Uttar Pradesh act 004 of 1936 : The UNITED PROVINCES CIVIL JUDGES (DESIGNATION) ACT, 1936

Section 1.Short title extent and commencement

(1) This Act may be called the United Provinces Civil Judges (Designation) Act, 1936.

(2) It extends to the [Uttar Pradesh.]¹

(3) It shall come into force on such date as the [State Government]² may by notification³ in the Gazette appoint in this behalf

Section 2.Amendment of Act No. 12 of 1887

In sections 3, 4, 6, 10, 11, 13, 18, 21, 22, 23, 24, 25, 26, 27, 31 and 36 of the Bengal, Agra and Assam Courts Act, 1887, in its application to [Uttar Pradesh]¹ for the word “subordinate” the word “civil” shall be substituted.

Section 3.Amendment of U.P. Act No. 4 of 1925

In sections 21, 22, 25, 26, 29, 30, 31, 32, 35, 39, 40 and 44 of the Oudh Courts Act, 1925, for the word “subordinate”, the word “civil” shall be substituted.

Section 4.Amendment of other Acts

The Acts specified in the Schedule are hereby amended to the extent and in the manner mentioned in the second column thereof.

Section 5. Saving

The office of a Civil Judge shall for all purposes be deemed to be not inferior to that of a Subordinate Judge.
