Uttar Pradesh act 010 of 1974 : The UTTAR PRADESH LEGISLATIVE ASSEMBLY SPEAKERS PENSION ACT, 1974

Section 1.Short title

This Act may be called the Uttar Pradesh LegislativeAssembly Speakers Pension Act, 1974.

Section 2. Pensions etc. to retiring Speakers

(1) Subject to the provisions of this section, every person who ceases to hold office as Speaker of the Uttar Pradesh Legislative Assembly, either by the expiration of his term of office or by resignation of his office,after having attained the age of not less than sixty eight years and having held the office of Speaker for not less than ten years (including any period before the commencement of this Act), shall be entitled to a pension of three hundred rupees per month and assistance allowance of one hundred and fifty rupees per month and, subject to any orders of the State Government in this behalf, also to medical attendance and treatment free of charge, for the remainder of his life.

(2) Nothing in sub section (1) shall apply in respect of a person who, after ceasing to hold office as Speaker, is a candidate for election to the State Legislature or to Parliament.

(3) Where any person who becomes entitled to receive pension and allowance under sub section (1) subsequently becomes a candidate for election to, or is nominated as a member of, the State Legislature or Parliament, or accepts the office of Minister, either for the Union or the State, or accepts any other office of profit under the Government of India or the Government of any State, shall cease to become entitled to the said pension and allowance and free medical attendance and treatment for the remainder of his life.

Section 3.Applicability to the Speaker of the last Legislative Assembly

The provisions of section 2 shall apply to the person who held office as the speaker of the Fifth Vidhan Sabha until March 18, 1974, as they apply to any person who ceases to hold office as Speaker after the commencement of this Act .

Section 4.Pension to be charged on the Consolidated Fund of the State

Any sum payable under this Act shall be charged on the Consolidated Fund of the State.
