AN
ACT
To provide for the Constitution of the United provinces Rakshak's Dal
Preamble Whereas it is expedient to provide for the
constitution of a force known as the United
Provinces Rakshak Dal for the preservation of
public peace, training of men in the use of arms
inculcate self-help and discipline and the
protection of the life of community and property
within the United Provinces
It is hereby enacted as follows :
Short title, extent &
commencement
1. (i) This Act may be called the United Provinces
Rakshak Dal Act, 1948.
(ii) It extends to the whole of the United Provinces .
(iii) It Shall come into force at once.
2. In this Act, unless there is anything repugnant in
the subject or context-
(a) "Administrative Commandant", "Gazetted
Officer" "Honorary Officer of equivalent Rank"
and "Non Gazetted Officer" mean persons
appointed to such offices as may be prescribed:
(b) "Member of the Rakshak Dal" means person
who is enrolled as such and includes an officer
appointed under the provisions of this act :
(c) "Provincial Government": means the
Government of the United Provinces
(d) "Prescribed" means prescribed by rules or
regulations framed under this Act.
Constitution of U.P.
Rakshak Dal
3. There shall be raised and maintained a force to be
designated "The United Provinces Rakshak Dal"
herein after called the Rakshak Dal and it shall be
constituted in such manner as may be prescribed.
Enrolment 4. Subject to such conditions as may be prescribed
any person may be enrolled as member of the
Rakshak Dal and his conditions of service shall
be such as may be prescribed.
Functions 5. A member of the Rakshak Dal when called upon
to do so by the prescribed authority, shall
discharge such functions in relation to the
preservation of public peace and for the
protection of inhabitants and the security of
property in any area within the United Provinces
as such prescribed authority may direct.
Declaration 6. Every member of the Rakshak Dal shall on
enrollment make a declaration in the form given
in the schedule.
Powers, protection and
control etc.
7. (1) For the enforcement of the provision of this act or
any rule or regulation made there under every
member of the Rakshak Dal shall, when on duty
or called for duty, be deemed to be a police
officer and subject to any terms, conditions and
restrictions as may be prescribed, to have and be
subject to, in so far as it is not inconsistent with
this Act, all the powers, privileges, liabilities and
protections, as a police officer duly appointed has
or is subject to by virtue of the Police Act, 1861
(save section 29 thereof), or of any other law for
the time being in force.
(2) No prosecution shall be instituted against a
member of the Rakshak Dal in respect of
anything done or purported to be done by him in
discharge of his functions as such member, except
with the previous sanction of the authority
prescribed in that behalf.
(3) The superintendence of the force in an area shall
vest in such officer or officers as may be
appointed by the Provincial Government.
Period of service and
discharge
8. Every member of the Rakshak Dal shall be
required to serve the Provincial Government for
such period as may be prescribed. He shall
thereafter be called up for duty at any time during
a further period as may be prescribed. After the
expiry of such further period the member shall be
deemed to have been discharged from the
Rakshak Dal. Offences 9. Any member of the Rakshak Dal who-
(a) fails to report himself when called up for duty
under section 5, or
(b) without sufficient excuse neglects or refuses to
obey the orders of his superior officer or fails to
discharge his functions as a member of the
Rakshak Dal while on duty, or
(c) deserts his duty or
(d) contravenes any provision of the Rules &
Regulations made under this Act,
Shall be punished with imprisonment for a term
which may extend to three months, or with fine
which may extend to five hundred rupees, or with
both.

10. When a member of the Rakshak Dal other than
an officer is charged with an offence punishable
under section 9, the Administrative Commandant
or, if so authorized in writing by the
Administrative Commandant in that behalf, any
gazetted officer or any honorary officer of
equivalent rank under whom the member of the
Dal is for the time being serving, may direct that
the charge shall be dealt with without formal trial
and thereupon the officer commanding the
detachment may award to such member any one
or more of the following punishments, namely :
(a) confinement in such place as may be considered
suitable for a period not exceeding seven days;
(b) punishment drill, extra work, fatigue or other
duty, not exceeding thirty days in duration, with
or without confinement to quarters;
(c) Forfeiture of emoluments for a period not
exceeding one month.

11. When a member of the Rakshak Dal who is a non
gazetted officer, is charged with an offence
punishable under section 9, the Administrative
Commandant or, if so authorized in writing by
the Administrative Commandant in that behalf
any gazetted officer or any honorary officer of
equivalent ranl under whom the member of the
Dal is for the time being serving, may without
formal trial award to such member any one or
more of the following punishments, namely;
(a) reduction to a lower grade or a lower class or to
the ranks;
(b) forfeiture of pay and allowances for a period not
exceeding one month;
(c) punishment drill, extra work or other duty not
exceeding thirty days in duration;
(d) Reprimand or severe reprimand.

