(Act No. 6 o f 2009) (Received the assent of the Governor on the 3rd day o f February, 2009)
An Act To provide for establishm ent and incorporation o f the Jodhpur National University, Jaipur in the State o f Rajasthan and matters connected therewith and incidental thereto.
W hereas, with a view to keep pace with the rapid developm ent in all spheres o f knowledge in the world and the country, it is essential to create world level modern research and study facilities in the State to provide state o f the art educational facilities to the youth at their door steps so that they can make out o f them human resources compatible to liberalized economic and social order o f the world;
And whereas, rapid advancem ent in knowledge and changing requirements o f human resources makes it essential that a resourceful and quick and responsive system o f educational research and development be created which can work with entrepreneurial zeal under an essential regulatory setup and such a system can be created by allowing the private institutions engaged in higher education having

sufficient resources and experience to establish universities and by incorporating such universities with such regulatory provisions as ensure efficient working of such institutions;
And whereas, the Kushal Education Trust, Jaipur, a Trust registered under the Rajasthan Public Trusts Act, 1959 having its registered office at 65, Sardar Patel M arg, C-Scheme, Jaipur, is engaged in the field o f education for last several years and is running a num ber o f educational institutions which are imparting education in the disciplines like management, engineering, pharmacy, physiotherapy, dental, education etc.;
And whereas, the said Kushal Education Trust, Jaipur has set up educational infrastructures, both physical and academic , as specified in Schedule 1, at village Nam adi, Tehsil Luni, D istrict Jodhpur in the State o f Rajasthan and has agreed to invest the said infrastructure in a University for research and studies in the disciplines specified in Schedule II and has also deposited an am ount o f rupees one crore to be utilized in establishm ent o f an endowment fund in accordance with the provisions o f this Act;
And whereas, the sufficiency o f the above infrastructure has been got enquired in to by a comm ittee, appointed in this behalf by the State Government consisting o f the Vice-chancellor, University o f Bikaner, Bikaner, Director, Technical Education Rajasthan, Jodhpur, Principal, Engineering College, Bikaner, Dr. kalpana Mathur, Professor & Head, Departm ent o f M anagem ent Studies, Jai Narain Vyas University, Jodhpur and Dr. K.S. Banga, Professor & Head, Nair Hospital and Dental College, Mumbai;
And whereas, if the aforesaid infrastructure is utilized in incorporation as a University and the said Kushal Education Trust, Jaipur is allowed to run the University , it would contribute in the academic developm ent o f the people o f the State;
Now, therefore, be it enacted by the Rajasthan State Legislature in the Fifty - ninth Year o f the Republic o f India, as follows:-
1. Short title, extent and commencement.- (1) This Act may be called the Jodhpur National University, Jodhpur Act,2009.
(2) It extends to the whole o f the State o f Rajasthan.
(3) It shall be deem ed to have come into force on and from 9th August ,
2008.

2. Definitions.- In this Act, unless the context otherwise requires.-
(a )" AICTE" means All India Council o f Technical Education established under All India Council o f Technical Education Act, 1987 ( Central Act No. 52 o f 1987);
(b )"CSIR" means the Council o f Scientific and Industrial Research, New Delhi-a funding agency o f the Central Government; (c )"DEC" m eans the Distance Education Council established under section 28 o f Indira Gandhi National Open University Act, 1985 (Central Act No. 50 o f 1985);
(d) "Distance education" means education imparted by com bination o f any two or more m eans o f communication, viz. broadcasting, telecasting, correspondence courses, seminars, contact program m es and any other such methodology;
(e )"DST" means the Departm ent o f Science and Technology o f the Central Government;
(f) "employee" means a person appointed by the University to work in the university and includes teachers, officers and other employees o f the University;
(g )"fee" means collection made by the University from the students by whatever name it may be called , which is not refundable;
(h) "Government" m eans the State Government o f Rajasthan;
(i) "higher education" means study o f a curriculum or course for the pursuit o f knowledge beyond 10+2 level;
(j) "hostel" means a place o f residence for the students o f the University , or its colleges , institutions or centers, maintained or recognized to be as such by the University;
(k )'TCAR" means the Indian Council o f Agriculture Research ,a society under the Societies Registration Act, 1860 (Central Act No. 21 o f 1860);
(1) "M CI" means M edical Council o f India constituted under section 3 o f the Indian M edical Council Act, 1956);
(m) "NAAC" m eans the National Assessment and Accreditation Council, Bangalore, an autonomous institution o f the UGC;
(n) " NCTE" m eans the National Council o f teacher Education constituted under section 3 o f the National Council o f Teacher Education Act, 1993 (Central Act No. 73 o f 1993);
(o) "off campus centre" means a centre o f the University established by it outside the main campus operated and m aintained as its constituent unit, having the U niversity's Complement o f facilities , faculty and staff;
(p) "PCI" means Pharm acy Council o f India Constituted under section 3 o f the Pharmacy Act, 1948 (Central Act No. 8 o f 1948);
(q) " prescribed" means prescribed by Statutes m ade under this Act;

