TECHNOLOGY IN THE STATE OF ORISSA

CHAPTER J

( I ) "Academic Coutlcil" nieans tll c ~cadenl ic Council of the University;
(2) "agriculture" inciudcs the bzsic and applied sciences dealing wit ti soil and wnter rnanagemcnt, production of crop, fish or livestock, veterinary science, home scincc, forestry anti such other ancillary suhjects ns are necesyary for the proper
stildy and understanding of agiicultllral produc!ion
and its development;
(3) "Board" means the Board of Management of the University constit~lted under section 16;
(4) "Extensiou" includ es all educational prpsrammes undertaken for the purpose of ascer-
taming the problems of research in agriculture and allied subjects, d isserninating the results of research and providing training for the purpose of such dissemination;

(5) On receipt of a cornmunicatjon frl,!n the Cha~lccllor, the Board shall consider thc same and inform the Chancellor as soon as may be, the details
of t I~c i~ction it proposes to lakc and tlle action, if any, taken in pursuance of such communication.
(6) If rile Board docs not, within a reasallable time, take action ro the satisfaction of the Cl~ancello;., he may, after considering any explanation furnished or representatim made by the Board, issue such directions as he may think fit and thc Board shall be bound t o comply with such directions.
(7) The Chancellor may, whenever he tb inks it necessary, call for fhe proceedings of the Board or a report on any matter concerning the Uoiversity from
the Board who shall be bound to furnish the same.
(8) No honorary degree shall be conferred an any 2erson without the approval of the Chancellor.

life in conformity with the board objectives of the

(9) The Chancellor shall have such other powers as may be conferred on him by this Act orthe Statutes.

(5) He shall exercise such other powers and

(4 ) The Chancellor may at any time remove
the Vice-Chancellor from ofice, if in his opinion-or
on receipt of'. a resolution of the Board adopted by
twothirds of ~ t s members, it appears tnat his continu- ance in ofice is detrinlental t o the interests of the
University:
Provided that no such removal shall be made without giving the Vice-Chancellor a reasons ble
opportunity of being Izeard.
(5) The Vice-Chancellor may relinquish his
office by su'bmit ting resignation to the Chancellor
subject to the condition that he shall give no.tice of
three lllonrlls of his iateiltion so to do.
(6) A person holding the office of Vie-Chan- cellor shal! be eligible.for reappoirltme~zt :
Provided that no person sl~ali be eligible: to
hold such office for more than two terms consecut i - vely.
(7)TheVice-Chancellor shall b e a whole-time salaried oficer of the Unive~,sity and his emoluments and other service conditions sha!! be such as may be prescribed and shall not during his tern1 of office be
varied to his disadvantage.

(8) The Vice-Chancel lor shall be responsible
to the Board for co-ordination and integration
of teaching, research and dxtension education
programmes i u the Universi~ y.
(9) The Vice- Chancellor shall discharge such
other duties and pcri'orrn such other functions as
may be assigned to him by the Board. The
Kegimlrar. 11. ( 1 ) The Rt~ i s t r a r sha11 be a whole-time
officer of the Univers~ty and shalI be appointed by the Board.
(2) The Regisirar shall subject to the provisions
of this Act and the Statutes be respansiblc to the
Vice-chancellor for thecustody of the records and
the common seal of the University and d ~ a l l be the
ex oficio Secretary of the Academic Council.
(3) The Rcgistrar shalI be responsible to the
Vice-ChanceIlor for the conduct of the examina- tions as prescribed and shsll make all other arrange- ments necessary thcrefor and be responsible in like manner for thc due execution of all processes connected therewith.
(4) The Registrar shall perform such other
duties as may be prescribed or required from time to time by the Board or the Vice-Chancellor.

12. (1) The Comptroller shall be a whole-time officcr of tbe University and shall be appointed by
the Board.
(2) The Comptroller shall manage the property
and investinents of the University and advise in regard to its financial policy and shall be responsibIe
to the Vice-Chancellor for the preparation of the budget and statc rnent of accounts for presentation by the Vice-Chancellor.
(3) The ComptroIler sliall be responsible to the
Vice-Chancellor for ensuring that no expenditure
not authorised i n the budget is incurred by the University otherwisethan by way of investments and shall disallow any expenditure which may contravene the tcrnls OF any Statute or for which provision is r e q ~ e d to be made by the Statute.;

(vii) to perft;rm such other duties as may be
assigned t o him by thc Yoard or the Vice- CbanceIIor.
14. ( 1 ) The Directar of Physical Plants shaIl be n e Director OF Physical appointed by the Vice-Chancellor rvitl? the approval
of the Board.
(2) The Director of Physical Plants shall have the following dutles, namely:-
(i) to makc arrangeinenis for the maintenance and construction of balidings and other structures of the University ;
(ii) to make arranz-ements for purchase and
maintenance of machinery and other equipmcnts necessary for the purposes of the University ; and
(iii) such other duties as may be ~rescdbed
or a s may bc assisfled by tile ~ o z r d .
(3) The Director of Physical Plnnts shall, in the
discharge of his duties, be responsible to the Vice- Chancel Ior.

