to provide for guaranreed delivery of notified series to citizens in tle State of Tripura withio the stipulated time limit td for mallers mmected rherewith and incidental thereto.

BE it enacted by the Trjpura Legislative Assenbly in lhe Seventy_first Yur ofdre Republic oalndia as follows:-

1. Short title atrd commencement. - (i) This Aci may be called the

2. Definitions.- In this Ad, unless theconte{ otheNise rcquires, -

(a) 'Appellale Authorily" means an oftice. appointed by the Government by notification invested with the powe. ro hear appql against the orders passed by any competent of8cer unde. this Acti

(b) "eligible person means a ciiiz who is eligible lbr obtaining dE norified sdNice

(d) 'D6ierEt€d Officef' means an ofiicer who is r€quired io provide citizen related seNice:

(e) "Norified se'vice' means any service notified by the state

(t) "covemmenf' means the Govemmert ofTripura;

(g) "prescribed" mealrs pr€scrib€d by the rutes rnade under this Acll

(h) "Public Authority ' means rhe Organization or Authonly or body or insrirution or a Local Authority established or consiituled,-

(i) by or onder the Constitution in the Stale:

(ii) by any other law nude by the State Legislature;

(iii) by notrfication issned o. order made by the Govemment and includes, -

(iv) body oured, contolled or substaniially financed;or

(v) Non'Governmeolai organization substantially fi nanced; directly or indirectly by the Govemment.

C) "Public servant" a person subst?ntively appointed to any service or post ofthe public 'naeuathiso nty:

(k) "Riglrt lo sewice- means right to obiain the citizen relaled seryices within tlrc stipulat€dtinre specified in the Schedule;

(l) "slipulated time" mears the maximunr time lo provide the seraic€ by the designated oflicer or to decide the appeal by the competent oflicer or Appellate Authoriry notified under Section3

3 . Right toobtain service tliahin stipulated time limit - (1) Every eligible citizen shall have nght to obtain citizen relaied eligible services in the State in accordance with this Act withn the stipulated time specified thereunder; (2) Every desi$ated oftlc€r and his subordinate public s€rvant ofthe Public Auihority shall provide the cilizen related s€rvices specified ir the Schedul€ to the cirizens eligible to obiain the ser,,ice, within the strpulated time ard also display the same on the norice board of rheir offices.

4. Notificition of services, designated otficen, conpetent ofticers, al pcllate authority snd stipulated tine limiis. - The Government mayby notification, amend, add or delete the services. d€signated omcers of every public authori, or Local Authority under each Secrelariat Departme.t, competent oflicer and appellate authonty aiong w1th stipulated time limits lvithin which the services are rendered under this Act and may by like notifrcation amend or vafr the entries in the rule.

s. Providins services trithiD th€ stipulatcd time. - (l)'lhe stipulal€d lime may start frcm the date when r€quired appiication is submitt€d to the designated olicer or to a person subordinate to him authorized to receive the application in such manner as may be prcscribed in tule. Such application sMll be duly acknowledged.

(2) The designaled omcer on receipt of an application under sub-section (l) shall within the slipulated time either dir€ctly provide the se ice or through an officer duly authorized by him or rejcct the application and jn case of rejection of applicalion, shall record the reasons in writing and intimate to the applicant, the information

about the period ofmaking appeal against the decision and all the details of the compelent ofI;cer to whom the first appeal lies.

6. Motritoring the status of the application. - (l) Every citizen having applied for any citizen related sewices may be provided an application number by the concemed Public Authonty, or local Authority. as rhe case may be, and may be entitlcd to obtain and monitor status ofhis applicaiion online in accordance with such procedure as may be prescribed

(2) Every public authoriry or lo(al Authority, as lhe case may be, may mainiain slatus of all applications goveming citizen relatsl services onlin€ and may be duty bound to update the status ofthe sam€ as pe. the procedur€ as prescribed by rules in this resard.