) " regulating body" means a body established or constituted by or under any law for the time being in force laying down norms and conditions for ensuring academ ic standards o f higher education , such as UGC, AICTE, NCTE, MCI, PQI, NAAC, ICAR, DEC, CSIR etc. and includes the State Government;
(s) " Rules" m eans the rules made under this Act;
(t) " Schedule" means the Schedule to this Act;
(u) " Sponsoring Body" means the Kushal Education Trust, a Trust registered under Rajasthan Public Trust Act, 1959 ( Rajasthan Act No. 42 o f 1959) having Registration No. 20, Jaipur, 2002 dated 28.08.2002;
(v) "Statutes" , "Ordinances" and " Regulations" means respectively , the Statutes, Ordinances and Regulations o f the University made under this Act;
(w) "Student o f the University" means a person enrolled in the University for taking a course o f study for a degree, diplom a or other academic distinction duly instituted by the University, including a research degree;
(x) " Study centre" means a centre established and m aintained or recognized by the university for the purpose o f advising, counseling or for rendering any other assistance required by the students in the context o f distance education;
(y) " teacher" means a Professor , Reader, Lecturer or any other person required to impart education or to guide research or to render guidance in any other form to the students for pursuing a course o f study o f the University;
(z) " UGC" means the University Grant Commission, established under section 4 o f the University Grants Commission Act, 1956 (Central Act No. 3 o f 1956); and
(aa) "University" means the Jodhpur National University, Jodhpur.
3. In co rp o ra tio n .- (1) The first Chancellor and the first V ice-chancellor o f the University and the first members o f the Board o f M anagem ent and the Academic Council and all persons who may hereafter becom e such officers or members, so long as they continue to hold office or m embership , are hereby constituted a body corporate by the name o f Jodhpur National University, Jodhpur.
(2) The movable and immovable property specified in the Schedule I shall be vested the University and the Sponsoring Body shall, immediately after commencement o f this Act, take steps for such vesting.
(3) The University shall have perpetual succession and a common seal and shall sue and be sued by the said name.

(4) The U niversity shall situate and have its headquarters at village N arn ad i, Tehsil Luni, District Jodhpur.
4. T he objects o f the U niversity .- The object o f the university shall be to undertake research and studies in the disciplines specified in Schedule II and such other disciplines as the University may with the prior approval o f the State Government , determine from time to time and to achieve excellence and impart and disseminate knowledge in the said disciplines.
5. Pow er and functions of the U niversity .- The U niversity shall have the following powers and functions, namely
(a) To provide for instructions in the disciplines specified in Schedule II and to make provisions for research and for the advancement and dissemination o f knowledge;
(b) To grant , subject to such conditions as the university may determine , diploma or certificates , and confer degree or other academ ic distinctions on the basis o f examinations , evaluation or any other method o f testing on persons , and to withdraw any such diplomas, certificates, degrees or other academic distinctions for good and sufficient cause;
(c) To organize and to undertake extra-mural studies and extinction service;
(d) To confer honorary degrees or other distinctions in the manner prescribed;
(e) To provide instruction, including correspondence and such other courses, as it may determine;
(f) To institute professorships , Readerships, Lectureships and other teaching or academic posts required by the University and to make appointment thereto;
(g) To create administrative , ministerial and other posts and to make appointments thereto;
(h) To appoint persons working in any other university or organization having specific knowledge permanently or for a specified period;
(i) To co-operate, collaborate or associate w ith any other university or authority or institutions in such m anner and for such purpose as the university may determine;
(j) To establish study centers and m aintain schools, institutions and such centers, specialized laboratories or other units for research and instructions for the furtherance o f its object;
(k)To institute and award fellowships, scholarships, studentships, medals and prizes;
(1) To establish and maintain hostels for students o f the University;

