An Act to regulate the recruitment and conditions of service of persons

appointed to the Madhya Pradesh Vidhan Sabha Secretariat Se rvice.

Be it enacted by the Madhya Pradesh Legislature in the T hirty-

second Year of the Republic of India as follows:-

1. This Act may be called the Madhya Pradesh Vidhan Sabha

Sachivalaya Seva Adhiniyam, 1981.

Amendment of

section ^2.

2.. In clause (a) of section 2 of the Madhya Pradesh Vidhan Sabha

Sachivalaya Seva Adhiniyam, 1981 (No. 20^of.1981), the following words shall be added at the end, namely:-

\ • "and includes a Special Secretary of that Secretariat;".

2. In this Act. unless the context otherwise re9uires,-

(a) "Secretary" means the Secretary of the Madhya Pradesh Vidhan Sabha Secretariat ; I --

(b) "Service" means the Madhya Pradesh Vidhan Sabha Secre- tariat Service ;

(c)"Speaker" means the Speaker of the Madhya Pradesh Vidhan -t, Sabha. ----

3. There shall be constituted a Madhya Pradesh Vidhan Sabha Constitution of

Provided that any rule made under clause (3) of Article 187 of the Constitution and in force immediately before the coming into force of this Act shall continue to be in force till repealed by a rule made under this section.

5. (1) The Secretary shall retire from service on the afternoon of Age of super-

the last day of the month in which he attains the age of sixty years and annuation. subject to the provisions of sub-section (3) other member of the service shall, retire on the afternoon of the last day of the month in which he attains the age of fifty eight years.

(2) A class IV employee of the service shall retire on the afternoon of the last day of the month in which he attains the age of sixty years.

(3) The Speaker may, if he considers it necessary so to do in the interest of the efficient working of the Vidhan Sabha Secretariat, grant extension to a member of the service beyond the age of superannuation for a total period not exceeding two years.

(4) The Secretary or other person appointed to the service may, in the public interest, be retired at any time after he attains the age of fifty five years without assigning any reason by giving him a written notice of three months :

Provided that the retirement can be made effective forthwith on payment of three months salary at the rate last drawn in lieu of the notice.

An Act further to amend the Chhattisgarh Yidhan Sabha Sachivalaya SevaAdhiniyam, l98l (No. 20 of 1981)

Be it enacted by the Chhattisgarh Legislature in the Sixty- fifth Year of the Republic oflndia, as follows :-

short title and l. 0) This Act may be called the Chlattisgarh Mdhan Sabha Sachivalaya Seva commencemen t' (Sanshodhan) Adhiniyam ,2014.

@ It shall come into force from the date of its publication in the Official Gazette. Amendment of 2. For sub-section (4) ofsection 5 of the Chlattisgarh Vidhan Sabha Sachivalaya Seva section s. Adhiniyam, l98l (No.20 of l98l), the followingshall be substituted, namely i '(4) The Principal Secretary/Secretary or any other person appointed to the service may, in the public interest, be retired at any time after he/she has completed 20 years qualifiing service or he/she attains the age of 50 years, whichever is earlier, without assigning any reason by giving him,fter a written notice of three months:

Provided that the retirement can be made effectiye forthwith on

payment ofthree months salary at the rate last drawn in lieu ofthe notice."
