(1) Au election under clauses (h), (i), (j) and (k) of suit- w<,,!<' oC section (1) of see!ion 4 shall be conducted by the Council and election, an election under clauses (g), (!) and (in) of sub-section (I) of sccLton 4 shall be conducted by the bodies referred to therein in Llic prescribed manner.

(2) If any of the bodies referred lo in clauses (g), (I) and

(m) of sub-section (1) oT section 4 docs not, by such dale as may lie prescribed, elect a person to be a member of the Council, the Slide Government shall, by order in wriliug, appoint to (he vacancy a person qualified for election ihcrcto; anti the person so appointed shall he deemed to he a member of the Couutil as it lie had been duly elected by the said body.

(3) Where any dispute arises regarding any election to the Council, it shall be referred to the State Government lviihin such period.as may be prescribed and the decision of the Stale Government thereon shall be final,

Provided that notwithstanding the expiry of his term, such member shall continue to hold office until Lhc election or scfcc- fidn, as tfic case may be, of his successor is duly notified in the Gazette. • ,

8. (1) An elected or nominated member may at any Lime, Casual vacancies, resign his membership by tendering Ids resignation in. writing- under Ids hand to tlic President, and his scat shall thereupon become vacant.

(2) An elected or nominated member shall be deemed to have vacated big scat if—

(i) lie is absent without excuse sufficient in the opinion of the Council, from three consecutive ordinary meetings, of the Council; or

(ii) lie is absent out of India for a period exceeding six ; consecu live months; or

(iii) is name is removed from the State Register under i section 17. ■

(") If any question, dispute or doubt, arises wheiher a yacaney has occul ted under .sub-section (2), it shall be decided ■ by the State Government and its decision shall he final.

(4) A casual vacancy in (he Council shall be filled by elee- ! tion or nominal ion, as ihe ease may be, and the person elected ' ' or noinitmled to fill I he vacancy shall bold ollice for the uu- expjjcd term of his predecessor. i

An Act to consolidate the laws relating to registration o(

Nurses, Mid,rives, Auxiliary Nuiso-Midwivcs and Ucallh

Visitors in Madhya Pradesh and to make provision for (he constitution of the Nurses Registration Council for the Stale and lor matters connected therewith. He it enacted by the Madhya Pradesh Legislature in the Twenty-third Year of the Republic of India as follows:— PART I—PRELIMINARY

1. (1) 'I'his Act may be called the Madhya Pradesh Up-Short title, charika, I'rasavika, Salmi Upcharika-Prasavika Tallin and commence- Syyqtbya Paridaishak Registration Adhiniyam, 1972. mentu

2. In this Act, unless the context otherwise requires,—

tration Council, established under section 3;

(b) "Nurse" includes a male nurse;

(c) "recognised qualification" means any of .the qualifita-. lions un billed in the Schedule to the Indian Nurs- ing Council Act, 1947 (No. 48 of 1947);

(c) Two Matrons from Medical College Hospitals nomi- nated by the State Government by rotation;

(f) Two -Sister tutors of Schools of Nursing in Madhya - Pradesh nominated by the Stale Government by rotation; '

(g) One nurse elected by the Madhya Pradesh Branch of trained Nurses Association from amongsf the registered nurses residing in Madhya Pradesh;

(b) Three nurses elected by registered nurses other than those who-are members of the Madhya Pradesh Board of Trained Nurses Association from amongst themselves of whom one shall be male nurse;

(i) One midwife elected by registered xnidwives bjm amongst themselves;

(j) One auxiliary nurse-midwilc elected by registered. auxiliaiy nursc-midwivcs from amongst them- selves ; ~

(k) One health visitor elected by registered health visi- tors from amongst themselves;

(l) One member elected by the Madhya Pradesh Branch of the Red Cross Society Iioin amongst its mem- bers residing in Madhya Pradesh.;

(m) One member elected by Mid-India Board, of Exami- ners from amongst its members:

(3) Where any dispute arises regarding any election to Lhe Council, it shall he referred to the State Government within such period .as may be prescribed and the decision of the Stale Government diet eon shall be final,

(2) Every member of the Council other than an cx-ollicio Council, member, shall hold office for a term of three years from the date, his election or nomination is notified in the Gazette under sub- section (2) of section 4:

Provided that notwithstanding the expiry of his term, such member shall continue to hold office until the election or sclcc- tidh, as the ease may be, of his successor is duly notified in the Gazette.