12. When a gazetted officer or any honorary officer
of an equivalent rank is charged with an offence
punishable under section 9, the Administrative
Commandant may, without formal trial
reprimand or severely reprimand such officer or
may refer the matter to the Provincial
Government for orders.
Trial of offences 13. An offence punishable under section 9, shall if the
charge is not disposed of under section 10, 11 or
12 be tried by a Magistrate of the first class
having jurisdiction.
Powers of Provincial
Government to award
punishment
14. Without prejudice to any other punishment which
the Provincial Government may impose under
any other law or rule for the time being in force
the Provincial Government may on a reference
under section 12 or on its own motion award to a
gazetted officer or an honorary officer of an
equivalent rank all or any of the following
punishments, namely;
(a) reprimands or severe reprimand;
(b) deduction in the case of paid officer, from pay to
defray expenditure or recoup loss incurred as a
consequence of misconduct by him;
(c) forfeiture of service; and
(d) reduction of rank.
Custody during
investigation
15. Any member of the Dal charged with an offence
punishable under this Act may be taken in to and
kept in custody in the prescribed manner by the
prescribed authority pending investigation.
Proof of enrolment 16. In any proceeding before a court the fact that a
person is enrolled under this act may be proved
by the production of a certificate signed by the
Administrative Commandant or any honorary
officer of equivalent rank as may be prescribed.
Permission by employer
to join duty
17 (1) Except as may be prescribed, every employer, his
agent or manager shall permit a member of the
Rakshak Dal, who is for the time being employed
by or under him, to join his duty as such and not
withstanding anything in any law or agreement
between him and such member in force, the
period between the date of the member joining his
duty and his release there-from shall, subject to
such condition and restrictions, as may be
prescribed, be deemed to be period spend in such
employment.
(2) No employer, his agent or manager, shall dismiss,
remove or suspend any employee, or take any
other action which may prejudice such employee
by reason of his being a member of the Rakshak
Dal. (3) Whoever contravenes the provision of sub-section
(1) or (2) shall be punished with fine which may
extend to five hundred rupees.
Payment of compensation
and allowance to
Employer other than
Provincial Government
18. whenever any member of the Rakshak Dal who is
employed under any person other than the
Provincial Government is called up for duty, the
Provincial Government shall pay such
compensation and allowances to the employer and
to the member as may be prescribed.
Repeal of the United
Provinces Home Guards
Act-1948
19. The United Provinces Home Guards Act (Act 1
of 1947) as amended by the United Provinces
Home Guards (Amendment) Ordinance 1948 is
hereby repealed; Provided that (without prejudice to the
General application of section-6 and 24 of the
United Provinces General Clauses Act 1904 with
regard to the effect of repeals).
(a) any form, order, rule or direction made, issued or
given under the said Act shall continue in force as
if it had been, prescribed, made, issued or given
under this Act and may be repealed, revoked,
varied or amended accordingly;
(b) any officer or person appointed to Act or enrolled
under or by virtue of the said Act shall continue
and be deemed to have been appointed under or
by virtue of this Act;
(c) any statement executed by any member of the
Prantiya Rakshak Dal in accordance with section-
7 of the said Act in force at the commencement of
this Act shall be so read and construed as if it has
been executed under the corresponding provisions
of this Act.
Rules making power 20 (1) The Provincial Government may, after previous
publication in the official Gazatte, make rules and
regulations to carry out the purposes of this Act
(2) In particular and without prejudice to the
generality of the foregoing power, such rules and
regulations may-
(a) prescribe the manner in which & the conditions
subject to which any person may be enrolled of
appointed as a member of the Rakshak Dal
(b) prescribe the authorities under which and the
conditions subject to which any person enrolled
or appointed as a member of the Rakshak Dal
may serve
(c) prescribe the classification of officers whether
honorary or paid, in to gazetted and non-gazetted
categories
(d) prescribe the duration and manner of training of
such member and the obligations to which such
member shall be liable when undergoing such
training and generally for the maintenance of
discipline; and
(e) Provide for any other matter which, under this
Act is to be or may be prescribed.

No. B-2938/VIII- In exercise of the powers conferred by section 12 of the
United Provinces Home Guards Act, 1947 (United Provinces) Act no.1 of 1947 as
amended by the United Provinces Home Guards (amendment) ordinance, 1948 (United
Provinces Ordinance no.V of 1948), the Governor is hereby pleased to make and
promulgate the United Provinces Rakshak Dal Rules 1948 and the said Rules are hereby
published for general information:
United Provinces Rakshak Dal Rules-Part-1
1. (1) These Rules may be called the United Provinces Rakshak Dal Rules, 1948.
