Notification
The 26th November, 2019 No. Leg. 40/2019.— The following Act of the Legislature of the State of Haryana received the assent of the Governor of Haryana on the 17th November, 2019 and is hereby published for general information:-
HARYANA ACT NO. 38 OF 2019
THE HARYANA SERVICE OF ENGINEERS, GROUP A, PUBLIC WORKS
(BUILDINGS AND ROADS) DEPARTMENT (AMENDMENT) ACT, 2019
AN
ACT
further to amend the Haryana Service of Engineers, Group A, Public Works (Buildings and Roads) Department Act, 2010.
Be it enacted by the Legislature of the State of Haryana in the Seventieth Year of the Republic of India as follows:-
1. This Act may be called the Haryana Service of Engineers, Group A, Public Works (Buildings and Roads) Department (Amendment) Act, 2019.
Short title.
2. For sub-sections (2) and (3) of section 1 of the Haryana Service of Engineers, Group A, Public Works (Buildings and Roads) Department Act, 2010 (hereinafter called the principal Act), the following sub-sections shall be substituted, namely:-
"(2) It shall be deemed to have come into force on the 4th November, 2010.
(3) It shall apply to the persons who are members of the Service and have been appointed on or after the 4th November, 2010.".

section 1 of
Haryana Act 30
of 2010.
3. For the second and third proviso to sub-section (1) of section 9 of the principal Act, the following provisos shall be substituted, namely:-
"Provided further that there shall be a common cadre for promotion to the post of Engineer-in-Chief:
Provided further that there shall be separate post of Chief Engineer (Electrical) for Electrical cadre and Chief Engineer (Mechanical) for Mechanical cadre and same shall be filled up by the Committee constituted under section 8 on the basis of seniority-cum-merit. The seniority shall be determined by the length of Service on the post of Superintending Engineer in their respective cadre.".
Amendment of
section 9 of
Haryana Act 30
of 2010.
4. For clause (f) of proviso to section 25 of the principal Act, the following clause shall be substituted, namely:-
"(f) the officers promoted, recruited or appointed, in the Buildings and Roads Branch now called Public Works (Buildings and Roads) Department, prior to the notification of this Act shall continue to be governed and regulated by the Haryana Service of Engineer, Class I, Public Works Department (Buildings and Roads Branch), (Public Health Branch) and (Irrigation Branch) respectively Act, 1995 (20 of 1995),".
Amendment of
section 25 of
Haryana Act 30
of 2010.
5. (1) The Haryana Service of Engineers, Group A, Public Works (Buildings and Roads) Department (Amendment) Ordinance, 2019 (Haryana Ordinance No. 2 of 2019) is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the principal Act, as amended by the said Ordinance, shall be deemed to have been done or taken under the principal Act, as amended by this Act.