(m) To make provisions for research and consultancy , and for that purpose to enter into such arrangements with other institutions or bodies as the University may deem necessary;
(n)To determine standard for admission into the University, which may include exam ination, evaluation or any other m ethod o f testing; (o)To demand and service payment o f fees and other charges; (p)To supervise the residences o f the students o f the University and to make arrangement for the promotion o f their health and general welfare; (q)To make special arrangements in respect o f w om en students as the University may consider desirable ;
(r) To regulate and enforce discipline among the em ployees and students o f the University and take such disciplinary m easures in this regard as may be deemed necessary by the University;
(s) To make arrangem ent for promoting the health and general welfare o f the employees o f the University ;
(t) To receive donations and acquire, hold, m anage and dispose o f any movable or immovable property;
(u)To borrow m oney with the approval o f the sponsoring Body for the purposes o f the University;
(v)To m ortgage or hypothecate the property o f the University with the approval o f the sponsoring Body;
(w) To establish examination centers; (x)To ensure that the standard o f degrees , diplom as, certificates and other academic distinctions are not lower than those laid down by AICTE, NCTE, UGC, M CI, PCI, and other similar bodies established by or under any law for the time being in force for the regulation o f education;
(y) To set up o ff campus centre within or w ithout the State, subject to the provisions o f any other law for the time being in force ; and
(z) To do all such other acts and things as may be necessary , incidental or conducive to the attainment o f all or any o f the objects o f the University.
6. University to be self- financed.- The University shall be se lf - financed and shall not be entitled to receive any grant or other financial assistance from the State Government.
7. No power of affiliation.- The university shall have no power to affiliate or otherwise admit to its privileges any other institution.
8. Endowm ent Fund.- (1) There shall be established an Endowm ent Fund, as soon as may be after coming into force o f this Act w ith an amount o f rupees one crore which has been deposited by the Sponsoring Body with the State Government.

(2) The Endow m ent Fund shall be used as security deposit to ensure that the University com plies with the provisions o f this Act and functions as per provisions o f this Act, Statutes and Ordinances. The State Government shall have the powers to forfeit in the prescribed m anner, a part or whole o f the Endow m ent fund in case the University or the Sponsoring Body contravenes any o f the provisions o f this Act or Statutes, Ordinances, Regulations or rules made thereunder.
(3) Income from the Endowm ent fund may be utilized for development o f infrastructure o f the University but shall not be utilized to meet out the recurring expenditure o f the university .
(4) The am ount o f the Endowm ent Fund shall be invested and kept invested until the dissolution o f the University in long term securities issued or guaranteed by the State Government or deposited and kept deposited until the dissolution o f the University in the interest bearing Personal Deposit Account o f the Sponsoring Body in the Governm ent Treasury.
(5) In case o f investm ent in long term security, the certificates o f the securities shall be kept in the safe custody o f the State Government and in case o f deposit in the interest bearing personal Deposit account in Government Treasury , the deposit shall be made w ith the condition that the am ount shall not be withdrawn without the perm ission o f the State Government.
9. General Fund The University shall establish a fund , which shall be called the General Fund to which following shall be credited , namely:-
(a) Fees and other charges received by the University;
(b) Any contributions made by the sponsoring Body;
(c) Any income received from consultancy and other work undertaken by the University in pursuance o f its objectives;
(d) T ru s t, bequests, donations, endowments and any other grants; and
(e) All other sums received by the University.
10. Application o f General Fund.- The General Fund shall be utilized for meeting all expenses , recurring or non- recurring in connection with the affairs o f the University:
Provided that no expenditure shall be incurred by the University in excess o f the limits for total recurring expenditure and total non- recurring for the

year, as may be fixed by the Board o f M anagem ent, w ithout the prior approval o f the Board o f M anagement.
11. O fficers of the U niversity .- The following shall be the officers o f the University o f the University, namely:-
(i) The Chancellor;
(ii) The Vice-chancellor;
(iii) The Pro-Vice-chancellor;
(iv) The Proctor;
(v) The Deans o f Faculties;
(vi) The Registrar;
(vii) The ch ief Finance and Account Officer; and
(viii) Such other officers as may be declared by the Statutes to be the officers o f the University.
12. T he C hancello r.- (1) The Chancellor shall be appointed by the Sponsoring Body with the consent o f the State Government for a period o f five years from the date on which he enters upon his office and shall not be eligible for re- appointment:
Provided that a chancellor shall notwithstanding the expiration o f his term continue to hold office until his successor enters upon the office.
(2) Any vacancy in the office o f Chancellor shall be filled within six months from the date o f such vacancy.
(3) The Chancellor shall , by virtue o f his office , be the head o f the University .
(4) The Chancellor shall, if p re se n t, preside at the m eetings o f the Board o f M anagement and at the convocation o f the University for conferring degrees, diplomas or other academic distinctions.
(6) The Chancellor shall have the following powers, nam ely:-
(a) To call for any information or record in connection with the affairs o f the University;
(b) To appoint the Vice-chancellor;
(c) To remove the Vice-chancellor in accordance with the provisions o f sub-section (8) o f section 13; and
(d) Such other powers as may be prescribed by the Statutes.

