न होता ह ैतो वह ऐसी िारीररक या मानजसक असामान्द्यताओं से पीज़ित हो सकता ह ै जिससे वह गंभीर रूप से अिम हो, चौबीस सप्ताह की गभाभवजध के आग ेगभ भ का समापन अनुज्ञात करना या अस्ट्वीकार करना;

(ii) बोडभ में अन्द्य जविेषज्ञों से सहयोग लनेा तर्ा गभभ के समापन का जवजनश्चय करने के जलए, यदि अपेजित हो, अजतररि अन्द्वेषणों के जलए कहना;

(ख) जचदकत्सा बोडभ के कृत्य जनम्नजलजखत होंगे, अर्ाभत् :-

(i) स्त्री और उसकी ररपोर्टों का परीिण करना, िो धारा 3 की उपधारा (2ख) के अधीन गभभ के जचदकत्सीय समापन के जलए पहुचें;

(ii) धारा 3 की उपधारा (2ख) के अधीन गभ भ के जचदकत्सीय समापन के जलए आवेिन प्राजप्त के तीन दिनों के भीतर गभ भ के समापन या समापन के आवेिन को अस्ट्वीकृत करन ेके संबंध म ें प्ररुप घ म ें जचदकत्सा बोडभ की राय प्रिान करना;

(iii) यह सुजनजश्चत करना दक समापन प्रदिया की िब जचदकत्सा बोडभ द्वारा सलाह िी िाए, तो वह धारा 3 की उपधारा (2ख) के अधीन गभभ के जचदकत्सीय समापन के जलए आवेिन की तारीख से पांच दिनों के भीतर समुजचत परामिभ के सार् सभी सुरिा पूवाभवधाजनयों के सार् की िाए ।

3ख. चौबीस सप्ताह तक की गभाभवस्ट्र्ा के समापन के जलए पात्र जस्त्रयां - अजधजनयम की धारा 3 की उपधारा (2) के खंड (ख) के अधीन, चौबीस सप्ताह की अवजध हतेु गभाभवस्ट्र्ा के समापन के जलए जनम्नजलजखत प्रवगों की जस्त्रयों को पात्र समझा िाएगा, अर्ाभत ्:-

(क) यौन हमले या बलात्संग या कौरु्टजम्बक व्यजभचार के उत्तरिीवी;

(ख) अल्पवय;

(ग) गभाभवस्ट्र्ा के िौरान वैवाजहक प्राजस्ट्र्जत म ें पररवतभन (वैधव्य या जववाह-जवच्छेि); (घ) िारीररक अिमताओं वाली जस्त्रयां (दिव्यांगिन अजधकार अजधजनयम, 2016 (2016 का 49) के अधीन अजभकजर्त मानिडंों के अनुसार प्रमुख जनःििता);

(ङ) मानजसक रूप से रुग्ण स्त्री जिसके अन्द्तगभत मानजसक मन्द्िता भी ह;ै (च) भू्रणीय जवकृजत का इसके िीवन के सार् असंगत होन ेका सारवान् िोजखम ह ैया यदि जिि ुउत्पन्न होता ह ैतो वह ऐसी िारीररक या मानजसक असामान्द्यताओं से पीज़ित हो सकता ह ैजिससे वह गंभीर रूप से अिम हो; और

(छ) मानवीय जस्ट्र्जतयों या आपिा या आकजस्ट्मकता की पररजस्ट्र्जतयों में गभाभवस्ट्र्ा वाली स्त्री, िैसा दक सरकार द्वारा घोजषत दकया िाए ।"।

4. उि जनयमों के जनयम 4 में, - (क) खंड (ग) के उपखंड (ii) में, "बीस सप्ताह", िब्िों के स्ट्र्ान पर, "चौबीस सप्ताह", िब्ि रखे िाएंगे; (ख) खंड (ग) के पश्चात,् जनम्नजलजखत खंड अंतःस्ट्र्ाजपत दकया िाएगा, अर्ाभत ्:-

"(गक) रजिस्ट्रीकृत जचदकत्सा व्यवसायी के पास गभभ समापन की जचदकत्सा पद्धजतयों द्वारा नौ सप्ताह तक की गभाभवजध के गभभ समापन को करने के जलए जनम्नजलजखत अनुभव और प्रजििण होगा, अर्ातभ ् :-

(i) प्रसूजत जवज्ञान और स्त्री रोग जवज्ञान व्यवसाय का तीन मास से अन्द्यनू अवजध का दकसी जचदकत्सालय का अनुभव; या