(2) These shall come in to force at once.
2. In these Rules unless there is anything repugnant in the subject or context
(a) "Act" means the United Provinces Home Guards Act, 1947 as amended by the
United Provinces Home Guards (Amendment) Ordinance, 1948.
(b) "Administrative Commandant" "Gazetted Officer" "Honorary Officer of
equivalent rank" and "Non gazetted officer" means the persons appointed to
such officers in the Dal.
(c) 'Dal' means the Prantiya Rakshak Dal.
(d) 'Enrolling authority' means the person or committee appointed as such by the
Provincial Government under rule 3.
(e) 'Form' means a form appended to these rules.
(f) 'Province' means the United Provinces
(g) 'Rakshak' means a member of the Dal other than an officer, a clerk or a
follower.
(h) 'Schedule' means the Schedule attached to these rules.
3. The Provincial Government may appoint any person or committee as the
Enrolling Authority for any area. The Enrolling Authority may enroll persons
resident in the area for which it is appointed who may offer themselves for
enrolment in the Dal.
4. (1) Every person enrolled in the Dal, unless discharged or dismissed earlier, shall
remain a member thereof for a period of three years, or until he attains the age
of 50 years, whichever is earlier :
Provided that the limitation as to age or period of membership shall not
reply to persons who have been conferred honorary ranks in the Dal by the
Provincial Government by reason of their distinction in social, political or
other aspect of the life of the community.
5. (1) When any person offers himself for enrolment in the Dal and appears before
the Enrolling Authority, it shall read and explain to him or cause to be read and
explained to him the conditions set forth in Form 1 which shall be known as
the Enrolment Form, shall put to him the Questions set forth in that Form, after
having cautioned him that he is bound to state the truth in answer to any
question, and shall record or cause to be recorded his answer to each such
question.
(2) In answering the questions set forth in the Enrolment Form, the person offering
himself for enrolment shall be bound to state the truth.
(3) If after complying with the provisions of sub-rule (1) the enrolling authority is
satisfied that the person offering himself for enrollment understands the
questions put to him and accepts the conditions set forth in the Enrollment
Form, and if it sees no impediment to the Enrollment, it shall sign, and shall
also cause such person to sign, the Enrollment Form and the person shall then
be deemed to be duly enrolled.
(4) No person shall be Enrolled in the Dal who-
(a) has not attained the age of 18 years or has attained the age of 45 years (b) is not passed by the medical authority as fit to perform the duties
required of a member of the Dal,
(c) has been convicted of an offence involving moral turpitude, or (d) is under police surveillance or under restraint under any provision of
the law for the time being in the force;
Provided that the maximum age limit mentioned in clause (a) shall not
apply to servants of the Crown whether on active list or retired who may be
appointed to the Dal.
6. When a person has been enrolled under rule 5, the enrolling authority shall
complete Form II which shall be known as the recruitment Certificate and
direct the person to report to the District Organizer at such time and place as
may be specified.
7. Medical Examination- Before being enrolled, every person offering himself
for enrolment shall be examined by the Medical Authority who shall enter on
the Enrolment Form his opinion whether the recruit is physically fit or not in
every respect for service in the Dal. The medical authority shall satisfy itself
that every person passed as medically fit for service in the Dal is fit to undergo
physical exertion over protracted periods, But no fixed standard of height or
chest measurement or weight shall be insisted on and slight degrees of
disability not interfering with the performance of normal work may be
condoned.
8. Terms of Service- (1) Every member of the Dal shall be entitled to receive
such pay and allowances and clothing and rations as may be laid down from
time to time.
(2) Every member of the Dal shall be entitled to free medical attention and free
accommodation while called up for duty
9. Medical Authority- The Provincial Government shall appoint qualified
persons on such terms as it considers necessary to carry out the Medical
Examination of persons offering themselves for enrollment in the Dal or to act
as Medical Officers of any unit or part of a unit.
Provided that Medical Officers of any District Board hospital or those
appointed to examine recruit to Provincial Police shall be deemed to be
appointed under these rule to examine recruits for the Dal.
10. Transfer- (1) The Provincial Government shall fix the headquarters of each
unit and may transfer any unit or part of a unit from any one place in the
Provinces to any other.