13. The Vice-chancellor.- (1) The Vice-chancellor shall be appointed by the Chancellor from a panel o f three persons recom m ended by the Board o f M anagement and shall , Subject to the Provisions contained in sub-section(8) , hold office for a term o f three year:
Provided th a t , after expiry o f the term o f three years, a person shall be eligible for re-appointm ent for another term o f three years:
Provided further that a Vice-chancellor shall notw ithstanding the expiration of his term continue to hold office until his successor enters upon the office.
(2) Any vacancy in the office o f Vice-chancellor shall be filled within six month from the date o f such vacancy.
(3) The Vice-chancellor shall be the principal executive and academic officer o f the University and shall exercise general superintendence and control over the affairs o f the University and shall execute the decisions o f the authorities o f the University.
(4) I f in the opinion o f the Vice-chancellor it is necessary to take immediate action on any m atter for which power are conferred on any other authority by or under this Act, he m ay take such action as he deems necessary and shall at the earliest opportunity thereafter report his action to such officer or authority as would have in the ordinary course dealt with the matter:
Provided that i f in the opinion o f the concerned officer or outhority such action should not have been taken by the V ice-chancellor then such case shall be referred to the Chancellor whose decision thereon shall be final; Provided further that where any such action taken by the Vice-chancellor affects any person in the service o f the University such person shall be entitled to prefer, within three m onths from the date on which such action is communicated to him , an appeal to the Board o f M anagem ent and the Board o f M anagement may confirm or modify or reverse the action taken by the Vice-chancellor.
(7) If, in the opinion o f the Vice-chancellor , any decision o f any authority o f the University is outside the powers conferred by this Act or Statutes, Ordinances , Regulations or rules made University, he shall direct the concerned authority to revise its decision within fifteen days from the date o f its decision and in case the authority refuses or fails to revise such decision, then such matter shall be referred to the Chancellor and his decision thereon shall be final.

(8) The V ice-chancellor shall exercise such other powers and perform such other duties as m ay be prescribed by the Statutes or the Ordinances.
(9) If the Chancellor is satisfied , on an enquiry m ade or caused to be made on a representation made to him or otherwise, that the continuance o f Vice- chancellor in his office is prejudicial to the interest o f the University or the situation so warrants , he may, by an order in writing and stating the reasons therein for doing so, ask the Vice-chancellor to relinquish his office from such date as may be specified in the order;
Provided that before taking an action under this sub-section, the Vice- chancellor shall be given an opportunity o f being heard.
14. The Pro-Vice-chancellor.- (1) The Pro-V ice-chancellor shall be appointed by the Chancellor in consultation with the Vice- chancellor shall be appointed by the chancellor .
(2) The Pro-V ice-chancellor shall hold office for a period o f three years and shall be eligible for re-appointm ent for a second term.
(3) The condition o f service o f the Pro-Vice-chancellor shall be such as may be prescribed by the Statutes.
(4) If the Chancellor is satisfied, on an enquiry made or caused to be made on a representation m ade to him or otherwise, that the continuance o f Pro-Vice- chancellor in his office is prejudicial to the interest o f the University or the situation so warrants, he may, by an order in writing and stating the reasons therein for doing so, ask the Pro-Vice-chancellor to relinquish his office from such date as may be specified in the order;
Provided that before taking an action under this sub-section, the Pro-Vice- chancellor shall be given an opportunity o f being heard.
(5) The Pro-Vice-chancellor shall assist the Vice-chancellor in such matters as are assigned to him by the Vice-chancellor from time and shall exercise such power and perform such functions as may be delegated to him by the Vice- chancellor.
15. The Provost.- (1) The Provost shall be appointed by the Vice-chancellor for such period and in such m anner as may be prescribed by the Statutes.
(2) The Provost shall ensure discipline in the University and shall keep the various unions o f the teachers and employees advised o f the various policies and practices in the University.
(3) The Provost shall exercise such other powers and perform such other duties as may be prescribed by the Statutes.

16. The Proctor.- (1) The Proctor shall be appointed by the Vice-chancellor for such period and in such m anner as may be prescribed by the Statutes.
(2) The Proctor shall be responsible for the m aintenance discipline among the students and keep the various students union advised o f the various polices and practices in the University.
(3) The Proctor shall exercise such other powers and perform such other duties as may be prescribed by the Statutes.
17. The Dean of Faculty.- (1) There shall be a Dean o f each Faculty who shall be appointed by the V ice-chancellor for a period o f three years in such manner as may be prescribed by the Statutes.
(2) The Dean shall convene meeting o f the Faculty , as and when required , in consultation with the Vice-chancellor and shall preside over the same. He shall formulate the policies and development programme o f the faculty and present the same to the appropriate authorities for their consideration.
18. The Registrar.- (1) The Registrar shall be appointed by the Chancellor, in such m anner as may be prescribed by the Statutes.
(2) All contracts shall be signed and all documents and record shall be authenticated by the Registrar on behalf o f the University.
(3) The Registrar Shall be the M em ber Secretary o f the Board o f Management and Academ ic Council but he shall not have a right to vote.
(4) The Registrar shall exercise such other powers and perform such other duties as may be prescribed by the Statutes.
19. The Chief Finance and Accounts Officer.- (1) The C hief finance and Account Officer shall be appointed by the V ice-Chancellor in such m anner as may be prescribed by the Statutes.
(2) The C hief Finance and Account Officer shall exercise such powers and perform such duties as may be prescribed by the Statutes.
20. Other officers.- (1) The University may appoint such other officers asm ay be necessary for its functioning.
(2) The m anner o f appointment and powers and functions o f such officers shall be such as may be prescribed by the Statutes.

