committee or any orher body, by whatever name called, which is authorised undcr the Camti~ion or any law for the time king in force for self-govmrance or any oher authority or budy vested with the control and management of civic swims, within 3 specified local area;

(9) "mealn means hot cwkd or pre-cooked and heated before its service meal or take home ~ i i o n , as may b-c prescribed by the Centrat Governlent; (ID) "minimum suppot price" means the assured priceannounced by the Central

Government at which foodgrains ate procured &om farmers by the Central Govemme~it arrd the State Governments and their agencies, for the c t n h l pool;

(11) "notification" means a notification issued under his Act and published it) the Oficial Gazette;

'(12) "othtt welfare schemes" means such Govcnuncnt schemes, in addition to h e Targeted Public Distribution System, under which foodgrains or meals arc supplied as part of the schemes;

(18) 'Schedule" means a Schedule appended to this Act; ( 1 9 ) "senior citizen" means a person defined as such under clause (h) of s e c ~ ~ o n 3 56 of 2007 of the Mainrenance and Welfare of Parents and Senior Citizcns Act, 2007;

(10) "social audir" means the process in which peuplc coliectively monitor and

evaluate rfie pla~nitlg and irnplernentatian of a programme or scherne; (21 ) "Smte Commission" rncarls the State Food Conml~ssion corlstituled under

section 16;

/ (32) "Slarc C;overnrnenlM, in relation to a Union temrory, means Ute Administrator rhcreor appoinled under aniclc 239 of the Constitution;

(23) "Targe~ed Public Distribution Syslern" means the system for dis~ribution of

essential c o m d i t i c s to h e ratian card holders through fair price shops;

(24) "Vigilance Committee" Ineans a cornmiace constituted ~ d e r section 29 to

supervise rhc lmplementatiw o f all S E ~ C ~ I " ~ under this Ad; I' (25) the words and cxprcssions not defined here but defined in the Essential 10 of I955 Commodities Act, 1955, or my other relevant Act shall have the meaning respectively

assigned to them in those Acts.

5. ( 1 ) Every person belonging to priorib households, identified under sub-section ( 1 ) of section 10, shall bc entltled to receive five kilograms of idgrains per person per mon1fl at subsidi~ed prices specified in Schedule I from the Statc Government under the Targeted Public Distribulion System:

(2) The entitlements of the persons helonging to the eligible households referred to In sub-section ( I ) at subsidiscd prices shall extend up to seventy-five per cent. of the mral population and up to fifty per cent, of the urban population.

(2) Every school, rtfmed to in clause (b) of sub-section (I), and anganwodi shall have facilities for cooking mrals, drinking water and sanitation:

CHAPTER 111

fc) leveraging "aadhaar-for unique identificatioi~, with biornetric information of cntitled beneficiaries for proper targeting of beriefits under this Act;

(c) preference to public institutiorls or public bodies such as Panchayats, self- help groups, co-ope.ratives, in licensing of fair price siiops and nlanagenunr of Fair price shops by women or heir collectives;

(6) Any complain;mt or thc oficer or authority againsl whom any order has been passed by o f f r c ~ referred to in sub-section ( I ) , who is not satisfied with the redrcssal of grievance may file an appeaf against such order before the Statc Commission.

(7) Every appeal under sub-section (6) shall be filed in such manner and &thin such

(a) who are or have been member ofthe All India Services or any orher civil services of the Union or State or holding a civil post under the Union or Statc having

knowledge and orpcrienct in mattm relating to food Security, policy making and administration in the field of agriculture, civil supplies, nutrition, health or any a t l i d field; or

(b) of eminence in publtc life with wide knowledge and experience in agriculture,

law, human righrs. smial service, management, nutrition, health, food policy or public

adminislratian; or

(c) who have a proven rccord of w o k relating to the itnprovemerlt of the food uld nuwition rights of the poar.

(7) The Stare Gavernmenl shall make available to the State Comrnisslon, sucll administratwe and tccllnical staff, as il !nay consider necessary fbr proper functioning ofthe Stale Commission.

((5) The method o f appointment of the staff under sub-section (3, (their salaries.

allowances and conditions of service shall be such, as may be prescribed by the State

Govenunclnt.

(9) Tfie Starc Government may remove fiom office fie Chairprsrson or any Member who--

(a ) is, or at any time has bent. adjudged as an insolvent; or

( b ) has become physically or mentally incapable of acting as a member; or

( c ) has been convicted of an offence which, in thc opinion of the State Govcm~ncnt, jnvolves moral turpitude; or

(u') has acquired such financial or other inrercsl w i s likely to affect prejudicia! ty his hnctions as. a mwhcr; or

(e) has so abused his position as to render his continuation in oficc detriments)

to the public interest.

(10) No such Chairperson or Mtmbcr shall be removed under clause (4 or clause ( e ) of sub-section (9) unless he has been given a reasonable appownity of being heard in r)le

24. ( 1 ) The State Government shall be responsible for irnpleme~~tation and

monitoring of the schemcs of various Ministries and Departments of the Central Government in accordance with guidelines issucd by the Ccntral Government for each scheme, and thcir own schemes, far ensuring food security to the targeted beneficiaries irr their Statc.

(2) Under the Targeted Public Distribution System, il shall be the duty of the State Government to--

( 0 ) take delivery or foodgrains &om the designated depots af the Ccntral Government in the State, at the prices specified in Schedule 1, organise inw-State allocations for delivery of the allgated foodgrains through their authorised agencies a1 the door-step of each fair price shop, and

( b ) erisure actual delivery or supply of the foodgrains to &e entitled persons at the prices sptcified in Schedule 1.

