    An Act to provide for estnblisl1111c:nt and incorporation of the Hidayatui!ali National· University of Law, Chhattisgarh for the purposes of advancement of lcarnin~, teaching, research ,md diffusion 01· knowledge in the field nf law and allied sciences; as also to cater to the needs of th~ society by developing professional skills and lo train lawyers of nationa1 and ,,:ternational repute, train persons intending to take up advocacy, judicial service, law officers/ managers and legislative draftsman as their profession and matters incidental thereto.

    PRELIMINARY

    (i) "Academic Council" means the Acadc111ic Council of the University;

    "Schedule" means the Schedule appended to this Att;

    "Special Officer" means_ the Special Officer nppointcd by the State Government to oversee nil matters pertaining to the prepar.l!ory w0rk of setting up of the University.

    (2) The University shiill be a body corporate by the name uforesaid, having perpetuai succc~3ion and common sc,11 with power, subject to !he provisions-of'!i1is 1\ct, to acquire and hold property, to contrnc.t and shail, by the said name, sue and be sued.

    8. Chancclior of the U!livcrsily.-( I) The Chief Justice of the High Comt of Judicature of Chhattisgarh shall be the Chancellor of the University.

    (2) The Chancellor r.hall <1pp<1int the Vice Clrnnccllor of the University in accorJancc with the procedure and subject to the conditions prescribed in the. Statutes.

    9. The Powers oi the fisi::cr and tlic. Chancellor.•- (l) The Visitor and the · Chancellor shall have the following powers, n;imcly;-

    (a) to give direction, take action, or do anything as required ·under tr.e provisions of this 1\ct and the StatutcSJ

    (b) to c;iuse an inspection by such person, as· he may direct, of any work, activity or examination of the University, college, or regional centers;

    (c) to give his views or advice to •he Vice Chancellor in the matters wherein an inspection or inquiry ha~ been inndc under clause (b).

    (2) Where either the Visitor or the Chancellor of the Uni\'ersity under c!_ause (b) of sub-section(!) has ordere.d an inspection or inquiry, the University may depute one of its officers to represent it in such inspection or inquiry.

    (3) The Visitor or the Chancellor shall communir,atc the result of the inspec.tion or inquiry and his advice to the Vice Chancellor.

    (4) The resuit and the advice referred to in s·ub-scction (3) shall be communicated by the VscP- Chancellor lo the Executive Council with his comments for such action it may propose to take, and th,:: action so lakcn shall be comm,mjcatcd by the Executive Council to the Visitor or the Chancellor, as the case may be, th;o~gh the Vice Chancellor.

    (2) The Academic Council' shall have the power to propose Regulations on all the ·matters specified in (a) to (h) ubovc r.nd matter incidental and related thereto.

    18. Powers of authorities to make Regulations.- i\n authority of the University shall have the power to make Regulations, in the manner prcsc.rib-~d by the Statutes, for the conduct of its affairs and the al'f'airs of the committees conslitutcd by such authority, and such Regulations shall not be inconsistent wilh the provisions of this i\ct, Statutes and the Ordinances of the Univcr~ity:

    CHAPTER VII

    IUIVIE\V COMMISSION

    19. Appointment of a University Review Commission.- (I) The Chancellor shall, at least one~ in every five yc,irs, or as and when required, constitute a Conunission to review the working or the. University and to make rccommenclations.

    (2) The Commission shall consist of not less than three eminent educationists, one of whom shall be the Chairman of s1.mh Commission appoinlcd by the Chancellor in consultation with the State Government.

    (3) The terms a!1d conditions of the appointment of the members shall be such as the Chancellor may det~nninc.

    (4) The Cot111nis:;ion shall alicr holding such inquiry as it deems fit. make ils rcco1111ne11dation to the Chancellor.

