AN ACT TO VALIDATE THE ACTION 0 F . m MUPIKCPAL
COUNCIL OF TALCHER MUNICIPALITY
AND ITS CHUMAN
BE .it enacted by - the - Legislaturt: ofh the State , of Orissa in the Twenty-seventh. .Year of the Republic of India, as follows :-
1. ( I ) This Act may be called the Talcher Munici- ~hor t t i t~e pality ( Validation ) Act, 1976. and oommen- Cement.
(2) It shall be deemed to have come into force on the 3rd day of June, 1976.
2. Notwithstanding anything contained in the Validation or actions taken 0dss;tAct Orissa Municipal Act, 1950 or in any judgment, by the Of lgso. d m e or order of any Court, all actions taken and orders passed by- g-$zrd
its Chairman.
(a) the Municipal Council of the Tdcher Municipality in the district of Dhenkanal and by its Chairman during the period from the 12th March 1969 to the 5th February 1972 ( both the days inclusive );
and
(6) the Subdivisional Officer, Talcher during
the period from the 6th February 1972 to
the 20th February 1975 ( both the days inclusive ) on being appointed to ex~cjse
the powers and perform the functions of the said Municipal Council and its Chairman,

45 of 19761 in the belief or purporled belief that the Talcher
Municipality was validly constituted, shall, for all intents and purposes, be deemed to have been validly taken and passed, and no such action or
order shall be questioned in any court of law or athenvise open to chaIIenge merely on the ground
that the said Municipality was not validly constituted.

3. ( I ) The Talcher Municipality ( Validation ) o,i= Ordie
Ordinance, 1976 is hereby repealed. nilncc NO. 1 of 1976.
(2) Notwithstanding such repeal anything done
or any action taken undcr the said Ordinance shall b0 deemed to have been done or taken under this Act.
