THE PAYMENT OF SALARIES AND ALLOWA~CES (AMENDMENT) ACT, 1982*

(Act 2 of 1982)

An Act furth~r to amend the Payment of Salartes and Allowances Act, 1951.

Preambu -WHEREAS it is expedient further to amend the Payment of Salaries and Allowances Act, 1951, for the purposes hereinafter appearing ; BE it enacted in the Thirty-third Year of the Republic of India as follows:-

. 1. Short htle and commencement.-(!) This Act may be calkd the Payment of Salaries and Allowances (Amend .nent) Act, 1982.

(2) It shall come into force at once.

2. Amendment of IonS( lltle.-In the long title to the Payment of Salaries and Allowances Act, 1951 (XIV of 1951) (hereinafter referred to <~S the pnncipal Act), for the words "the Leader of the Opposition and members", the words ''the Leader of the Opposition, the Chief Whip and members" shall be substituted.

3. Amendment of preamble.-In the preamble to the principal Act, fer the words "and the Leader of the Opposaion," the words "the Leader ot the Opposition and the Chief Whip" shall be substituted.

4. Amendment oj Jectzon 2.-In sccuon 2 of the principal Act! 'I f• e::-

clause (f), the followmg clause shall be mserted, namely:-

"(g) "Chiei'Whip" means the Government Chief Whip in the Legislative Assembly ".

5. Amendmmt of section 3.-In section 3 of the pnncipal Act,-

(a) in the marginal note, for the words "and Leader of the Opposition", the words "; Leader of the Opposition and Chief Whip"

6 Amendment of section 5.-Jn section 5 of the principal Act,-

(a) in the mai·ginal note, for the words "and Leader of the OjJpo- sition", the words ·', Deputy Speaker, Leader of the Opposit1on and Chief Whip" shall be substituted ;

(b) for the words "and the Leader of the Opposmon", the word~ ., ,the Deputy Speaker, the Leader of the Opposition and the Chiel Wlup"

shall be subst1tuted ;

(b) for the words "and the Leader of the Opposition'', the words

"the Leader of the Oppos1tion and the Chief Whip" shall be substituted.

8. Amendment of sectzon 6.-In sectwn 6 of the principal Act,-

(a) in the marginal note, forth,. words "and Leade1 of the Oppo- sition", the words, "Leader of the Opposition and Chief Whip" shall be substituted;

(b) m sub-section (I), for the words "and the Leader of the Oppo- sition", the w0rds ",the Le"ader of the Opposition and the Chief Whip"

shall be substituted;

(c) in sub-sectior. (2) ,-

(1) for the word:- "and the Leader of the Opposition", the words ", the Leader of the Opposition and the Chief \.Yhip" shall be

. substituted; (1i) for the wotds "three hundred and fifty rupees", the words

"eight hundred and fifty rupees" shall be substituted;

(d) in sub-section (3), for the words ''and the Leader of the Oppo- sition", the words", the Leader of the Opposition and the Chief Whip"

shall be substituted.

• 9. Amendment if stctzon 6A.-In section 6A of the principal Act, -

(a) in the marginal note, for the words "and Leader of the Oppo- sition", the words ", Leader of the Opposition and Chief Whip" shall be substituted ;

(b) for the words ''and the Leader of the OppositiOn·', the words

", the Leader of the Opposition and the Chief Whip" shall be substituted.

(b) in sub-section (4), for the words "and the Leader of the Opposition", the words", the Leader of the Opposition and the ·chief Whip" ~hall be st.~bstituted.

11. Amendment of section 8. -In sectior:. 8 of the principal Act,-

(a) in sub-sectiOn (1 ),-

(i) to clause (b), the following proviso shall be added, namely:-

" Provided that the travelling allowance which a member is entitled to r..:ceive under this clause for journeys ins1de the State of Kcrala shall not be less than one thousand rupee~ per mcnsem.";

(1i) clause (c) shall be omitted ;

(b) in sub-section (4), after the words "the Leader of the Oppo- sition", the words", the Chief Whip" s'1all be inserted.

12. Amendment of section 8 A.-In section 8A of the principal 1\ct, in ctub-seions (I) and (3), after the word.; "the Leader of the Opposition", the words '',the Chief Whip" shall be inserted.

13. Amendment of sectzon 9.-In sectiOn 9 of the principal Act, in sub- section (1), after the words " the Leader of the Opposition", the words ccthe Chie1 Wlup" shall be mserted':

14. Amendment of section 9A.-In section 9A of the principal Act, in sub-section ( 1) ,-

(a) after the words "the Leader of the Opposition", the words ec ,the Chief Whip" shall be inserted.

(b) for the words "two thousand and five hundred rupees", the words "fiv<: thousand rupees" shall be substituted.

15. Amendment of Schedule.-In the Schedule to the principal Act,- ( l) u'J paragraph I,-

(a) in the marginal note and in the openmg portion, for the words "and the LPader of the Oppos•tion", the words '', the Lc<~.der of the Opposnion and the Chid Wh1p" shall be substituted ;

(b) in clause (1),-

(i) in sub-clauses (a) and (b), for the words "twenty-five rupees", the words "fifty rupees" shall be substituted ;

(ii) in sub-clause (c), for the words ''twelve paise", the words

"twenty-five patse'' shall be substituted ;

(iii) in sub-clause (d), for the letters and figures "Rs. 62.50", the letters and figure, "Rs. 125" ~hall be substituted ;

(c) in clause (2), in sub-clause (b), for the words "thirty-five rupees", the words "eighty rupees" shall be substituted ;

(2) , i nparagraph III,-

(a) in clause (1),-

(i) the proviso shall be omitted ;

(u) for the words "twenty-five rupees", the words ''fifty rupe~s" shall be substituted ;

(b) in clause (2),-

(i) for the words "twelve paise", the words "twtnty-five paise" shall be substituted ;

(ii) for the words "thirty-five rupees", the words "ei~hty rupees" shall be substituted .
