to amend the Ind ustria l Disputes A c t, 19 47 in its applic ation to the S tats o f Assart. Pream ble. Whereas it is ex pedient to amend the Ind ust rial Act 14 of Disputes Act, 1947, in its app lica tion to the Sta te of¹9⁴7-

Am end ment

1. (1) This Act may be called the Ind ust ria l utes (Assam A men dment) Ac t, 1962.

(2) It extends to the whole of the Sta te of Assam.

(3) It shall come into force at once,

2. In sub-section (3) of section 7-A o f the Indu s- of Act' l4 oP Disputes Act. 1947, after c lause (a) the following 194 7, clause shall be inser ted, namely :—

" (aa) he has worked as a Distr ict Judg e or as an Add ition al Dis trict Ju dg e or as both for a total perio d of no t less than th ree years or is qua lified for app oin tment as a

Ju dg e of a Hig h Cou rt : Provided that the appointme nt to a Tribunal of any person qualified under this clause shall n ot be made withou t consultat ion with the Assam High Co urt; or" .

Am end ment 3. To clause (Z>) of section 7-C of the Indu str ial ct sec tion 7C j ) i Sp U t e g A c t, 1947, the following proviso shall be °947.^Ct°^a^d^d^e^d

" Provided th at where such pres iding officer of a Tr ibu na l appoint ed by the Sta te Govern- ment attain s the age of sixty-five years before the completion of any proce edings pending before h im, the Sta te Governme nt may, if in the opin ion of such Government public interest so requires, ord er his con tinuance in office for a period not exceeding six months for completion of the proceedings."

(2) Notwi thst and ing such repeal , any thing done or any action take n under the Ind ust ria l Disputes (Assam Amendm ent ) Ordinance, 1962 shal l b e deem ed t to have been done or taken under this Act as if this Act had comm enced on the twe ntie th day of Janu ary 1962 (the da te of pro mulga tion of the Ord inance ).