7. E-govemance of senic€s; -As a part of E-gov€manc€, the Govemment shall endeavour and encouage the public Authoriries, to deliver their citizen relared sen r(es elecronically or Ihrough

posl i, a phased manne. and in such other mmer d ruy be prescribed subject to payDent of such fees as may be prescribed.

8. Pryment ofcompensatory cost to the citizeo: -Citizen having applied for such services shall be entitled to seek conpensalory cosl in a.co.dance winr tlre provisions of this Act and rules made ther€under, in case of delay or defadt in the delivery ofsuch seflices b€yond the stipulated lime.

9. Liability to pay compensstory cost- Every Appeuate Authority or Competent Offcer or designat€d officer or his subordinale public servant who fails to deliver or dispose the citizen related seNices or appeals ofa citizcn \yitlin the stipulated time shall be liable 10 pay compensatory cost at therate oftventy rupe€s pe. day for the period of delay subject to a nra\intm of five hundred rLpees pe. application , in aggregate, if there is no ban or reshctiorl from ihe Government to provide tle same.

Providiry thar the payment of compensatory cosl for delay in disposing of apptications coutd not be imposed on folLowin| grounds: -

i) Mater pending or delayed because oflitigatio.

ii) Applicants intention is to eam profit ftom tlre compensatory cost

iii) The seNice applied required is ool needed by him at thal pointoftime

iv) There is nmrifold increase in applications.

v) Delayed because ofdisaster, breakdown ofnehvork Load shedding. Provided €very Departnent shall ensure thal that there are adequate slafi for processing and d€livery of services.

10. (3) On such demand of compensatory cost by the ciii2-en at the time of delivery of cilizcn relaled services. it slEll be the duly of the competent officer ro pay sucl cost lo thc citizen againsl acknowledgement and receipl in such manDer as Day be prescribed.

ll. Procedure soveming fixing ofliability.- (1) Within a penod offiliee! days of the payment of compensatory cost, the competent officer after condu.ting pre1imtuary en$iry, shrll issue af,otice against t\ep$lic sen'anl found responsible for the d€lay in delilery of such citizen related senices in such nErner as lnay be prescribed, calling upon him as to !i4ry the compensatory costpaidto thecrtizetr may Dot be recovered from hun.

(2) The public serant against whom such notice is issued may represent within a period of seven days fiom the date of receipt of sch notice. (l) wtile fixins the liabiliry underthis Act, tle competent office. shall follow tle principles of natual iastice before passing the order in fiat respcct.

12. Rightofappeal by tle publicsemDt - (1)Arypublic servant agerieved by the order Dased by the compctent offic€r in accordance will

(2) For the purpose of this Act, tlre Govemment shall appoint a! officer to be dre rppellate authoriqr to lear and decide appeals against the order passed by the coDpetent ofiicer. The appellate authority shall be an officer not below the rank ofthe Deputy Secr€tary to GovemmeDt or its equivalent rank.

13. Appeil by the aggrieved citizen. - (l) Al)y person, whose applicatioD is rejected under sub-section (2) of section 5 o. lvho is not provided the seNice stipulaled tine, m3y fit€ an appeal to the competent oilicer wi$j, tbiny days from dre date of rejection of application or the expiry of the stipulated time limit:

Prov;ded tiat the competent officer nay admit the appeal even after the expiry of the period of tliny days if he is satisfied that the appelLant was prevented by su{icient cause from filins the appeal in tn.e. (2J The competetrt offrcer may ord€r lo the designated ofiicer to provide fte service within the specified period or may rejed the appeal or may impose compensatory cost according to tle provisions ofsecdon9.

(3) An appeal agahst decision of competert officer shall lie 1o the appellate auihority within sixty days fiom the date on whiol lhe decisio! MS made:

(5) Jf tle design aled officer does not comply th sub-section (I) ofsection 5, then the applicant asgrieved from such non- compliance may submit an application direotly to the competent offic€r. This application shall be disposed of io the mamer asifitis lhe first appeal.