(2) The Provincial Government or any other officer appointed by the
Provincial Government in this behalf may transfer any salaried member of the
Dal from one unit to another
11 Leave- Every full-time paid member of the Dal shall subject to exigencies of
the service, be eligible for the grant of casual leave, earned leave and leave on
medical certificate on same terms and conditions as a member of the
Provincial Police of the same rank and status.
12 Full-time salaried Members of the Dal shall be subject to same terms and
conditions regarding pay, travelling allowance, provident fund, etc. as other
temporary servants of the Provincial Government of corresponding rank and
status.
13 Discharge or dismissal- (1) every member of the Dal who is convicted by a
court and sentenced to a terms of imprisonment shall with effect from the date
of conviction be deemed to have been dismissed from the Dal,
2- The Provincial Government may discharge or dismiss any member of the
Dal, and
3- The Administrative Commandant may discharge or dismiss any enrolled
person below the rank of a District Organizer.
14 Non Judicial of minor offences of the member of the Dal other than officers- when a member of the Rakshak Dal other than an officer is charged
with an offence punishable under section II of the Act, the Administrative
Commandant or if so authorized in writing by the Administrative
Commandant in that behalf, any Gazetted Officer or any honorary officer of
equivalent Rank under whom the member of the Dal is for the time being
serving may direct that the charge shall be dealt without formal trial and
thereupon the officer commanding the detachment may award to such member
any one or more of the following punishment. namely :
(a) punishment, drill, extra work, fatigue or other duty not exceeding thirty days in duration, with or without confinement to quarters;
(b) Forfeiture of emoluments for a period not exceeding one month. 15 Non-Judicial disposal of minor offences of members of the Dal other than
officers and Rakshaks- when a member of the Rakshak Dal who is a
nongazetted officer, is charged with an offence punishable under section II of
the Act, the Administrative Commandant or if so authorized in writing by the
Administrative Commandant in that behalf any gazetted officer or any
honorary officer of equivalent rank under whom the member of the Dal is for
the time being serving, may without formal trial award to such member any
one or more of the following punishments namely;
(a) reduction to a lower grade or a lower class or to the rank; (b) forfeiture of pay and allowances for a period not exceeding one month; (c) punishment drill, extra work or other duty not exceeding thirty days in
duration:
(d) reprimand or severe reprimand. 16 Non-Judicial disposal of minor offences of gazetted officer- when a
gazetted officer or and honorary officer of an equivalent rank is charged with
an offence punishable under section 11, the Administrative Commandant,
may, without formal trial, reprimand or severely reprimand such officer or may
refer the matter to the Provincial Government for orders.
17 Power of Provincial Government to award punishment- without prejudice to
the general powers of the Provincial Government to award other punishment
under any law or rule for the time being in force, it may award to a gazetted
officer or honorary officer of equivalent rank the following or any of the
following punishments namely
(a) Reprimand or serious reprimand; (b) Deduction in case of paid officer from pay to defray expenditure or
recoup loss incurred as a consequence of misconduct by him;
(c) Forfeiture of service, and (d) Reduction of rank; 18 Procedure in dealing with offences- No member of the Dal shall be
discharged for an offence, dismissed or reduced in rank otherwise than by an
order based on facts which have led to his conviction in a court unless he has
been informed in writing of the grounds on which it is proposed to take action
and has been afforded an adequate opportunity of defending himself.
19 (1) The Officer commanding a unit shall, subject to any order issued in this behalf
by the Provincial Government set a part a place at the head quarters of the unit
for the confinement of persons order to be confined under these Rules and such
place shall be known as the Guard Room.
(2) Any Rakshak who is reasonably believed to have committed an offence under
the Act may (under the order of any officer superior in rank to him) be taken
into custody by any member of the Dal and may be confined in the Guard
Room.
(3) A member of the Dal superior in rank to that of a Rakshak may be taken into
custody only by officer of his own or a higher rank and shall when necessary
be confined to his quarters under the written order of the officer commanding
the unit.
(4) No member of the Dal shall be detained in custody pending an investigation of
an offence for a longer period than four days.
20 Duties of members of the Dal-(1) Every member of the Dal shall be required
to undergo such duty drill & physical or other training as may be ordered by
the Administrative Commandant or by an officer appointed by him in this
behalf and in all matters relating thereto shall obey the orders of his superior
officers.
2- Every member of the Dal shall when in uniform salute every officer who is
superior in rank.
21 Administrative training of units- Subject to the provisions of the Act and the
rules made there under, the Provincial Government may issue such orders as it
considers fit dealing with the administration, duties and training of unit
including the keeping of records and prescription of forms.
