THE BIHAR SPECIAL SECURITY GROUP (AMENDMENT) ACT, 2010
AN
ACT
PREAMBLE:—WHEREAS, with a view to provide adequate security to the Chief Minister, Ex-Chief Ministers and immediate family members of the Chief Minister, special security group is provided under the provision of Bihar Special Security Group Act 2000.
WHEREAS, in view of the perceived threat from extremists and terrorist group it is considered expedient to provide adequate security to the Chief Minister and Ex-Chief Ministers.
NOW THEREFORE, it is necessary to amend the Bihar Special Security Group Act 2000 (Bihar Act 8 of 2000).
BE it enacted by the legislature of the State of Bihar in the sixty one year of the Republic of India as follows:-
1. Short title extent and commencement.—(1) This Act may be called The Bihar Special Security Group (amendment) Act, 2010.
(2) It shall extend to the whole of the State of Bihar.
(3) It shall come into force at once.
2. Amendment of Section -4 of Bihar Act 8, 2000.—In Section 4 of The Bihar Special Security Group Act 2000 -
(i) Sub Section (2) shall be substituted as follows, namely-
"(2)The special security group shall provide proximate security to:-
(a) The Chief Minister,
(b) Immediate family members of the Chief Minister.
(c) Ex-Chief Ministers for a period of 5 years from the date they have demitted office.
Provided that on expiry of five years after demitting office, the Ex-Chief Ministers shall be entitled to adequate security by providing sufficient security personnel, at their residence and during their movement in journey throughout the state, bullet proof vehicles etc. in such manner as may be prescribed by the State Government in the rules or by issuance of an order to that effect.
Provided further that the Ex-Chief Ministers, irrespective of their tenure would also be entitled to a free government accommodation in the protected area within Patna urban area."
(ii) A new Sub-Section (3) shall be inserted as follows and exsiting SubSection
(3) and (4) shall be renumbered as Sub-Section (4) and (5) -
"(3) If any immediate family member of the Ex-Chief Minister has also been Ex-Chief Minister, the facilities of accommodation & house guard to be provided in Sub-Section (2) shall not be duplicated."