(6) If the designated ofiicer does not compLy the order of provjding thc service und€r sub-section (2) of this section, then the applicanl aggrieved from such non'compliance may submit an

application direcdy to the appellate authoriry This applicalion shall be disposed of in the manner of appeal.

(7) The competent ofiicer and the appellate authority slull whjle deciding an appeal unde. this section, have the same powers as are vested in civil cou( while trying a suit under the Code of Civil Procedu.e, 1908 (Central Act 5 of 1908) in respect ofthe following matte6, namely: .

(a) requiring the produciionand inspection of documenls;

(b) rssuing summons tbr hearing to the designated officer and appellant; and

(c) any other matter which may be prescribed.

14. Developing culture to deliver serv;ces within fixed period. - (l) The defauhs on Ihe pad ofdesignated oficer in the time bound delivery ofcilizen related seNices as defined in this Act shall not be counted towards misconductas the purpose and object is Io sensitizethe public seNant lowards the citizen a.d to enhance and imbibe a cullure to deliver time bound seNices

(2) In case of any designated ofiicer who is a habitual and wilfirl defaulter. without any reasonable cause and persistently failed to receive an application or has failed to provide service within the slipulaled time or identionally denied the request for the

service or delayed inordinately, the head of the Public Authoriry concemed shall be competed to take app.opriate disciplin ry action after recording a finding to this effect buf nol before giving a show cause notice and opporlunity oI hearing to the defaultrng oflcer.

(3) To encourage and enhance the elficiency of the desrgnated oflicer, a Ietter of appreciation for not a single deftult repoted may be issued and enlered in his Annual Perlonnance Report by the head ofthe Public Authority. a

(4) If. any Desispated officer or Conpetent officer or Appellate Authority fails ro detiver the Citizen related service or dispose appeals wi$in the stipr ated time for more lhrn seven times, he shall subject to enquiry by the concemed disciplina'y Anthorily and if found euilry. prepare a repon asaiDst the concemed otrcer and $rbnit it to the Govemment. The State Govemment after considering the report shall take action Bithin one monti from tbe date of receipt of the repon."

15. Deemed senice cordition. - The provisions ofihis Act shall be deemed to be part ofseNice conditions ofthe designated officer including such office. of atl hbLic Authorides.

16. Supplement - The provisions of this Act shall be supplemented to lhe disciplinary and financial rules and suci other seNice nlles and regulations as applicable to the employees of the Govenment or local Autnority or public authorily concemed. as fie ca* may be, and not in derogation !o such serice rules and reguiations goveming the se ce condition and conduct of the govemment employees or the employees of ahe other public authorit/

17. Protecnon ol actior taketr tu good faith.- No suil, prosecution or ofier lesal proceedrns shalt iie against any person for a,,4hins which is in sood faith done or nrtended to be done nder this Act or. any rule made tlereutrder.

18. Bar ofju.isdiction. - No CiviL court shall have iurisdictioD in respect of any matter which the comDetot officer or appellate authonly is empowered by or under this Act to determine.

19. Power to make rulee. - (l) The Govemment may,3fter previous publiqnon, by notification, in the official Gazetle, make rules to carry out the puaoses ofthisAct.

(2) Every rule made under tlris section shall be laid as soon as may be after it is made. before the Tripura Lesislative Assembly wl le it is in tle session for a total pef,od olfounefl day, whicl ma) be compriseo rn oie ses,ron or rn rso success,ve sessions and if before tfie expiry oftfi€ session in which it is so laid or the s€ssion immediately followins, The Tripum Lesisl:tive Assembly a$ee in makins any modification in fie rote or the Tripura

20. Pow€r to remove difficultiB. - Ifany difficulty arises. in giving effecl to rhe provisions of this Act, the Covemment may by order, not inconsistent with the provisions ofthjs Act, remove the difliculty:
