It is hereby enacted in the Fifty-ninth Year of the Republic o f India as follows:-

1. (1) This Act may be called the G·uwahati Waterbodics (Preservation and Conservation) Act, 2008 .

(2) It extends to the jurisdiction of Guwahati Metropolitan Development Authority.

(3) It shall come into force at once.

(a) "Competent Authority" means the Gmvahati Metropolitan Development Authority constituted under the Guwahati Metropo litan Development Authority Ad, 1985 l)r any other Authority whenever State Government specially empowered in this behalf :

"Jirat" means any structures raised by the owner and includes trees;

"Owner" means a land holder and settlement holder other than land holder who holds land under the Assam Land and Revenue Regulation, 1886 and shall include a mortgagee, lessee or a tenant under the Assam (Temporarily Settled Areas) Tenancy Act, 1971;

"Waterbodies" means the area or area,, of land where the rain water accumulates and act as natural or storm water reservoir and shall include wetland.

Notwithstanding anything contained in any other laws enacted by the State Legislature which are ftn the time being in force in Assam, the areas of the land specified in the Schedules I, IL, m and rV of this Act shall be the waterbodies. Notwithstanding anything cont;; ined i.n any other laws enacted by the State Legislature which are for the t.ime bd ng in force in Assam, the area of land specified in the Schedules I, JI, III and IV of this Act shall he used as waterbodies and no person after coming into force of this Act shaH-

(i) undertake any activities including the filling up of watcrbodies which may cause damage or reduce the size o f the waterbodics;

(ii) construct or erect any $tructurc \n !fa~ waterbodies;

(iii) dump or throw solid waste or gw bag,; in the waterbotlics;

(iv) extend or reinforce of any building standing upon th..: waterbodies;

(v) carry out any kiud of bw~ it·c~ -, t:x~ept fish curing, aqua culture, conservation measure and tlooJ control measures, that too with the specific previous permission o f the Competent Authority. Appeal 5. Any person aggrieved by the order of the Competent Authority under clause (v) of section 4 may prefer an appeal before the State Oovcrnment within thirty days from the date of such order, whose decision thereon shall be final. Penalty 6. (1) Whoever violates any one or more of the provisions of section 4 shall commit an offence which shall be punishable with imprisonment for a term which may extend to three years or with fine which may extend tl> fifty thousand rupees or with both.

(2) A person who abets any of these offences as aforesaid shall he liable for the same punishment as provided for the offence .

(3) The offences committed uudcr this Act shaH be treated as cognizable offence under the Code of Criminal Procedure, 1973 and shall be tried accordingly.

9. The Government may, by notification in the o fficial Gazette, make rules for carrying out the purposes of this Act.

10 If any difficulty arises in giving effoct to the provisions of this Act, the Oovernment ·may, by notification· in the oll1ci.al Gaze!h'., .

11. Notwithstanding anything contained in the Assam Hill Land and Ecological Sites (Protection and Management) Act, 2006, or any other Acts emtdcd by the State Legislature for the time being in force in Assam, the provisions of this Act shall have effect in the areas mentioned in t-he Schedules I, II, TH and IV of this Act.