21. A u th o rities o f the U niversity .- The following shall be the authorities o f the University, namely:-
(i) The Board o f M anagem ent;
(ii) The Academ ic Council;
(iii) The Faculties; and
(iv) Such other authorities as may be declared by the Statutes to be the authorities o f the University.
22. T he B oard of M anagem ent.- (1) The Board o f M anagem ent o f the University shall consist o f the following , namely:-
(a) The Chancellor ;
(b) The Vice-chancellor; (c)F ive persons nominated by the sponsoring Body out o f whom two shall be em inent educationists;
(d) One expert o f management o f information technology from outside the University , nom inated by the Chancellor;
(e) One expert o f finance , nominated by the Chancellor;
(f) Com m issioner , College Education or his nom inee not below the rank o f deputy Secretary; and
(g) Two teachers, nominated by the Vice-chancellor.
(2) The Board o f M anagement shall be the principal executive body o f the University. All the M ovable and immovable property o f the University shall vest in the Board o f M anagem ent. It shall have the following powers, nam ely:-
(a) To provide general superintendence and directions and to control the functioning o f the University by using all such powers as we provided by this Act or the Statutes, Ordinances , Regulations or rules made thereunder;
(b) To review the decisions o f other authorities o f the University in case they are not in conformity with the provisions o f this Act or the Statutes, Ordinances, Regulations or rules made thereunder;
(c) To approve the budget and annual report o f the University;
(d) To lay down the policies to be followed by the University;
(e) To recom m end to the Sponsoring Body about the Voluntary liquidation o f the University if a situation arises when smooth functioning o f the University does not remain possible,in spite o f all efforts; and
(f) Such other powers as may be prescribed by the Statutes.
(3) The Board o f M anagement shall meet at least three times in a calendar year.
(4) The quorum for meetings o f the Board o f M anagem ent shall be five.

23. The Academ ic Council (1) The Academic Council shall consist o f the Vice-chancellor and such other members as may be prescribed by the Statutes.
(2) The V ice-chancellor shall be the Chairperson o f the Academic Council.
(3) The Academ ic Council shall be the principal academic body o f the University and shall, subject to the provisions o f this Act and the rules, Regulations, Statutes or Ordinances, made thereunder, co-ordinate and exercise general supervision over the academic policies o f the University.
(4) The quorum for meetings o f the Academic Council shall be such as may be prescribed by the Statutes.
24. Other authorities.- The composition, constitution, powers and functions of other authorities o f the university shall be such as may be prescribed by the Statutes.
25. Disqualification for m embership of an authority.- A person shall be disqualified for being a m em ber o f any o f the authorities o f the University , if he-
(a) Is o f unsound m ind and stands so declared by a com petent court;
(b) Is an undercharged in so lven t;
(c) Has been convicted o f any offence involving moral turpitude; (d)Is conducting or engaging him self in private coaching classes; or (e)H as been punished for indulging in or prom oting unfair practice in the conduct o f any examination, in any form, anywhere.
26. Vacancies not to invalidate the proceedings of any authority o f the University.- No act or proceeding o f any authority o f the University shall be invalid merely by reason o f any vacancy or defect in the constitution thereof.
27. Filling up o f emergent vacancies.- Any vacancies occurred in the membership o f authority o f the University due to death, resignation or removal o f member or due to change o f capacity in which he was appointed or nominated , shall be filled up as early as possible by the person or the body who had appointed or nominated such a member;
Provided that the person appointed or nom inated as a m ember o f an authority o f the university on an emergent vacancy, shall rem ain m em ber o f such authority for only the remaining period o f the member, in whose place he is appointed or nominated.
28. Comm ittee.- The authorities or officers o f the University may constitute such committees with such terms o f reference as may be necessary for specific

