In exercise of the powers conferred by sub-section (1) of Section 97, read with clause(xxi) of sub-section (2) and sub-section (2A) of the said section and sub-section (3) of section 17 of the Employees' State Insurance Act, 1948 (34 of 1948) and in supersession of the Employees State Insurance Corporation (Medical Teaching Faculty posts) Recruitment Regulations, 2008 published in the Gazette of India vide No. A-12(11) 11/2008-Med.-IV dated the 2nd May, 2009, except as respects things done or omitted to be done before such supersession, the Employees' State Insurance Corporation hereby makes, with the approval of the Central Government, the following regulations for regulating the method of recruitment to the medical teaching faculty posts in the Employees' State Insurance Corporation's medical colleges, namely:
1. Short title and commencement: (1) These Regulations may be called the Employees' State Insurance Corporation (Medical Teaching Faculty posts), Recruitment Regulations, 2015.
(2) They shall come into force on the date of their publication in the Official Gazette.
These regulations shall apply to the posts specified in column (1) of the Schedule annexed to these regulations.
The number of posts, it's classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns(2) to (4) of the Schedule annexed to these regulations.
The method of recruitment, age-limit, qualification and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.
(1) Selection Board shall consist of
(a) a part-time Chairman of the status equivalent to Secretary or Additional Secretary to the Government of India or a person who had held the post equivalent to Secretary or Additional Secretary to the Government of India, may be appointed by Secretary, Ministry of Labour and Employment or the Director General, Employees' State Insurance Corporation, with the specific prior approval of the Chairman, Employees' State Insurance Corporation;
(b) two Medical experts from the discipline or specialised field for which recruitment is to be made, who may be chosen by the Chairman Selection Board from the panel of experts maintained for the purpose by the Director General, Employees' State Insurance Corporation; and
(c) the Medical Commissioner, Employees' State Insurance Corporation will be the departmental expert in New Delhi and in case of other States, the Senior State Medical Commissioner or State Medical Commissioner of the respective States will be departmental expert:
Provided, that the Director General can nominate some other officer as the departmental expert, in case the said officers are not available due to some reasons.
(2) The term of office of the part-time Chairman shall ordinarily be one year from the date of constitution of the Selection Board and his term may, however, be curtailed or extended by the Director General, with the specific prior approval of the Chairman, Employees' State Insurance Corporation.
(3) The part-time Chairman and the Medical or Dental Experts shall be entitled to travelling allowances, sitting fees, etc. at such rates as may be fixed by the Director General from time to time, keeping in view the rates prescribed by the Central Government.
(1) Direct recruitment to the posts included in the said Schedule shall ordinarily be made on the basis of an interview of eligible candidates by the Selection Board:
Provided that in case, it becomes necessary to adopt a different mode of recruitment other than on the basis of an interview of eligible candidates by the selection Board, the Director General may adopt the same after obtaining specific prior approval of the Chairman, Employees' State Insurance Corporation, and however, once a mode of recruitment is notified in the advertisement, no change shall be made subsequently.
(2) The number of candidates to be invited for interview shall be decided by the Chairman of the Selection Board, keeping in view the number of vacancies and the number of applicants who satisfy the prescribed requirement.
(3) Mere fulfillment of the prescribed requirement of age, qualification, experience, etc. will not confer any right on the applicant to be called for interview or to any claim over the post advertised.
(4) All work relating to issue of advertisement in respect of applications and processing of applications for submission to the Chairman, Selection Board will be handled by the office of the Director General, Employees' State Insurance Corporation.
(5) The Selection Board will be provided necessary secretarial assistance by the office of the Director General, Employees' State Insurance Corporation.
- No person:
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:
Provided that the Director General may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this regulation.
8. Power to relax Where the Director General of the Employees State Insurance Corporation is of the opinion that it is necessary or expedient to do so, he may, by order, for reasons to be recorded in writing and after obtaining specific prior approval of the Central Government, relax any of the provisions of these regulations with respect to any class or category of persons.
Nothing in these regulations shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Schedules Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
