संÉया-एल0जी0-47/2015-111/लेज0 झारखÖड ǒवधान मंडल का िनàनिलǔखत अिधिनयम, ǔजस पर राÏयपाल Ǒदनांक 01 जून, 2016 को अनुमित दे चुके हɇ, इसके Ʈारा सव[साधारण कȧ सूचना के िलये Ĥकािशत Ǒकया जाता है ।
झारखÖड लोक भूिम अितĐमण (संशोधन) अिधिनयम, 2016
(झारखंड अिधिनयम संÉया-18, 2016) झारखÖड लोक भूिम अितĐमण अिधिनयम, 1956 का संशोधन करने के िलए अिधिनयम । भारत गणराÏय के सड़सठवɅ वष[ मɅ झारखÖड राÏय ǒवधान मंडल Ʈारा िनàनिलǔखत Ǿप मɅ यह अिधिनयिमत हो:-
1. संǔ¢Ư नाम, ǒवèतार एवं Ĥारàभ:-
(1) यह अिधिनयम झारखÖड लोक भूिम अितĐमण (संशोधन) अिधिनयम, 2016 कहा जा सकेगा।
(2) इसका ǒवèतार सàपूण[ झारखÖड राÏय मɅ होगा ।
(3) यह तुरÛत Ĥवƣृ होगा

2. झारखÖड लोक भूिम अितĐमण अिधिनयम, 1956 (यथा संशोिधत 14 नवàबर 2000 तक) कȧ धारा-6 का संशोधनः -
(i) उƠ अिधिनयम, 1956 कȧ धारा-6 कȧ उप धारा-(1) का खंड-(ग) ǒवलोǒपत Ǒकया जाएगा।
(ii) उƠ अिधिनयम, 1956 कȧ धारा-6 कȧ उप धारा-(2) िनàनिलǔखत Ʈारा Ĥितèथाǒपत कȧ जाएगी।
"(2) यǑद कोई åयǒƠ समाहता[ Ʈारा इस धारा के अधीन पाǐरत आदेश का अनुपालन नहȣं करता है तो वह उस कारावास, ǔजसकȧ अविध एक वष[ तक ǒवèताǐरत कȧ जा सकेगी, अथवा Ǿ0 25,000/- (पÍचीस हजार) तक जुमा[ना अथवा दोनɉ से दंडनीय होगा।"
3. åयावǒृƣ :- झारखÖड लोक भूिम अितĐमण अिधिनयम, 1956 (यथा संशोिधत 14 नवàबर 2000 तक) कȧ धारा-6(1) (ग) के ǒवलोǒपत होते हुए भी, धारा-6(1) (ग) के अधीन, Ĥदƣ शǒƠयɉ के Ĥयोग मɅ Ǒकया गया कोई भी कार[वाई इस अिधिनयम Ʈारा या के अधीन Ĥदƣ शǒƠयɉ के Ĥयोग मɅ Ǒकया गया या कȧ गई समझी जाएगी, मानɉ उस Ǒदन उƠ Ĥावधान Ĥवƣृ था, ǔजस Ǒदन ऐसा काय[ Ǒकया गया या ऐसी कार[वाई कȧ गयी थी। झारखÖड राÏयपाल के आदेश से,

संÉया-एल0 जी0-47/2015-112/लेज0 झारखÖड ǒवधान मंडल Ʈारा यथापाǐरत और राÏयपाल Ʈारा Ǒदनांक 01 जून, 2016 को अनुमत झारखÖड लोक भूिम अितĐमण (संशोधन) अिधिनयम, 2016 का िनàनांǑकत अंĒेजी अनुवाद झारखÖड राÏयपाल के Ĥािधकार से इसके Ʈारा Ĥकािशत Ǒकया जाता है, ǔजसे भारतीय संǒवधान के अनुÍछेद 348 के खÖड (3) के अधीन उƠ अिधिनयम का अंĒेजी भाषा मɅ Ĥािधकृत पाठ समझा जायेगा ।
The Jharkhand Public Land Encroachment (Amendment) Act, 2016 (Jharkhand Act-18,2016)
AN ACT To amend the Jharkhand Public Land Encroachment Act, 1956 (As amended till 14th November, 2000)
Be it enacted by the Legislature of the State of Jharkhand in the sixty-seventh year of the Republic of India as the following:-
1. Short Title, Extent and Commencement. —
(1) This Act may be called The Jharkhand Public Land Encroachment (Amendment) Act, 2016.
(2) It shall extend to the whole of the State of Jharkhand.

(3) It shall come into force at once.
2. Amendment in Section-6 of the Jharkhand Public Land Encroachment Act, 1956.—
(i) Clause (C) of Sub-Section-(l) of Section-6 of the said Act, 1956 shall be deleted.
(ii) Sub-section (2) of Section-6 of The said Act, 1956 shall be substituted by the following:-
"(2) If any person does not comply with the orders passed by the Collector under this section, he shall be punishable with imprisonment for a term, which may extend to one year or with fine up to Rs. 25,000/-(twenty five thousand) or with both."
3. Savings .—Notwithstanding the deletion of Section-6(l) (c) of the Jharkhand Public Land Encroachment Act, 1956 (Jharkhand Act XV, 1956) anything done or any action taken in exercise of the powers conferred by or under the Section-6(l) (c) shall be deemed to have been done or taken in exercise of powers conferred by or under this Act, as if the said provisions were in force on the day on which such thing or action was done or taken.
