firrther to amend the Uttar Pradesh State Legislature (Members' Emoluments and: 4, Pension) Act, 1980 the Uttar Pradesh State Legislature (Officers Salaries and Allowancee Aa, 1952 and the Uttar Pradesh Ministers (Salaries, Allowances and Miscellaneons'. Provisions) Act, 1981.

IT IS HEREBY enacted in the Fifty-fifth Year of the Republic of India as follows :—

CHATTER I

PRELIMINARY

Short title and commencement

1. (1) This Act may be called the Uuar Pradesh State Legislature Members and Officers and Ministers Amenities Laws (Amendment) Act, 2004.

(2) It shall come into force with effect from April 1, 2004.

AMENDMENT OF THE UTTAR PRADESH STATE LEGISLATURE

(MEMBERS' EMOLUMENTS AND PENSION) ACT, 1980 2., In section 3 of the Uttar Pradesh State Legislature (Members' Emoluments and Pension) Act, 1980, hereinafter referred to in this chapter as the principal Act, in I sub-section (1)for the words "two thousand rupees" the words "three thousand rupees': . shall be substituted.

In section 4 of the principal Act, Or the words "five thousand rupees" the ; wOrds "seven thousand five hundred rupees" shall be substituted In section 5 of the principal Act,—

in sub-section (1) for the words and figures "and not exceeding eighty-eight thousand rupees per annum from June 1, 1998" the words and figures "not exceeding eighty-eight thousand rtives per annum from June 1, 1998 and not exceeding one lakh twenty thousand rupees per annum from April 1, 2004";

in sub-secion (2),—

(i)for the words "ten thousand rupees" the words "twenty thousand rupees" shall be substituted;

(ii) in the first proviso, in clause (b) for the words "three thousand rupees" the words "five thousand rupees" shall be substituted

5. In section 14 of the principal Act, in clause (d), in the second proviso^for the words "two members" the words "five members" shall be substituted.

6. In section 15 of the principal Act,— in sub-secion (1)for the words "two hundred fifty rupees" the words

"three hundred rupees" shall be substituted; in sub-section (2)for the words "two hundred rupees" the words "two hundred fifty rupees" shall be substituted;

(c)in sub-section (3)for the words "two hundred rupees" the words "two hundred fifty rupees" shall be substituted.

7. In section 15-A of the principal Act, for the words "one thousand rupees"

the words "two thousand five hundred rupees" shall be.substaufed.

8. In section 18-A`of the principal Act, in clause (a) for the words "one thousand rupees" the words "two thousand rupees" shall be substituted.

9. In section 24 of the principal Act,— in sub-section (1) for the words "one thousand five hundred rupees"

the words "two thousand rupees" shall be substituted; in the proviso for the words "two hundred rupees" the words "two hundred fifty rupees" shall be substituted;

after the first proviso the following proviso shall be inserted, namely:—

"Provided further that in the event of dissolution of Assembly, the period from the date of dissolution of Assembly, till the date of first meeting of the new Assembly, shall be counted for pension purposes of a member who has been the speaker of the dissolved Assembly and has continued to be in office as such during the said period ".

after the aforesaid proviso the following Explanation shall be inserted, namely:—

"Explanation—Where a person have served as a member of the Assembly or the Council for a term of six months and above'and have not completed one year then such person shall for the purposes of calculating the pension, be deemed to have served as a member for one year".

AND ALLOWANCES) ACT, 1952

In section 2 of the Uttar Pradesh State Legislature (Officers Salaries and Allowances) Act, 1952, hereinafter in this Chapter referred to as the principal Act, in

sub-section (1)for the words "two thousand and five hundred rupees" the words "five thousand rupees" shall be substituted.

In section 4 of the principal Act in sub-section (3) for the words "two thousand and five hundred rupees" the words "five thousand rupees" shall be substituted. Amendment of

CHAPTER IV

AMENDMENT OF THE UTTAR PRADESH MINISTERS ( SALARIES, ALLoWANC_ES AND

MISCELLANEOUS PROVISIONS) ACT, 1981

12. In section 3 of the Uttar Pradesh Ministers ( Salaries, Allowances and Miscellaneous Provisions) Act, 1981,—

in sub-section (1) for the words "two thousand and five hundred rupees" the words "five thousand rupees" shall be substituted; in sub-section (2) for the words "two thousand two hundred and twenty-five rupees" the words "four thousand rupees" shall be substituted.

STATEMENT OF OBJECTS AND REASONS

In view of price rise and increase of responsibilities, it has been considered expedient in public interest to revise, the pay, allowances, railway coupons and other amenities admissible to the members, officers and Ministers of the State Legislature and to increase the pension and railway coupons admissible to ex-members. It has therefore, been decided to amend the Uttar Pradesh State Legislature (Members' Emoluments and Pension) Act, 1980 and Uttar Pradesh State Legislature (Officers Salaries and Allowances) Act, 1952 and the Uttar Pradesh Ministers (Salaries, Allowances and Miscellaneous Provisions) Act, 1981 to revise the Salaries and allowances and other amenities of the members and officers and Ministers of the State Legislature.

The Uttar Pradesh State Legislature Memebers and Officers and Ministers Amenities Laws (Amendment) Bill, 2004 is introduced accordingly.