(ii) उसने सरकार द्वारा स्ट्र्ाजपत या अनुरजित अस्ट्पताल में अर्वा इसी प्रयोिन के जलए अनमुोदित प्रजििण संस्ट्र्ान में गभ भ के जचदकत्सीय समापन के िस मामलों को गभभ समापन की जचदकत्सा पद्धजतयों द्वारा दकसी रजिस्ट्रीकृत जचदकत्सा व्यवसायी के पयभवेिण के अधीन स्ट्वतंत्र रूप से दकया हो ।"।

5. उि जनयमों के जनयम 4 के पश्चात्, जनम्नजलजखत जनयम अतंःस्ट्र्ाजपत दकया िाएगा, अर्ाभत ्:-

"4क. (1) अजधजनयम की धारा 3 की उपधारा (2क) के प्रयोिनों के जलए, रजिस्ट्रीकृत जचदकत्सा व्यवसायी की राय, िो गभाभवस्ट्र्ा की जवजभन्न अवजधयों के जलए अपेजित ह,ै जनम्नजलजखत होगी, अर्ाभत ्:-

(क) नौ सप्ताह तक की गभाभवस्ट्र्ा अवजध, गभ भ समापन की जचदकत्सा पद्धजतयों द्वारा : जनयम 4 के खंड (क), (ख), (ग), (गक) और (घ) के अधीन पात्र रजिस्ट्रीकृत जचदकत्सा व्यवसायी;

(ख) बारह सप्ताह तक की गभाभवस्ट्र्ा अवजध, गभभ समापन की िल्य जचदकत्सा पद्धजत द्वारा : जनयम 4 के खंड (क), (ख), (ग) और (घ) के अधीन पात्र रजिस्ट्रीकृत जचदकत्सा व्यवसायी;

(ग) बारह सप्ताह से अजधक बीस सप्ताह तक की गभाभवस्ट्र्ा अवजध : जनयम 4 के खंड (क), (ख) और (घ) के अधीन पात्र रजिस्ट्रीकृत जचदकत्सा व्यवसायी;

(2) अजधजनयम की धारा 3 की उपधारा (2क) के प्रयोिनों के जलए, जनयम 4 के खंड (क), (ख) और (घ) के अधीन पात्र िो रजिस्ट्रीकृत जचदकत्सा व्यवसाजययों की राय, िो बीस सप्ताह से अजधक चौबीस सप्ताह तक की गभाभवस्ट्र्ा अवजध के गभभ के समापन हते ुअपेजित ह,ै प्ररुप ङ म ें होगी ।

(3) धारा 3 की उपधारा (2ख) के प्रयोिनों के जलए, चौबीस सप्ताह से अजधक की गभाभवस्ट्र्ा अवजध के गभभ समापन हते ु राय : संबंजधत राज्य सरकार या संघ राज्यिेत्र प्रिासन द्वारा अनुमोदित प्रसुजवधाओं पर सम्यक् रूप से गरित जचदकत्सा बोडभ द्वारा िी िाएगी तर्ा जनयम 4 के खंड (क), (ख) और (घ) के अधीन पात्र िो रजिस्ट्रीकृत जचदकत्सा व्यवसायी ऐसे जचदकत्सा बोडभ के जवजनश्चय के आधार पर गभभ का समापन करेंगे ।"।

6. उि जनयमों के जनयम 5 के उपजनयम (1) के खंड (ii) म,ें - (अ) "20 सप्ताह", अंकों और िब्ि के स्ट्र्ान पर, "चौबीस सप्ताह", िब्ि रखे िाएंग;े (आ) "पररवहन की सुजवधाएं; तर्ा", िब्िों के स्ट्र्ान पर, "पररवहन की सुजवधाएं", िब्ि रखे िाएंग;े (इ) "भारत सरकार द्वारा समय-समय पर", िब्िों के स्ट्र्ान पर, "केन्द्रीय सरकार द्वारा समय-समय पर; तर्ा", िब्ि रखे िाएंग;े

(ई) उपखंड (ग) के पश्चात्, जनम्नजलजखत अंतःस्ट्र्ाजपत दकया िाएगा, अर्ाभत ्:-

"चौबीस सप्ताह से आग ेकी गभाभवस्ट्र्ा के समापन की ििा म ें :-

(क) आपरेिन रे्टबल और उिर संबंधी या स्त्री रोग संबंधी िल्य जचदकत्सा करने के जलए उपस्ट्कर; (ख) जनश्चेतना उपस्ट्कर, पुनरुज्जीवन उपस्ट्कर और जवसंिमण उपस्ट्कर; (ग) औषजधयों, आकजस्ट्मक उपयोग के जलए िनकीय तरलों और रि की उपलब्धता, िैसा केन्द्रीय सरकार द्वारा समय-समय पर अजधसूजचत दकया िाए;