tasks to be perform ed by such committees. The constitution o f such committees and their duties shall be such as may be prescribed by the Statutes. 29.The Statutes.- (1) Subject to the provisions o f this Act, the Statutes o f the University may provide for all or any o f the following matters, namely:-
(a)T he constitution, power and functions o f the authorities o f the University as may be constituted from time to time;
(b)The terms and conditions o f appointm ent o f the V ice-Chancellor and his powers and functions ;
(c)T he m anner and terms and conditions o f appointm ent o f the Registrar and C hief Finance and Accounts Officer and their powers and functions; (d)The m anner in which and the period for which the Provost and the Proctor shall be appointed and their powers and functions; (e)T he m anner in which the Dean o f Faculty shall be appointm ent and his powers and functions;
(f) The m anner and terms and conditions o f appointm ent o f other officers and officer and teachers and their powers and functions ; (g)The term s and conditions o f services o f employees o f the University and their functions;
(h)The procedure for arbitration in case o f disputes between officers, teachers, employees and students;
(i) The conferm ent o f honorary degrees;
(j) The provisions regarding exem ption o f students from payment o f tuition fee and for awarding to them scholarships and fellowships;
(k) Provisions regarding the policy o f admissions including regulation o f reservation o f seats;
(1) Provisions regarding fees to be charged from students;
(m) Provisions regarding num ber o f seats in different course;
(n) Creation o f new authorities o f the University;
(o) Accounting policy and financial procedure;
(p) Creation o f new departments and abolition or restructuring o f existing departments;
(q) Institution o f medals and prizes;
(r) Creation o f posts and procedure for abolitions o f posts;
(s) Revision o f fess;
(t) Alteration o f the number o f seats in different syllabi; and (u)A ll other matters which under the provisions o f this Act are required to be, or may be , prescribed by the Statutes.
(2) The Statutes o f the University shall be m ade by the Board o f M anagement and shall be submitted to the State Government for its approval.

(3) The State Government shall consider the Statutes, submitted by the University and shall give its approval thereon within two months from the date o f its receipt with such modifications, if any, as it may deem necessary.
(4) The University shall communicate its agreem ent to the Statutes as approved by the State Government, and if it desires not to give effect to any or all o f the m odifications made by the State Governm ent under sub reason(3), it may give reasons therefor and after considering such reason, the State Governm ent may or may not accept the suggestions made by the University.
(5) The State Government shall publish the Statutes, as finally approved by it, in the Official Gazette, and thereafter, the Statutes shall come into force from the date o f such publication.
30.T he O rd inances.- (1) Subject to the Provisions o f this Act or Statutes made thereunder, the Ordinances may provide for all or any o f the following matters, namely :-
(a) The adm ission o f students to the University and their enrolm ent as such; (b)The courses o f study to be laid down for the degrees, diplomas and certificates o f the University;
(c)T he award o f the degrees, diplomas, certificates and other academic distinctions, the minimum qualifications for the same and the measures to be taken relating to the granting and obtaining o f the same; (d)The conditions for award o f fellowships, scholarships, stipends, medals and prizes;
(e) The conduct o f examinations, including the terms o f office and m anner o f appointm ent and the duties o f exam ining bodies, examiners and moderators;
(f) Fees to be charged for the courses, examinations, degrees and diplomas o f the University;
(g)The conditions o f residence o f the students o f the University;
(h) Provision regarding disciplinary action against the students;
(i) The creation, composition and functions o f any other body which is considered necessary for improving the academic life o f the University;
(j) The m anner o f co-operation and collaboration w ith other Universities and Institutions o f higher education; and
(k)A ll other matters which by this Act or Statutes made thereunder are required to be provided by the Ordinances.
(2) The Ordinances o f the University shall be m ade by the Academic Council which after being approved by the Board o f M anagem en t, shall be submitted to the State Government for its approval.
(3) The State Government shall consider the Ordinances submitted under submitted under sub-section(2) w ithin two months from the date o f their

receipt and shall either approve them or give suggestions for modifications therein.
(4) The Academ ic Council shall either modify the Ordinances incorporating the suggestion o f the State Government or give reasons for not incorporating any o f the suggestions made by the State Government and shall return the Ordinances alongwith such reasons, if any , to the State Governm ent and on receipt o f the same , the State Government shall consider the comments o f the Academ ic Council and shall approve the Ordinances o f the University with or w ithout such modifications.
31. R egulations.- The authorities o f the University m ay , subject to the prior approval o f the Board o f M anagement, make regulations, consistent with this Act and the rules , Statutes and the Ordinances made thereunder , for the conduct o f their own business and that o f the committees appointed by them. 32.A dm ission.- (1) Adm ission in the University shall be m ade strictly on the basis o f merit.
(2) M erit for admission in the University may be determ ined either on the basis o f m arks or grade obtained in the qualifying exam ination and achievements in co-curricular and extra-curricular activities or on the basis o f mark or grade obtained in the entrance test conducted at the State level either by an association o f the universities conducting sim ilar courses or by any agency o f the State; Provided that admission in professional and technical courses shall be made only through entrance test.
(3) Reservation in admission to the University for scheduled castes, scheduled tribes and other backward classes, women and handicapped person shall be provided as per the policy for the State Government.
33. Fee structure.- (1) The University may, from time to time , prepare its fees structure and sent it for approval o f the committee constituted for the purpose.
(2) The committee shall consider the fees structure prepared by the University and if it is satisfied that the proposed fees is -
(a) sufficient for:-
(i) generating resources for m eeting the recurring expenditure o f the University; and
(ii) the saving required for the further development o f the University; and

