Uttar Pradesh act 017 of 1970 : The UTTAR PRADESH OFFICIAL LANGUAGE (SUBORDINATECOURTS) ACT, 1970

Section 1.Short title and extent.

(1) This Act may be called the Uttar Pradesh Official Language (Subordinate Courts) Act, 1970

(2) It extends to the whole of Uttar Pradesh.

Section 2.Amendment of section 137 of Act V of 1908

In section 137 of the Code of Civil Procedure, 1908, in subsection (3), the following proviso thereto shall be inserted, namely:

“Provided that with effect from such date as the State Government in consultation with the High Court may by notification in the Gazette appoint, the language of every judgment, decree or order passed or made by such courts or classes of courts subordinate to the High Court and in such classes of cases as may be specified shall only be Hindi in Devnagri script with the international from of Indian numerals.”

Section 3.Amendment of section 367 of Act V of 1898.

In section 367 of the Code of Criminal Procedure, 1898, in sub-section (1), the following proviso thereto shall be inserted, namely:

“Provided that with effect from such date as the State Government in consultation with the High Court may by notification in the Gazette appoint the language of every judgment or order passed or made by such courts or classes of courts subordinate to the High Court and in such classes of cases as may be specified shall only be Hindi In devanagri script with the international form of Indian numerals.”

Section 4.Repeal of U.P. Ordinance no 4 of 1970.

The Uttar Pradesh Official Language (Subordinate Courts) Ordinance, 1970 is hereby repealed.