(घ) अल्रासाउंड मागभििभन के अधीन प्रदिया के जलए सुजवधाएं ।"।

(उ) स्ट्पष्टीकरण म,ें "सात सप्ताह", िब्िों के स्ट्र्ान पर, "नौ सप्ताह", िब्ि रखे िाएंगे ।

NOTIFICATION

New Delhi, the 12th October, 2021

G.S.R 730(E). — In exercise of the powers conferred by section 6 of the Medical Termination of Pregnancy Act, 1971 (34 of 1971), the Central Government hereby makes the following rules to amend the Medical Termination of Pregnancy Rules, 2003, namely:-

1. (1) These rules may be called the Medical Termination of Pregnancy (Amendment) Rules, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Medical Termination of Pregnancy Rules, 2003 (herein after referred to as the said rules), in rule 2, after sub- rule (e), the following sub-rule shall be inserted, namely:-

'(f) "Medical Board" means the Medical Board constituted under sub-section (2C) of section 3 of the Act.'.

3. After rule 3 of the said rules, the following rules shall be inserted, namely:-

" 3A. Powers and functions of Medical Board.—For the purposes of section 3,—

(a) the powers of the Medical Board shall be the following, namely:-

(i) to allow or deny termination of pregnancy beyond twenty-four weeks of gestation period under sub-section (2B) of the said section only after due consideration and ensuring that the procedure would be safe for the woman at that gestation age and whether the foetal malformation has substantial risk of it being incompatible with life or if the child is born it may suffer from such physical or mental abnormalities to be seriously handicapped;

(ii) co-opt other specialists in the Board and ask for any additional investigations if required, for deciding on the termination of pregnancy;

(b) the functions of the Medical Board shall be the following, namely :-

(i) to examine the woman and her reports, who may approach for medical termination of pregnancy under sub- section (2B) of section 3;

(ii) provide the opinion of Medical Board in Form D with regard to the termination of pregnancy or rejection of request for termination within three days of receiving the request for medical termination of pregnancy under sub-section (2B) of section 3;

(iii) to ensure that the termination procedure, when advised by the Medical Board, is carried out with all safety precautions along with appropriate counselling within five days of the receipt of the request for medical termination of pregnancy under sub-section (2B) of section 3.

3B. Women eligible for termination of pregnancy up to twenty-four weeks.—

The following categories of women shall be considered eligible for termination of pregnancy under clause (b) of sub- section (2) Section 3 of the Act, for a period of up to twenty-four weeks, namely:-

(a) survivors of sexual assault or rape or incest;

(b) minors;

(c) change of marital status during the ongoing pregnancy (widowhood and divorce);

(d) women with physical disabilities [major disability as per criteria laid down under the Rights of Persons with Disabilities Act, 2016 (49 of 2016)];

(e) mentally ill women including mental retardation;

(f) the foetal malformation that has substantial risk of being incompatible with life or if the child is born it may suffer from such physical or mental abnormalities to be seriously handicapped; and

(g) women with pregnancy in humanitarian settings or disaster or emergency situations as may be declared by the Government." .

4. In rule 4 of the said rules,—

(a) in clause (c), in sub-clause (ii), for the words "twenty- weeks", the words "twenty - four weeks" shall be substituted;

(b) after clause (c), the following clause shall be inserted, namely:-

"(ca) A Registered Medical Practitioner shall have the following experience and training for conducting termination of pregnancy upto nine weeks of gestation period by medical methods of abortion, namely:-

(i) experience at any hospital for a period of not less than three months in the practice of obstetrics and gynaecology; or

(ii) has independently performed ten cases of pregnancy termination by medical methods of abortion under the supervision of a Registered Medical Practitioner in a hospital established or maintained, or a training institute approved for this purpose, by the Government.".

5. After rule 4 of the said rules, the following rule shall be inserted, namely:-

"4A. (1) For the purposes of sub-section (2A) of section 3 of the Act, the opinion of Registered Medical Practitioner which is required for termination of pregnancy at different gestation ages shall be the following, namely:-

(a) till nine weeks of gestation period, by Medical Methods of Abortion: Registered Medical Practitioner eligible under clauses (a), (b), (c), (ca) and (d) of rule 4;

(b) till twelve weeks of gestation period, by surgical method: Registered Medical Practitioner eligible under clauses (a), (b), (c) and (d) of rule 4;

(c) beyond twelve weeks till twenty weeks of gestation period: Registered Medical Practitioner eligible under clauses (a), (b) and (d) of rule 4;

(2) For the purposes of sub-section (2A) of section 3 of the Act, the opinion of two Registered Medical Practitioners eligible under clauses (a), (b) and (d) of rule 4, which is required for termination of pregnancy beyond twenty weeks till twenty-four weeks of gestation period, shall be in Form E.