(b) not unreasonably excessive, it may approve the fees structure.
(3) The fees structure approved by the committee under sub-section(2) shall remain in force for three years and the University shall be entitled do charge fees in accordance with such fees structure.
(4) The University shall not charge any fees , by whatever name called , other than that for which it is entitled under sub- section(3).
34. Exam inations.- At the beginning o f each academic session and in any case not later than 30th o f August o f every calendar year, the University shall prepare and publish a schedule o f examinations for each and every course conducted by it and shall strictly adhere to the schedule.
Explanation.- "Schedule o f Exam ination" means a table giving details about the time , day and date o f the commencement o f each paper which is part o f a scheme o f exam inations and shall also include the details about the practical examinations;
Provided that if, for any reason whatsoever , the University has been unable to follow this schedule , it shall , as soon as practicable , submit a report to the State Government incorporating the seasons for m aking a departure from the published schedule. The Government may, thereon, issue such directions as it may deem fit for the compliance o f the schedule.
35. Declaration of results.- (1) The University shall strive to declare the results o f the every exam ination conducted by it within thirty days from the last date o f the examination for that particular course and shall in any case declare the results latest within forty-five days from such date;
Provided that if , for any reason whatsoever, the University is unable to finally declare the results o f any exam ination within the aforesaid period o f forty- five days, it shall submit a report incorporating the reasons for such delay to the State Government . The State Government may, thereon , issue such directions as it may deem fit.
(2) No examination or the result o f an examination shall be held invalid only for the reasons that the University has not followed the time schedule as stipulated in section 34 or , as the case may be, in section 35.
36. Convocation.- The convocation o f the University shall be held in every academic year in the m anner as may be prescribed by the Statutes for conferring degrees, diplomas or for any other purpose.

37. Accreditation of the University.- The University shall obtain accreditation from the NAAC , as per the norms o f the NAAC and inform the State Government and such other regulating bodies which are connected with the courses taken up by the University about the grade provided by the NAAC to the University. The University shall get renewed such accreditation from time to time as per the norms o f the NAAC.
38.University to follow rules, regulations , norms, etc. o f the regulating bodies.- Notwithstanding anything contained in this Act, the University shall be bound to comply w ith all the rules , regulations, norms, etc. o f the regulating bodies and provide all such facilities and assistance to such bodies as are required by them to discharge their duties and carry out their functions.
39. Annual report.- (1) The annual report o f the University shall be prepared by the Board o f M anagem ent which shall include among other matters, the steps taken by the University towards the fulfillment o f its objects and copy o f the same shall be submitted to the Sponsoring Body.
(2) Copies o f the annual report prepared under sub-section (1) shall also be presented to the State Government.
40. Annual Accounts and audit.- (1) The annual accounts including balance sheet o f the University shall be prepared under the directions o f the Board o f M anagement and the annual accounts shall be audited at least once in every year by the auditors appointed by the University for this purpose.
(2) A copy o f the annual account together w ith the audit report shall be submitted to the Board o f M anagem ent.
(3) A copy o f the annual accounts and audit report al'ongwith the abservations o f the Board o f M anagem ent shall be subm itted to the Sponsoring Body.
(4) Copies o f annual accounts and balance sheet prepared under sub-section
(1) shall also be presented to the State Government. The advice o f the State Government, if any, arising out o f the accounts and audit report o f the University shall be placed before the Board o f M anagem ent. The Board o f M anagem ent shall issue such directions, as it may deem fit and compliance shall be reported to the State Government.

41. Power of the State Governm ent to inspect the University.- (1) For the purpose o f ascertaining the standards o f teaching, exam ination and research or any other m atter relating to the University, the State Governm ent may cause an inspection , to be m ade in such m anner as may be prescribed , by such person or persons as it may deem fit.
(2) The State Government shall communicate to the U niversity its recommendations in regard to the result o f such inspection for corrective action . The University shall adopt such corrective measures and m ake efforts so as ensure the compliance o f the recom mendations.
(3) I f the University has failed to comply w ith the recom m endations made under sub-section (2) within a reasonable time, the State Governm ent may give such directions as it may deem fit for such compliance.
42. Powers of the State Governm ent to call for inform ation.- (1) The State Government may call for information from the University relating to its working , functions, achievements, standard o f teaching , exam ination and research or any other m atters as it may consider necessary to judge the efficiency o f the University in such from and within such time as may be prescribed by rules .
(2) The University shall be bound to furnish the inform ation as required by the State Governm ent under sub-section (1) w ithin the prescribed time.
43. Dissolution o f the University by the Sponsoring B od y.-(l) The Sponsoring Body may dissolve the University by giving a notice to the effect in the prescribed m anner to the State Government and the em ployees and the students o f University at least one year in advance :
Provided that dissolution o f the University shall have effect only after the approval o f the State Government and the last batches o f Students o f the regular courses have completed their courses and they have been awarded degree, diplomas or awards, as the case may be.
(2) On the dissolution o f the University all the assets and liabilities o f the University shall vest in the Sponsoring Body.
44. Special Powers of the State Governm ent in certain circum stances.- (1)
if it appear to the State Government that the University has contravened any o f the provisions o f this Act o f the rules , Statutes or Ordinances m ade thereunder or has violated any o f the directions issued by it under this Act or has ceased to carryout any undertakings given by it to the State Government or a situation o f financial mismanagement o f m al-adm inistration has arisen in the University , it shall issue

