THE BIHAR FISH JALKAR MANAGEMENT (AMENDMENT) ACT, 2010
AN
ACT
TO AMEND THE BIHAR FISH JALKAR MANAGEMENT ACT, 2006 [Bihar Act 13 of 2006] Preamble:—WHEREAS, there is immense potential of Fishery development in the State of Bihar,
AND, WHEREAS, the State Government has launched various schemes to augment fishery production by introduction of technology and imparting training to the traditional fisherman,
AND, WHEREAS, the policy of the State Government is to settle sairats comprised of water bodies with traditional Fishermen Co-operative Society for enhanced fish production which will ultimately add to GSDP of the state,
AND, WHEREAS, the increasing number of Fishermen Co-operative Societies in each block is resulting in large number of disputes amongst Fishermen Societies, adversely affecting fish production and productivity in the State, BE it enacted by the Legislature of the State of Bihar in the Sixty One year of the Republic of India as follows:—

1. Short Title, Extent and Commencement.—This Act may be called The Fish Jalkar Management (Amendment) Act, 2010
(ii) It shall extend to the whole of the State of Bihar.
(iii) It shall come into force on such date as the State Government may, by notification, in the Official Gazette, appoint, and different dates for coming into force for different provisions of this Act, may be appointed.
2. Amendment in Section-2 of Bihar Act, 13, 2006.- In Section 2 (ix), the words and figure "and Bihar Self Supporting Co-operative Societies Act, 1996" shall be deleted.
3. Amendment in Section-5 of Bihar Act, 13, 2006.- In sub-section (i) of Section 5, the word "five" shall be substituted by the word "seven".
4. Amendment in Section 14 of Bihar Act, 13, 2006.- The following amendments shall be made in Section-14 of the Bihar Fish Jalkar Management Act, 2006:-
(1) In sub-section (i) of Section 14, the words " Director, Fisheries " shall be substituted by the words " Divisional Commissioner".
(2) In sub-section (iii) of Section 14, after the words " Short term settlement taken by the ", the words " Divisional Commissioner and the" shall be added.