PART-II
22 Composition of units-(1) The Headquarters of the Dal shall be situated at
Lucknow and will when at the full strength consist of officers at other ranks
shown in schedule-A
(2) There will be five regional Headquarters in the Provinces at places to be
notified by the Provincial Government. When at full strength each regional
Headquarters will consist of officer and another rank shown in schedule B.
(3) The Dal in each district other than the districts of Almora, Nainital and
Garhwal shall consist of one or more battalions as may be ordered by the
Provincial Government from time to time. The number of companies in each
battalion shall not exceed four on the basis of one company per tahsil. Where
more than four tahsil exist in a district a second battalion will be raised. Each
battalion when at full strength will consist of officers and other ranks shown in
schedule C. Each company shall have four platoons and when at full strength
shall be composed of officers and other ranks shown in schedule D.
(4) The other ranks in the company shall be composed of selected Groups or
section leaders or both from the tehsil. The remaining enrolled persons shall
from a reserve which shall be known as the "Reserve Dal".
(5) The Reserve Dal shall consist of a Section Leader and eleven other ranks in
each village. Four sections will be grouped in to a group under a group leader.
Note- Regarding the composition of the Dal in the district of Almora, Nainital
and Garhwal the Provincial Government may issue such orders from time to
time as they consider necessary.
23 Command and Promotions- (1) The Provincial Government shall place the
Dal in each district under the command of commandant to be known as
District Commandant.
(2) The Provincial Government may in its discretion promote or demote any
officer.
24 Appointments- (1) The Provincial Government may by notification in the
official Gazette, post Administrative Commandant or other officers to any
unit, can or Headquarters of the Dal and may transfer such officer from one
unit to another or from one post to another.
(2) The Administrative Regional or District Commandant may appoint any
officer or Rakshak to be Quartermaster of a unit and to other ranks of a
company subject to the general directions issued from time to time by the
Provincial Government in this behalf.
25 Non-Gazetted Officers- (1) There shall be the following grades of group
leaders :
(i) Havaldar Major (ii) Quartermaster Havaldar (iii) Havaldars (iv) Naik (v) Lance Naik (2) The number of Havaldar major and Quartermaster Havaldar shall be
limited to one each per company while the number of Havaldars, Naiks and
Lance Naiks shall be 1, 3 and 3 per platoon respectively.
(3) The Havaldar and other officers mentioned in sub paragraph (1) shall be
appointed from among enrolled persons in the company by the Regional
Commandant in such manner as a Provincial Government may consider fit.
26 Badges of Rank- (1) The following Badges of Rank will, unless otherwise
ordered by the Provincial Government, be worn in gilt on the shoulder straps
of all officers :
(1) Administrative Commandant One Ashok wheel and two stars
(2) Camp Commandants One wheel and one star
(3) Regional Commandants One wheel
(4) District Commandants Three stars
(5) Company Commander Two stars
(6) Administrative Officr
(a) Gazetted Two Stars
(b) Non Gazetted--
(1) Two Miniature Stars on a ribbon
(2) One Miniature Star on a ribbon
(2) When in uniform non gazetted officers shall wear on the outside of the
upper portion of each arm the following distinguishing badges of rank of a
design and color to be approved by the Provincial Government:
(1) Havaldar Major One wheel on wrist
(2) Quartermaster Havaldar Three stripes surmounted by a
wheel
(3) Havaldar Three stripes
(4) Naik Two stripes
(5) Lance Naik One Stripe
Note- If a Gazetted officer holds a higher rank in the Army or Police at the
time of his appointment to the Dal, he will be allowed to retain that rank.
27 Uniform and personal equipment- (1) Every member of the Dal shall unless
otherwise ordered by the Provincial Government wear when on duty a
uniform of such design, material and color and distinguishing badges as may
be specified by the Provincial Government.
(2) Every member of the Dal shall be provided at his expense or at the expense
of the Provincial Government such articles of uniform, clothing or personal
equipment as the Provincial Government may direct, and such of these articles
as may be specified shall be the property of the unit or of the enrolled person
as the case may be.
28 Accommodation and unit equipment- Living accommodation and unit
equipment shall be provided on a scale to be fixed by the Provincial
Government at the Headquarters of each unit and at each place at which a unit
or part of a unit may be stationed when on duty.
29 Rations- Rations on a scale to be fixed by the Provincial, shall be issued to all
enrolled persons when called up for duty.
30 Application of these regulations to ten selected cities- These rules shall also
apply mutatis mutandis to ten cities viz in the cities of Meerut, Agra, Aligarh,
Moradabad, Bareilly, Kanpur, Lucknow, Allahabad, Banaras, there shall be
raised a separate group or Section Leader or both in addition to the companies
mentioned in sub rule-(3) of rule 22.