AUTHORITIES OF THE UNIVERSITY

18. (1) The Academic Council shall consist of r h c ~ c z . the following members, namely :- dcmic CounCiI.
(i) the Vice-Chancellor ;
(i i) the Deans of Faculfies ;
(iii) the Dean of Student Welfare ;
( i v ) the Heads of Departments or varicus
Faculties; ( v ) the Dean of Research ; and

(2) The Vice-chancellor shall be the Chairman
of the Academic Council and in bis absence any
other member authorised by him shall act as the Chairman of the said Council.
19. ( 1 ) The Academic Council shall, subject to Powers and

(3) The Dean of Research shall be in charge of the Agriculture Experimeij t stations with powers to
control and co-ordinate all resiarch activities of the experiment stations. The Dean $ha11 forinulate the research programmes in all the institutions of the
University in consultation with the respective Deans and shaIl be responsible to the Vice-Chancellor.
Bxteneion 26. ( 1 ) A Department of Extension Education 8dUc"i0nm shall be established and maintained by the University

CHAPTER VI
UNIVERSITY FUNDS, ETC.

(2 ) The Foundatio~l Fund shall consist of-
(4 the sum of not less than ten lakhs of rupees which shall be given to i t by the
Government in the course of the five years after the corning into force of this Act;
(b) any contribution to this fund which may
be made by the Government, any local
authority or othcr public body or others; and
(c) any contributions to this fund which inay be inac'e by the Unikfersiiy -
(3) The Foundaiion Fund shall be invested and be
kept invested, i n securities, issued or guaranfeed by the Central Government or by any other State Govern- ment hnd such illvestments shall not be varied
without the consent of fhc Chancellor.
(4) The corpus of the Foundation Fund shall be
kept intack but the interest thereon may be utilised for the purposes of the University.
(5) The expenditure from thc revcnues of the State referred to in clause (a) of sub-section (2) shall be expenditure charged on the revenues of' the State.

Statutes. Manner of making
34. ( 1 ) The first Statutes wit11 regard to matters
statutes. specified in clauses (a) t o (lc) of section 33 shall be made by the Government after being previously
published in the Gazette for the consideration of objections, if any, as may be rcceived from the public within a month of such publication. Subse-
quent amendments and alterations in respect of ttleseitemsshal1,subject to the approval of the Government, be made by the Board.
(2) The first Statutes wit11 regard to matters
specified in clauses ( 1 ) lo (IU) of section 33 shall, subject to the approval of the Board and the ChancelIor, be made by the Vice-Chancellor. The Academic CounciI may from time to time, propose
draft of subsequent amendments and alterations of
such Statutes, which would be considered by the
Board at its next meeting. The Board may approve
any such draft and m e n d or alter the Statutes accordingly or. reject it or return it to the Academic
Council for reconsideration, either in whole or in
part, together with any a~endments which it may suggest.
CHAPTER VIlI

ments of such college shall be deemed to have been
transferred to the University as its college:
Provided that until arrangements are made by the
University, the Government shall be, and continue to
be, responsible for keeping the buiIdings of the
college, includ i ng the fixu res, fittings a ad connections, , in a proper state of repair, as may from time to time
be required by the University.
(2) Nothing in this section shall be deemed to
autborise the Univcrsi ty to sell, lease, exchange or
otherwise dispose of any land or building of any college transferred to the University under sub-
section (1 ) .
(3) Where any c01Iege has been transferred to the university by an order under sub-section ( I ) , notwithstanding anything contained in this Act, the
University shall . employ all members of the teaching staff and other servants of the Government who, immediately before the date of the publication of the 'said order, were serving in or were attached to that college, on such foreign service conditions as may be deter mined by the Government:
Provided that such employees may, within a
period of one year from the date they are called upon
by the Univcrsiry so to do, exercise their option to
revert to t.heir services under the Government failing

(Sec. 38) which they shall be deemeh to have been absorbed in
the services of tlie University ~villl effect from the
date of,theexpiry of the period aforesaid and shall thereafter be governed by the terms and conditions
governing the said services.
(4) The provisions contained in sub-sectioa (2) and sub-section (3) shall, rirrltnris ~r~irkwdis, apply in

Provided: that-
(a) the IJuivcl-si ty established, authorities constitilted and officers, other than the Vice-Pres iden t, appointed undcr the said
Act shall be deemed to have been established, conslilu ted and appointed under this Act;
(b) the person appointed t o be the president under the said Act, shall be deemed to be the Vice-Chancellor a~pointed under this Act and shall subject t o thc other provisions of this Act, continue to hold ofice so long as he would have other- wise continued as such President;
(c) the aforesaid authorities shall continue to hold office u11ti1 they are reconstituted in accordance with the provisions of this Act; and
(6) statutes and regulations made, notifica- tions and notices issued, contracts entered into and all actions taken and things done under the said Act, shall be dcen~cd to havz bee11 made, issued, enterzd into, taken and done under
this Act and shall continue in force untiI new provisions are made under
the appropriate provisions of this Act.
