Governor-General Act, 1858 [Repealed]

An Act for providing for the exercise of certain powers by the Governor General during his absence from the Council of India.

PREAMBLE

Whereas the Governor General in Council has declared that it is expedient that the Governor General should visit the North-Western Provinces of the Presidency of Fort William in Bengal, and other parts of India, unaccompanied by any Member of the Council of India; It is enacted as follows:

Section 1. Powers to be exercised by the Governor General during his absence from the Council of India

During the absence of the Governor General from the Council of India, it shall be lawful for the Governor General alone to exercise all the powers which might be exercised by the Governor General in Council in every case in which the said Governor General may think it expedient to exercise those powers.

Section 2. Power of the President in Council

All powers vested in the Governor General in Council by any Act of the Government of India, may be lawfully exercised by the President in Council.

Section 3. Commencement and duration of Act

This Act shall commence from the day on which it shall be notified by an order published in the official Gazette, that the Governor General has quited Calcutta for the purpose of so proceeding as aforesaid; and shall not continue in force for a longer period than six months.