    (5) The Chancellor may, in consult:1tinn with the Slate Govcrnlllcpl. take snch action, as he deems lit 011 the r~cornrnc11ualion lll:ldc by the IZcvicw Commission l

    20. Action not to be invali

    No act, or iule or pmcecuings of the General Council, the Executiv~ Council, the Academic Council or any other ,1uthori1y or body of the Univc:rsity shall be invalidated only on the ground or grounds that such authority or body is not duly constituted or there is a defect in its constitution or rcconslilulion al any time, or that there is a vacancy in th

    23. Aut:1ori1ir.s and officers of the University.- The auihoritics oftht: University and their composition, ·powers, ftinctions and 0ti1cr matter., relating to them and the officers of University and their appoin!mcnt, powers, functions and other m.:•tcrs n:laiing to them and all olher matters relating to t/1c financial powers, leaching, administration and management of the affairs of the University shall be gov,med by the provisions as specified in the Schedule and subject to lhe provisions of this ac( shall also be governed by the Regtllations as may be made under the provisions oflhis Act.

    24. Indemnity.- No suif, prc1scculion or other lcgai proceedings shall lie against, and no damages shall b~ clai111cd from, the Univci·sity, the ChQncci!or, the Vice Chnnccllor, the authu,tics or offic<:rs of the University or any other person in n;spcet of anything which is in good faith done or purported lo have llc~-11 done in pursuJnce of this Act or any Regulations mad;: there under. ·

    (2) The amoun! of the said Fund sliall be kept in a Scheduled Bank as defined in the Reserve Bank of.Jndia Ac!, 1934 (Central Act No. 2 of 1934), or in a corresponding new bank constituted under the Banking Companies· (Acquisition and Transfer of Undertakings) Act, 1970 (Central Act No. 3 of i 970) and- the Banking Companies (Acquisition and Transfor of Undertakings) Acl, 1980 (Central Act No. 40 of 1980) or may be invested in such securities authorized by !11e Indian Trust Act, 1982 (Central _ _Act No. II of! 882), as may be decided by the Executive Council.

    (3) The said fund may be utilized for such purpose of the University and in such manner as may be prescribed by Regulations.

    24 Annu2l Accounls, Audi( and financial estimates.-(!) The Annual Accounts of the University shall be prepared under the directions of the Executive Council.

    (2) The auditors app;intcd by the b:ccutive Council sha:I a~dit the accounts of the University, at least once in each financial year;

    Provided that there shall be a Special Audit of'the Accounts, if the Executive Co_uncil considers it necessary to do so, and auditors for sud1 special Audit shail be specified by the Executive Council.

    (3) The ae~ounts'whcn audited shall be published by the Exccuti,•e Council and a copy of the ac,;o\Jnts together with the audit rcp,,11 shall be phccd before the Executive Council and shall also be sc:bnitled to \he Chancelior and the State Government.

    (4) The Annual 1\ccmmL~ shail be considered by the General Council at its annual meeting am! it may p.iss rcso!u!ions with rdcrcncc thereto and comnnmicatc the same to the Executive Council, which shall consider the suggestions made by the General Council and take such action there on, as it thinks fit; and the Executiv,J Council shall inform the General Council al its next meeting with respect to al! actions taken by it as also tile

    reasons, if any, for not taking action.

    (5) The Executive C0:!:1cil shall prepare, before such da1c as may be prescribed by the Regulatio~s. the financial estimates for the ensuing year and place the same before the General Council.

    (6) The Executive Co11ncii may, in cases where expenditure is to be incurred in excess of the amount provided in the budget or in cases Gf urgency for reasons to be recorded in writing, incur such ex.pcnditure subject to such restrictions and conditions as may be specified in the Regulations; and, where no provision has been made in the budget in respect of such excess expenditure, a report shall be made lo the General Council at its . . next meetmg. -- . · ' ,

    An Act to amend lhe Hidayatullah National University of Law Chbattisgarh Adhiniyam, 2003 (No._ IO of 2003).

    Be it enaL!cd by the Chhattisgarh Legislature in :he Sixty-firstY ear of the Republic of India as follows :-

    (I) This Act may be cal.led the Hidayatullah National University of Law ChhaUisgarn (Sanshodhan) Adhiniyam, 2010.

    (2) It s:-iall mme into force on the date of its publication in the Official Gazette. In sub-section (I) of Section 7 of the Hidayatullah National Uni".ersity of Law Chitattisgarh .'\jiJiniyarn, 2003 (No. IO of2003) for the words "The Chief Justice of the Supreme Court of India shall be the Visit,1r of the University" the wonts ·The Chief Justice of :he Supreme Court of India or his nominee, who shall be a sitting Judge of the Supre;-ne Court of India sha!I h1:: the Visitor'' shall be substituted.
