Appel late T ribunal o f Ind ia.
P re am ble .— Whereas the Ind ust ria l Disputes (Appellate Tribunal ) Act, 1950 (Act No. X L V II I of 1950) has been repe aled and whereas i t is expe dien t to empower the Sta te Government to withdraw its order published in Notif ication No. GLR./174/54, dated the 1st Ma y, 1954 modifying the decision of the Appella te Tr ibu nal of India constitu ted under the Act so repealed, in the manner her einafte r a ppear ing ;
It is here by enacted in the Ninth Yea r of the Repub lic of I nd ia as follows :—
1. Sh or t ti tl e , ex te nt an d com m en ce m en t. — (1) This Act may be called the Ind ust ria l Disputes (Appellate Tribunal ) (Wi thdraw al of Assam Modification Orde rs) Act, 1958.
(2) It extends to the whole of Assam.
(3) It shall come into force at once.
2. P ow er to w it hdra w an y N ot if ic at io n.— Th e Sta te Governmen t may, by notification in the official Gazette , wi thdraw at any time the ord er pub lished in Notifi cation No.GL R. 174/54, da ted the 1st May, 1954 modifyin g the decision of the Appella te Tr ibu na l of India p ronounced on the 2nd April, 1954, in Appeal No.C AL/244/52 in the ma tte r of the workmen of all Te a Estates in Assam represented by the India n Nat ional Tr ad e Union Congress, Dibru gar h versus M anagem ent of al l Te a Estates in Assam, repr esented by the India n Te a Association, Ca lcu tta and others .
3. O rd er s o f w it hdra w al to have im m ed ia te ef fe ct .—The decision of the Appell ate Tr ibun al of India as referred to in Section 2 shall come into imm ediate effect unmodified as soon as the State Govern ment withdraw s the Notif ication referr ed to in the same Section.