notice requiring the University to show cause within forty-five days as to why an order o f its liquidation should not be made.
(2) If the State Government, on receipt o f reply o f the University on the notice issued under sub-section(l) , is satisfied that there is a prima facie case o f contravening any o f the provisions o f this Act or the rules , Statutes or Ordinances made thereunder or o f violating directions issued by it under this Act or o f ceasing to carryout the undertakings given by it or o f financial m ism anagem ent or mal-adm inistration, it shall m ake an order o f such enquiry as it may consider necessary.
(3) The State Government shall, for the purposes o f any enquiry under sub- section (2), appoint an inquiry officer or officers to into any o f the allegation and to make report thereon.
(4) The inquiry officer or officers appointed under sub- section(3) shall have the same powers as are vested in a civil court under the Code o f Civil Procedure , 1908 (Central Act No. 5 o f 1908) while trying a suit in respect o f the following matters, namely:-
(a) Summoning and enforcing the attendance o f any person and exam ining him on oath;
(b) Requiring the discovery and production o f any such docum ent or any other material as may be predicable in evidence ; and
(c) requisitioning any public record from any court or office.
(5) The inquiry officer or officers inquiring under this Act shall be deemed to be a civil court for the purposes o f section 195 and Chapter 26 o f the Code o f Criminal Procedure , 1973 ( Central Act No. 2 o f 1974).
(6) On receipt o f the enquiry report from the officer or officers appointed under sub-section (3) , if the State Government is satisfied that the University has contravened any o f the provisions o f this Act or the rules, Statutes or Ordinances made thereunder or has violated any o f the directions issued by it under this Act or has ceased to carryout the undertakings given by it or a situation o f financial m ism anagem ent and m al-adm inistration has arisen in the University w hich threatens the academic standard o f the University, it shall make orders for liquidation o f the University and appoint an administrator and thereupon the authorities and officers o f the University shall be subject to the order and direction o f the administrator.
(7) The administrator appointed under sub-section (6) shall have all the powers and be subject to all the duties o f the Board o f M anagement under

this Act and shall administer the affairs o f the University until the last batch o f the students o f the regular courses have completed their courses and they have been awarded degrees, diplomas or awards as the case may be.
(8) After having been awarded the degrees, diplomas or awards, as the case may be, to the last batches o f the students o f the regular courses, the administrator shall make a report to the effect to the State Government.
(9) On receipt o f the report under sub-section(8), the State Government shall, by a notification in the official Gazette, issue an order dissolving the University and from the date o f publication o f such notification the University shall stand dissolved and all the assets and liabilities o f the University shall vest in the Sponsoring Body from such date.
45. Power to make rules.- (1) The State Government may, by notification in the Official Gazette, m ake rules to carry out the purposes o f this Act.
(2) All rules made under this Act shall be laid, as soon as may be , after they are so made, before the House o f the State Legislature, while it is in session, for a period o f not less than fourteen days which may be com prised in one session or in two successive sessions and if before the expiry o f the session in which they are so laid or o f the session immediately following ,the House o f the State Legislature makes any m odification in any such rules or resolves that any such rules should not be made, such rules shall thereafter have effect only in such m odified from or be o f no effect , as the case may be, so however, that any such m odification or annulment shall be w ithout prejudice to the validity o f anything previously done thereunder.
46. Power to remove difficulties.- (1) If any difficulty arises in giving effect to the provisions o f this Act, the State Government may, by order published in the Official Gazette, make provisions, not inconsistent with the provisions o f this Act, as appear to it to be necessary or expedient for rem oving the difficulty; Provided that so order under this section shall be m ade after the expiry o f a period o f two years from the date o f comm encem ent o f this Act.
(2) Every order made under this section shall, as soon as may be after it is made , shall be laid before the House o f the State Legislature.
47. The Act to have overriding effect.- The provisions o f this Act and the rules, Statutes , Ordinances made thereunder shall have effect notwithstanding anything to the contrary contained in any other law , for the time being in force,

relating to the m atters in respect o f which the State Legislature has exclusive power to make laws.
48. Repeal and saving.- (1) The Jodhpur National University, Jodhpur Ordinances, 2008 ( Ordinances No. 4 o f 2008) is hereby repealed.
(2) Notwithstanding such repeal, all things done, actions taken or orders made under the said Ordinances shall be deemed to have been done, taken or made under this Act.