(3) For the purposes of sub-secion (2B) of section 3, the opinion for medical termination of pregnancy beyond twenty-four weeks gestation period: Shall be given by a Medical Board duly constituted by the respective State Government or Union territory Administration at approved facilities and two Registered Medical Practitioners eligible under clauses (a), (b) and (d) of rule 4, shall perform the termination of pregnancy based on the decision of such Medical Board.".

6. In rule 5 of the said rules, in sub-rule (1), in clause (ii),—

(A) for the figures and word "20 weeks", the words "twenty-four weeks" shall be substituted;

(B) for the words "for transportation; and", the words "for transportation;" shall be substituted;

(C) for the words "Government for India from time to time.", the words "the Central Government from time to time; and" shall be substituted;

(D) after sub-clause (c), the following shall be inserted, namely:-

"in case of termination beyond twenty-four weeks of pregnancy:-

(a) an operation table and instruments for performing abdominal or gynaecological surgery;

(b) anaesthetic equipment, resuscitation equipment and sterilisation equipment;

(c) availability of drugs, parental fluids and blood for emergency use, as may be notified by the Central Government from time to time; and

(d) facilities for procedure under ultrasound guidance.".

(E) in the Explanation, for the words "seven weeks", the words "nine weeks" shall be substituted.

7. For Form A of the said rules, the following Form shall be substituted, namely:-

"FORM A (See sub-rule (2) of rule 5) FORM OF APPLICATION FOR THE APPROVAL OF A PLACE UNDER CLAUSE (b) OF SECTION 4 OF

THE ACT

Category of approved place:

(A) Pregnancy can be terminated upto twelve weeks

(B) Pregnancy can be terminated upto twenty-four weeks

No.. 12/F.-Misc-08-93/2023-1791(2)—In exercise of the power conferred by Section 3(2C) of the Medical Termination of Pregnancy (Amendment) Act 2021 issued by the Ministry of Law and Justice , Government of India in the Gazette of India on the 25th March 2021, every State Government or Union Territory , as the case may be , shall , by notification in the Official Gazette, constitute a Board to be called a Medical Board for the purposes of this Act to exercise such powers and functions as may be prescribed by rules made under this Act. Accordingly, in supersession of all previous notification and orders so far it relates to the subject in this regard,the Governor is hereby pleased to nominate the following persons as member of the Medical Board for the purpose of Medical Termination of Pregnancy Act.

It is to be mentioned that if any vacancy occurs in the office of a member, it shall be

filled by making fresh appointment from existing faculty / Medical Officers by the Facility

In-Charge (Civil Surgeons /Suprintendent) of the respective facilities where the MTP

Medical boards are formed.

It is to be mentioned that in districts where Medical Board is already formed in Sadar

Hospital & Medical College, and the position of either Gynaecologist, Paediatrician or

Radiologist falls vacant due transfer/retirement /any other reason, along with there is a

considerable delay in fresh appointment to replace the vacant position or the fresh

appointment is not made at all for a long time. In such a situation, the Sadar Hospital or

Medical College is tagged with nearest Medical College with existing Medical Board, as

mentioned below for the purpose of Medical Termination of Pregnancy Act, as per below

The Powers and Functions of the Medical Board as enshrined in Rule 3A of the Medical

Termination of Pregnancy (Amendment) Rules, 2021 are as follows:

Powers - [Under Rule 3A (a)]

(i) to allow or deny termination of pregnancy beyond twenty-four weeks of gestation period under sub-section(2B) of the said section only after due consideration and ensuring that the procedure would be safe for the woman at the gestation age and whether the foetal malformation has substantial risk of it bieng incompatible with life or if the child is born it may suffer from such physical or mental abnormalities to be seriously handicapped.

(ii) co-opt other specialists in the Board and ask for any additional investigations if required, for deciding on the termination of pregnancy

Functions - [Under Rule 3A (b)]

(i) to examine the woman and her reports, who may approach for medical termination of pregnancy under sub-section (2B) of section 3;

(ii) provide the opinion of Medica l Board in Form D with regard to the termination of pregnancy or rejection of request for termination within three days of receiving the request for medical termination of pregnancy under sub-section (2B) of Section 3

(iii) to ensure that the termination procedure , when advised by the Medical Board, is carried out with all safety precautions along with appropriate counselling within five days of the receipt of the request for medical for medical termination of pregnancy under sub-section (2B) of section 3

Pursuant to the provisions of the Medical Termination of Pregnancy (Amendment) Act. 2021 ,the State Government have been pleased to notify the updated formats, i.e. Form-I, Form-II and Form-III (Copies enclosed) for the documentation of MTP as per the mandate of Law.

This Notification will come into force from the date of its publication in the Bihar Gazette.

The propasal has the approval of the competent authority.