8, (1) An elected or nominated member may at any lime, Casual vacancies, resign his membership by tendering his resignation in. writing under his band to the President, and his scat shall thereupon become vacant.

(2) An elected or nominated member shall he deemed to have vacated his seat if—

(i) he is absent, without excuse sufficient in the opinion of the Council, from three consecutive ordinary meetings, of the Council; or

' (ii) he is absent out of India for a period exceeding six consecutive months; or

(iii) is name is removed from the State Register under section 17-

(3) If any rpiestion, dispute or doubt arises whether a vacancy has occurred under sub-section (2), it sh'all be decided by the Slate Governmvtit and its decision shall he final.

As from the date specified for the establishment of the Council under sub-section (I) of section 3, the Central Provinces and Berar Nurses Registration Act, I93G (No. 23 of 1936), and the Madhya Pradesh Siat'olory Bodies (Re- gional Constitution) Act, 1956 (No. i7 of 1956), in so far as it relates to the said Act, the Madhya Bharat Rais Registra- tion Act, 1953 (No. 22 of 1953), and the Madhya Bharat Nurses, Midwives and Health Visitors Registration Acl, 1955 (No. 2 of 1955), shall stand repealed.

(3) No school, hospital or other institution which is not approved anil recognised uniter tiiis section shall issue to any person a certificate oc-enter the name of any [....sou in any document purporting to show Unit such person is qualified by reason of his having passed any examination or undergone any course of training to practise as a nurse, midwife, auxiliary nurse-midwife or lioallh visitor, unless his name is registered or entered in the list under this Act.

(5) Where a person committing an offence under this section is a company or other body corporate or an association of persons {whether incorporated or not), every person who at the time of the commission of the ofTencc was a director, manager, secretary, agent or other uflicer or person concerned with the management thereof shall, unless lie proves that the offence was committed without his knowledge or consent, be deemed to (bc guilty of such oilen'ce.

Appeal against 25. Any person aggrieved by the refusal of the refusal to recog. (G) The Registrar shall, as soon as may be, after the expiry of the period specified in sub-section (2) or such further period as may be extended thereunder, publish tlie list 'of persons prepared under sub-section (!) in lhe Gazelle and the publication of such list sliall be tlie conclusive evidence of the eligibility of lhe person included, therein to practice as a nurse, midwife,. auxiliary nurse-' midwife, lieallli visitor, or dai, as tlie case rimy be, in :

18. (2) The Council may direct the removal altogether, or for a specified period from the State Register of the n'ame of any registered nurse, midwife, auxiliary nurse-midwife or health visitor for the same reasons for which registration may be pro- hibited by the Council under sccLion 17.

(3) The Council may tlirert that, any name removed under subsection (2) shall he restored subject to such conditions, if buy, which the Council may deem fit to impose.

19. For the purpose of any enquiry under section 15 or section 17. 'the Council or any committee authorised by rides made, under section 33 shall he deemed to be a Court, within ■ tlic meaning of the Indian Evidence Act, 1872 (f of 1872), and shall exercise all the powets of a. Commissioner appointed under the Public Servants (Inquiries) Act,, 1850 (37

20. (I) An appeal shall lie to- die State Government against every decision of the Council under section 15 or. sec- . tion 17 and the decision of the Stale Government thereon shall be fin.ib

(2) Every appeal under sub-section (1) shall be preferred within three months from (he date of the receipt by the parly concerned of a copy of such decision.

21. All fines realised under this Art. and .all moneys received by the Council under this Act shad be applied fur the purposes of tin's Act or the rides or. the regulations made thereunder.
