AN ACT

further lo amend the Uttar Pradesh State Commissionfor Women Act, 2004. IT IS HEREBY enacted in the Sixty-fourth Year of the Republic of India as follows:-

1. (I) This Act may be called the Uttar 'Pradesh Slate Commission for Women (Amendment) Act, 2013. ^Shonlille^andcommncnccmcnt (2)? I.shallcomeinto forceonAnl 26, 2012.

2. In ·section 3 of the Uuar Pradesh State Commission for Women Act. 2004 Amendment of hereinafter referred to as the principal Act, insub-section (2),

section 3 of U.P. Acl no. 7 of 2004 (a) for clause (a) the following clause shall be substituted, namely :- "

. I "(a) one Chairperson and two Vice-Chairperson who shallbeWomcn

and have worked for the welfare of women, nominated by the State Government;";

(b) clause (aa) shall be omitted;

(c)for clause (b) the following clause shall be subsliluted. namely :-:--

"(b) twenty five members nominated by the State Government who shall be women and who have worked for the upliftment and welfare of the women:

provided that atlcast one member each shall be from am_ongst, lhe women belonging to,- (i) lhe Scheduled Castes or the Scheduled Tribes;

(ii) the other backward classes of citizens; ii)e minorities."

3. In section 4 of lhe principal Act, for sub-section (2) the following sub-section mcndmcnt of shall be substituted, namely. scction 4 "(2) the Chairperson. any Vice-Chairperson or any·member shalJ not hold office below the age of 25 years."

4. ln section 15 of the principal Act for the words "The Chairperson" the words Amendment of "The Chairperson, the Vice-Chairperson" shall be substituted.· ..-· section IS

(2) Notwithstanding suilk repeal,'anything done or any actionakcR under the provisions of the principal Act as amerided by the· Ordtnanoc referred lo in sub-section (I) shall be deemed to have been done or talcen under the corresponding provisions of the principal Act as amendedby this Act as if the provisions of this Act were in force at all material times.

STATEM .

ENT OF OBJECTS AND REASONS . With the -object of safeg~arding the constitutional rights of women and their development and welfare the Uttar Pradesh State Commission for Women Act, 2004 (U.P. Act no. 7 of 2004) has been cnactcd. Section 3of the said Act provides for the constitution of the Uttar Pradesh St11te Commission for Women. It was provided that the-said Commission shall be constituted with one woman Chairperson, two womcn Vice-Chairpersons and 17 members. With a view to making the functi . ons, responsibility and utility. . . of the said Commission more reasonable it bas been decided to amend the said Act to provide for the constitution of the said Commission with one woman Chairperson, two women Vice-Chairpersons and 25 women members and also for reducing the minimum age of the Chairperson,·the Vice-Chairpersons and the members from 32 years to 25 years.

. ..... Since the State Legislature was not in session and immediate legislative action was necessary lo implement the aforesaid decision the Utar Pradesh State Commission for Women (Amendment) Ordinance, 2013 (U.P. Ordinance n0. 5 of 2013) was promulgated by the Governor on April 26, 2013. This Bill is introduced to replace the aforesaid.Ordinance.

hereinafter referred lo as lhe principal"Act, in sub-section (2),- of 2004

(a)for clause (a) the following clause shall be substituted, namely:-

"(a) one Chairperson and two Vice-Chairperson who shall be Women and have worked for the welfare ofwomen, nominated by the State Govemment,", {b) clause (aa) shall be omitted;

(c)for clause (b) the following clause shall be substituted, namely:-

Amendment of

section 4 3. In section 4 of the principal Act,for sub-section (2) the following sue-sectionshall be substituted, namely-

Amendment of 4.In section 15 of the principal Actfor the words "The Chairperson" the words section 15 "The Chairperson, the Vice-Chairperson" shall be substituted.
