An Act to repeal the Mizoram Street Vendor (Protection of Livelihood and Regulation of Street Vending) Act, 2011.
WHEREAS the Mizoram Street Vendor (Protection of Livelihood and Regulation of Street Vending) Act, 2011 (Act. No. 4 of 2012) was enacted on the basis of model Bill provided by the Central Government to the State Governments and came into force on 24.01.2012.
AND WHEREAS due to the fact that only 5 (five) states including the State of Mizoram enacted the said law and whereas it was considered, necessary by the Central Government to enact the law for the whole country the subject of which falls under Concurrent list, the Central Government enacted The Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 which extends to the whole of India except the State of Jammu and Kashmir.
NOW, THEREFORE, due to the enactment by the Central Government on similar subject, it is expedient to repeal the Mizoram Street Vendor (Protection of Livelihood and Regulation of Street Vending) Act, 2011.
It is enacted in the Mizoram Legislative Assembfy in the Sixty-Eighth year of the Republic of India as follows, namely:
This Act may be called the Mizoram Street Vendor (Protection of Livelihood and Regulation of Street Vending) (Repeal) Act, 2017.
(1) Mizoram Street Vendor (Protection of Livelihood and Regulation of Street Vending) Act, 2011 (Act. No. 4 of 2012) is hereby repealed.
(2) Notwithstanding such repeal, all orders issued and all actions taken or purported to be issued or taken under the said Act, shall be deemed to have been taken, or purported to be issued or taken under the provisions of The Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 .