(3) For foodgrain requirements in respect of entitlements under sections 4, 5 and scciron 6, it shall be the rmgonsibility ofthe Slate Government ro take delivery of foodgrains

Condr~d of 28. (1) Every local authority, or any other authority or body, as may be authorised by

32. (/) The provisions of this Act shall not prccltldc the Central Govemnent or the Government from continuing or formulating other food based welfare schemes.

(2) Notwithstaviiing anything contained in this Act, the Slate Government may, continue with or formulate food or nutrilion based plansor schemes providing for benefits higher lhan

the hejlefits provided under this Act, from its own resources.

33. Any public servant or authuriry found guilty, by the State Commission at the time or deciding any complaint o r q p e a l , of failing to provide the relief recommended by h e

Dimic( Grievance Redressal Oficer, without reasonable cause, ot wilfully ignoring such

recommendation, shall hc liable to penalty ndl exceeding five dtausarrd rupees:

Provided that the public servant or the public authority, as the case may be, shall be given a rtasonablc opportunity of king heard before any penalty b imposed.

34. ( 1 ) Forthe purpose of adjudging penalty under section 33, the Srae Cammission shall authorisc any of its member la be an adjudicating officer for holding an inquiry in the prescn%cd manner aflcr giving any person concerned a reasonable opportunity of being heard for the purpose of imposing any penalty.

( 2 ) While hold~tg an inquiry the adjudicating oficershall have power to summon and

cnlorct the attendance of any person acquainted with the facts and circurnsiatrces of the case to give evidence or to produce any document which in the opinion of the adjudicating officer, may be useful for or relevant to the subject matter of the inquiry and if, on such inquiry, hc is satisfied that the person has failed to provide lhe rcliefrccom~ndcd by the District Grievance Redressal ORcer, withour reasonable cause, or witfully ignored such recommendation, hc may impose such penaliy BS he thinks fit in accordance with the provisions of section 33.

35. (1) The Centr-al Government ntay, by notifiwion, dircct that h e powerscxercisable by it (except the power to makc rules), in such circumstances and subject to such condirions and timitation$, be cxercisablealso by the Stare Gavernmenr or an officer subordinate to the Central Government or the State Government as it may specify in the n o t i f i ~ t i ~ l n .

(2)The State Government may, by notification, direct hat the powers exercisable by it (except the power to make rules), in such circumstances and subject to such conditions and ljmitafions, be cxcrcisable atso by an ofIiccr subatdinate to it as it may specify in the norificaiion.

36. The provisions o f this Acl or the schemes made thereunder shaIl have effea notwithstanding anything inconsistent therewith contained in any other law for the time

being in fbrce or in any insrrument having affect by vinue ofs-uch law.

37. (1) If the Ccnhal Government is satisfied that it is necessary or expedient so to do, it may, by n~tification, amend Schcdule 1 or Schedule 11 or Schedule Il l or Schedule 1V and hereupon Schedule I or Schcdule II or Schedule 111 or ScheduleIV, as thc case may be, shall be deemed to have been amended accordingly.

(2 ) Acopy ofevery notification issued under sub-section (I), shalt be laid before each House of Parliament as soon as may be after i t i s issued.

39. (I)'Ihe Central Govemmcr~t may, in cunsultation with rhe.Stale Governmenis and by rmtificaiion, make njles to carry aul the provisions of this Act.

(2) In panicuiiu, and without picjudice ro the generality o f the foregoing power, such n1Ies may provide for all or any of the fallowirrg matters, namely:--

fa) scheme including cost sharing for providing maternity benefit to pregnant women and lactating mothers under clause (b) of section 4;

(b) schcmcs covering entitlements under sections 4, 5 and section 6 including cost sharing under section 7;

(c) amount, time and manner of payrnenr of food security allowance 10 entitled

individuals under scczion 8;

(4 introducing schemes of cash transfer, food coupms or other schemes to the targeted kneficiaria in ordcr to ensure their foodgrains entitlements in such areas

and manner under ch~rse (h) of sub-section (2) of section 12; fe) the onms and manner of providing assistance to the Statc Governments in meeting expenditure under clause (4 o f sub-section (4) of sation 22; manner in which hmds shall bc provided by the Central (iovmirnent lo l l le State Govcmnlents h case of shoa supply of fdgrains, under sccrinn 23;

(g) any other matter which is to be, or may be, p~escribed or in respect ofwhich

(3) Every d e made by the Central Government under this Act shall be laid, as soon as may bc afier il is madc, before cach House of Parliament, while it is in session, for a tomi period of thirty days which may be comprised In one session or in two or more successive sessions, and if, before the expiry of the session hcd ia tc ly foilowing the sessiot~ or Otc successive sessions aforesaid, both Houses agee in making any modification in the rule or both Houses agree hat the rule should not be madc, the rule shall thereafter have effect only in such modified form or be ofno ere$ as the case may be; so, however, that any such modification or annulment shall be without prejudice to tht validity of anything previousiy done under that rule.

40, ( I ) The State Covcmcnt may, by notification, and subject to the condition of previous publication, and cunsistent with this Act and t]re rules made by the Central

Governmait, make mfes to camy out the provisions of this Act,

(2) In particular and witbut prejudice to the generality of the foregoing power, such

rules may providc for ail or any o f h c following matters, namely:--

(a) guidelines for identification ofpriority househotds under sub-section ( I f of section 10; #

(b) internal grievance rcdressal mechanism under section 14; ,
