Received the assent of the Govemor ofNagaland of 3.12.2012 and published in the Nagaland Gazette Extraordinary dated 14* December 2012. To further amend the Nagaland Salaries, Allowance and other facilities of the Chief Minister, other Ministers, Speaker, Leader of Opposition, Deputy Speaker, Parliamentary Secretaries and other Members of the Nagaland Legislative Assembly and Pension for ex-Members Act, 2005.
Be it enacted by the Nagaland Legislative Assembly in the sixty-third year of the Republic India as follows:-
Short title and commencement:
1. (1) This Actmay be called theNagaland Salaries, Allowance and other facdities of the Chief Minister, other Ministers, Speaker, Leader of Opposition, Deputy Speaker, Parliamentary Secretaries and other members of the Nagaland Legislative Assembly and Pension for ex-Members (third Amendment) Act, 2012.
(2) It shall come into force on the date the Govemor gives his assent.
(3) As a onetime measure all ex-Members who have been affected by the pre- amended provision will be deemed to have resigned within the prescribed penod and shall be entitled hereafter without arrears.
2. In the Nagaland Salmes. Allowance and other facilities ofthe Chief Minister. - other Ministers, Speaker, Leader of Opposition, Deputy Speaker, Parliamentary Secretaries and othermembers of theNagaland Legislative Assembly and Pension - - for for ex-Members Act, 2005.
For the existing clause (vi) of sub-section(5) of Section 2, the following may be substitutednamely,
"(vi) who has voluntarily resigned komhis membership excepting,-
(a) Amember who has voluntarily resigned his membership of the House any time to assume the office of (i) member of Lok Sabha or (ii) member of Rajya Sabha or (iii) member of any State Legislative or (iv) Minister in the Union or any State Government or (v) Governor or (vi) Vice President of

India or President of India or any other analogous constitutional or statutory office or post or who has voluntarily resigned on health grounds;
(b) A memberwho has voluntarily resigned before announcement of elections by the Election Commission of India; and
(c) The ex-Members ofthe Tenth Nagaland Legislative Assembly who had volmtady resigned and has not been entitled to pension shall be entitled to pension and family pension hencefort
