(As passed by 1he Utrat Pradesh legislature) AN ACT further to amend rhe Uftar Pradesh Star~ Commission/or Women Act, 2004 .

IT ts HEREBY enacted in the Fifty-eighth Year of the K.epublic of India as follows:- ·

· .1. ( 1) This Act may be called the Uttar Prndesh Com.mission for Women Sho11 title nnd · (Amendment) Act, 2007. commencement · (2) !t shall be deemed to have come into force on June 15, 2007.

2. In section 3 of the Uttar Pradesh Commission of U.P. Act

Act, 2004 hereinafter referred to as the principal Act, for

(a) after clause (a) the following clause shall be inserted, namely :- "(aa) Two Vice-Chairperson who shall be women and have worked for the welfa of women possessing a Degree of University established by law in India or a qualificatic

recognized as equivalent thereto, nominated by the State Government; (b)for clause (b) the following clause shall be substitted namely ·_ the upliftm(be)nsteavnedntweeenlfamreemofbethres wnoommienna;t'ed by the State Government who have worked fo Amendment

namely:-(a) For sub-sections (1), (2) and⁽³⁾the following sub-sections shall be substituted

"(J) The Chairperson, a Vice-Chairperson or every member shall hold office for a

term ofone year from the date he assumes office or at the pleasure ofthe State Government:

(2) The Chairperson shall not hold office below the age 0f 32 years and after the

age of 60 years, no Vice-Chairperson shall hold office below the age 0f 28 years and after the age of 60 years and no other member shall hold office before attaining the age of 22 years and after completing the age of60 years.

(3) The Chairperson and Vice-Chairperson shall be having the status ofMinister of

State and Deputy Minister of the State respectively."

5. (1) The Uttar Pradesh State Commission for Women U.P. Ordinance (Amendment) Ordinance, 2007 is hereby repealed· . no. 14 of2007 (2) Notwithstanding such repeal, anything done or any action taken under the provisions of the principal Act as amended by the

· Ordinance referred to in sub-section (I) shall be deemed to have been done

or taken under the corresponding provisions of the principal Act as

amended by this Act as if the provisions of this Act were in force at all

. material times.

. STATEMENT OF OBJECTS AND REASONS

The Uttar Pradesh State Commission for Women Act, 2004 (U.P. Act no. 7 0f 2004) has been enacted to establish a State Commission for Women in the State of Uttar Pradesh . With the object of giving representation to the weaker section and youths of the society in the light of population and the geographical area, it was decided to amend the said Act mainly to provide for the Constitution of the Commission with a Chairperson, two Vice-Chairperson and seventeen members instead of a Chairperson and seven members, reducing the term of office of the Chairperson, and members including the

. vice-Chairperson from,yhree years to one,year and giving the status of the Minister of State and the Deputy Minister to the Chairperson and iheVice-Chairperson respectively.

' , a . Since the State legislature was not in session and immediate legislative action was necessary to' implement the aforesaid decision the Uttar Pradesh State Commission for Women (Amendment) Ordinance, 2007 (U.P. Ordinance no. 14 of 2007) was p-romulgated by the Governor on June 15, 2007.

Thereafter it has been decided to omit the restrictions of Area, Castes and Class from the provisions ofthe aforesa-id Ordinance with respect to the members of the Commission. This Bill is introduced to rep.lace_ the aforesaid Ordinance with the modification as aforesaid. By_order,
